4500 Gambling Devices428 ORDINANCE N0. 4500 (Published in the Salina Journal 14 z 1935) -- - -- - - --- _ _ - _— - — - - AN CRDI21ANCE relating to slot machines and other gambling devices; prohibiting the keeping or maintaining of such devices, and defining certain misdemeanors and providing a penalty for the violation of this ordinance. BE IT ORDAINED by the Board of Commissioners of the City of Salina: Section 1. Any person who shall set up or keep in any place In the City of Salina, any slot machine, or other gambling device, designed or devised for the purpose of gambling or of playing any game of chance for money or property or which is in face commonly used for such purpose or who shall induce or permit any person to sue or manipulate such machine or device or shall keep any such machine or device in any place where the same may be used by others, shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than $100.00 nor more than $500.00 for each offense or by imprisonment for not more than 30 days or by both such fine and imprisonment, and each day upon which any violation shall continue shall be deemed a separate offense. Section 2. Upon conviction of any person or persons under the provisions of this ordinance, the court shall as a part of its judg- ment order the destruction of all slot machines or gambling devices used by or in the T>ossession of the defendant, and the chief of police shall execute such judgment or order by publicly destroying such slot machine or other devices. Section 3. It shall be the duty of the police officers of the City of Sal na to seize and take possession of any slot machines or other gambling devices as defined by this ordinance wherever the same may be found in the City of Salina, and to arrest the owner thereof and any person in control or possession of such machine if he can be found, and or if no` person claims the same as owner or otherwise within ten days after the same shall have been seized, the Chief of Police of said city is hereby authorized and directed to destroy any such machine without further notice to the owner thereof.
