AN ORDINANCE providing for and requiring the construction of cer-
tain sidewalks along certain streets in the City of Salina.
WHEREAS, petitions each duly signed by ten or more citizens
of the City of Salina, have been filed in the office of the City
Clerk, praying for the construction of sidewalks along the streets,
and in front of and abutting upon the property, mentioned in the
following ordinance, and
WHEREAS, said petitions have been considered by the Board of
Commissioners of the City of Salina and have been found to be
sufficient and the sidewalks hereinafter referred to are by said
Board of Commissioners deemed to be necessary; NOW THEREFORE,
BE IT ORDt?INED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That concrete sidewalks shall be and the same
are hereby ordered to be constructed and laid along the following
streets and in front of the abutting upon the following described
lots, tracts and pieces of land, said concrete sidewalks to be
five feet in width, to -wit:
Along the west side of Eleventh Street lying; in front of
and abutting upon the east side of Lots 1, 2, 3, 4 and 5, on
Eleventh Street in Brown's addition,
Along the east side of Eleventh Street lying in front of
and abutting upon the west side of Lots 15, 17, 19, 21 and 23 on
Eleventh Street in Seitz Second Addition, and Lots 2, 4 and 6,
Block 4, Surveyors Plat 10.
Along the west side of '!'enth Street lying in front of and
abutting upon the east side of Lot 10 and South one-half Lot 6,
Block 16, South Park addition.
Along the east sine of Tenn atreet between Gypsum and iron
abutting upon the west side of the north 5 feet of Lot 13, Lot 12,
and the south 30 feet of Lot 11, all in Block 8, Oakdale Addition,
(also 20 ft. alley belonging to city).
Along the east side of rvinth Street between ItiAnneapolis and
Beloit abutting upon the west side of Lots 14, 16, 18, 20, 22 and
24 on Ninth Street, Grounds of Kansas Wesleyan University.
Along the east side of Twelfth Street between Washington and
Morrison abutting on the west side of Lots 1, 3, 5, 9 and 11 in Block
4, heplat of part of Morrison's Third Addition. Also along the north
side of, and abutting upon, the west 84 feet of Lot 1, Block 4 Replat
of part of Morrisons Third 11daition, ' p
just east of Twelfth.) Con south side of Morrison Avenue
Section 2. That the sidewalks provided for in the pre-
ceding sections of this ordinance shall be constructed and laid
in accordance with the Provisions of Ordinance No. 2407 and
Ordinance No. 3509 and in accordance with the plans and specifications
for concrete sidewalks on file in the office of the City Engineer
and in the office of the City Clerk, pursuant to the provisions
of said ordinance No. 3509, which plans and specifications have
been and are now hereby approved, the same to be constructed at
the grade to be furnished by the City Engineer.
Vection 3. That the owners of each of the lots and parcels
of land described in the preceding sections of this ordinance be
and they are hereby ordered to construct in front of and abutting
upon said lots or parcels of land, and along the streets herein-
above mentioned, concrete sidewalks as above provided for, and if
any one of them shall fail within 15 days from and after the publi-
cation of this ordinance to construct such sidewalks, the City
Engineer shall prepare and file with the City Clerk detailed estimates
under oath of the cost of constructinE, such sidewalks and the Board
of Commissioners of said city, shall proceed to construct or cause
to be constructed such sidewalks as Herein provided for and may let
a contract therefor, at a cost not to exceed the estimate of the
City Engineer, and shall assess the cost thereof against such lots
or parcels of land upon which such sidewalks shall abutt, according
to the front foot thereof, and such cost so assessed shall be duly
certified by the City Clerk to the County Clerk of Saline County
to be collected as other taxes and assessments are collected.
Section 4. This ordinance shall take effect and be in force
from and after its publication once in the official city paper.
