3688 Confirming Utility ImprovementsuhDINANCE NO. 3688 ( Publishes in the Salina Journal �_D 1929 ) AN OhDINANCE ratifying and confirming a contract for the construc- tion of Storm Sewers No. 9 and 10 in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor Construction Company hereinafter referred to as the contractor as submitted to the Board of Commissioners on March 18th, 1929, and as modified by the Supplemental proposal submitted to the Board of Commissioners by said contractor on blarch 25th, 1929, which is hereby found and determined to be the lowest and best bid for such work, and the contrac awarded by the Board of Commissioners of said city to said contractor and signed on behalf of said city by its acting Mayor on March 25th, 1929, for the construction of Storm Sewers No. 9 and 10 as provided for by ordinance No. 3605, said storm sewers to be constructed of No. 1 Vitrified Segment Block in sizes 72 inch to 36 inch, inclusive, and of No. 2 double strength Vitrified Clay Pipe in sizes 21 inch to 12 inch, inclusive, at and for the unit prices contained in said proposal and supplemental proposal, which proposals and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposals being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer filed in the office of the City Clerk, which estimates are hereby referred to and made parts of this ordinance. Section 2. 1"hat said Storm Sewers No. 9 and 10 shall be built and constructed in accordance with the plans and specifications there- for prepared by the City Engineer and on file in the office of the City Clerk, and in accordance with the proposal and supplemental pro- posal of said contractor and under the terms of said contract, all fo which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the k ayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 6 percent per annum and to mature not later than June 1st, 1930, and to be issued in such amounts and at such time as money for the payment of the cost of such work may be re- quired, suc$ notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
