AN ORDINANCE regulating the construction of chimneys, flues and fire-
places and providing penalties for the violation thereof.
BE IT OhDAiNED by the Board of Cott Ussioners of the City of Salina,
Kansas:
Section 1. All chimneys, flues and fireplaces hereafter
built or rebuilt in all public or private buildings in the City of
Salina, Kansas, shall conform to all the provisions and requirements
of this ordinance.
Section 2. If any chimney, flue or fireplace is, or shall
be of such construction or in such condition as to be liable to set
a fire, the use of such chimney, flue or fireplace for firing purposes
is and shall be prohibited.
Section 3. Except as herein provided, all chimneys in every
building hereafter erected and all chimneys hereafter rebuilt, re-
gardless of the kind of fuel used, shall be built of brick, concrete,
or stone and shall be lined continuously from the bottom b its extreme
height with fire -clay flue lining or with fire brick. Chimneys built
of brick or concrete shall have walls at least four inches thick and
if built of stone the walls shall be at least eight inches thick.
Brick set on edge shall not be permitted in chimney construction.
Chimneys built of concrete shall be reinforced vertically and horizontally
to avoid cracking.
Section 4. Chimneys ahall not rest upon or be carried by
wooden floors, beams or brackets, or be hung from wooden rafters.
Iron brackets or stirrups attached to wooden construction shall not
be used to support chimneys. In frame bui dings, chimneys shall be
built from the ground up or rest on basement walls.
Section 5. No wall less than 12 inches thick shall be used
to support a corbeled chimney and such corbeling shall not project
more than 6 inches from the wail and shall consist of at least five
courses of brick.
Section 6. All chimneys shall be built as nearly vertical
as possible and shall extend at least 3 feet above flat roofs and
2 feet above the ridges of peak roofs. Portland cement mortar only
shall be used in the construction of chimneys, except where fire
brick is used for lining, when fire -clay mortar shall be used.
Section 7. Fetal smokestacks may be permitted for boilers,
furnaces and similar apparatus, provided they have a clearance from
all combustible material of not less than one-half the diameter of
the stack, but in any case not less than 9 inches. Where such stack
passes through a roof, it shall be guarded by a galvanized thimble
extending from at least 9 inches below the underside of the ceiling
or roof beams to at least 9 inches above the roof, and the diameter
of the ventilating thimble shall be not less than 36 inches greater
than that of the smokestack. Metal smokestacks shall be permitted
to pass through floors.
Section 8. The fireback of every fireplace hereafter erected
sgall be not less than 8 inches in thickness of solid brickwork,
or not less than 12 inches of stone lined with fire brick. "'hen a
grate is set in a fireplace a lining of fire brick at least 2 inches
in thickness shall be added to the fire back; or a lining of soap-
stone, tile, or cast iron may be used, if solidly backed with brick
or concrete.
Section 9. No wooden beams or joists shall be placed within
2 inches of the outside face of a chimney or flue, whether the same
be for smoke, air, or any other purpose.
No woodwork shall be within 4 inches of the back wall of any
fireplace.
All spaces between the chimney and the wooden beams shall be
solidly filled with mortar, mineral wool, or other incombustible
material.
The header beam, carrying the tail beams of a floor, and
supporting the trimmer arch in front of a fireplace, shall be not
less than 20 inches from the chimney breast.
No wooden furring or studding shall be placed ag4inst any
chimney; the plaste.rin" shall be directly on the masonry, or on metal
lathing.
Woodwork fastened to plaster which is against the masonry of
a chimney shall have a layer of asbestos board at least 1,/8 inch thick
placed between the woodwork and the plaster.
Section 10. No smoke pipe shall be within 9 inches of any
woodwork, or any wooden lath and plaster partitions, or c,ilings,
Where smoke pipes pass through a wooden lath and plaster partitiom
they shall be guarded by galvanized iron ventilated thirbles at least 12
inches larger in diam(ter than the pipes, or by galvanized iron thimbles
built in at least 8 inches of brick work or other incor::bustible material,
No smoke pipe shall pass through any floor, or combustible roof
of any building.
Section 11. The Building Inspector and the Chief of the Fire
Department or their duly authorized assistants shall have concurrent
authority to enforce or cause to be enforced the requirements and pro-
visions of this ordinance, It shall be their duty to inspect all new
and rebuilt chimneys and for that purpose they shall have the right
to enter any bui :ding during reason. -.tile hours. The;� shall have the
power and authority to condemn any and all chimneys which in their
opinion are in an unsafe or dangerous condition or th.e construction
of which does not cori:ply with the requirements and provisions of this
ordinance and shall order such chimneys as he may condemn to be re-
pairs, rebuilt or torn down, and such order shall be complied. with
within ten days and the use of the same shall be iramed.iately dis-
continued.
Section 12. i�ny person, firm or corporation violatine,any
of the provisions of this ordinance shall be deemed guilty of a mis-
demeanor, and, upon conviction thereof, shall. be fired in any surr,
not less than five dollars (1�5) nor more than twenty-five (;;25) for
each offense. Each day that any cf the provisions of this ordinance
shall be violated shall constitute a separate offense.
Section 13. That Section 40 of ordinance No. 2993 being
Section 5-240 Revised ordinances 1925; Sections 1 and 2 of ordinance
3076 being Sections 10-119 Revised ordinances 1925 and Sections 44
of Ordinance 635 being Sections 15-1.10 Revised Ordinances 1925 and
all other ordinances or parts of ordinances in conflict with the
provisions of this ordinance be and the sante are hereby repealed.
Section 14 This ordinance shall take effect and be in force
at the expiration of 30 days from and after its Publication in the
official city paper.

AN ORDINANCE regulating the construction of chimneys, flues and
fireplaces and providing penalties for the violation there-
of.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas;
Section 1. All chimneys, flues and fireplaces hereafter
built or rebuilt in all public or private buildings in the City
of Salina, Kansas, shall conform to all the provisions and re-
quirements of this ordinance.
Section 2. If any chimney, flue or fireplace,is, or shall
be of such construction or in such condition as to be liable to
set a fire, the use of such chimney, flue or fireplace for firing
purposes is and shall be prohibited.
Section 3. Except as herein provided, all chimneys in every
building hereafter erected and all chimneys hereafter rebuilt,
regardless of the kind of fuel used, shall be built of brick,
concrete, or stone and shall be lined continuously from the bottom

grate is set in a fireplace a lining of fire brick at least 2 inches
in thickness shall be added to the fire back; or a lining of soap-
stone, tile, or cast iron may be used, if solidly backed with brick
or concrete.
Section 9. No wooden beams or joists shall be placed within
2 inches of the outside face of a chimney or flue, whether the same

Section 11. The Building Inspector and the Chief of the
Fire Department or`,their• duly authorized assistants shall have
concurrent authority to enforce or cause to be enforced the re-
quirements and provisions of this ordinance. It shall be their
fluty to inspect all new)and rebuilt chimneys and for that purpose
theyshall have the right to enter any building during reasonable
hours. They shall have the power and authority to condemn any
their
and all chimneys which in XU opinion are in an unsafe or dangerous
condition or the construction of which does not comply with the
requirements and provisions of this ordinance and shall order such
chimneys as he may condemn to be repairs, rebuilt or torn down, and
such order shall be complied with within ten days and the use of the
same shall be immediately discontinued.
Section 12. Any person, firm or corporation violating any
of the provisions of this ordinance shall be deemed guilty of a
misdemeanor, and, upon conviction thereof, shall be fined in any
sum not less than five dollars ($5) nor more than twenty-five ($25)
for each offense. Each day that any of the provisions of this
ordinance shall be violated shall constitute a separate offense.
Section 13. That Section 40 of Ordinance No. 2993 being
Section 5-240 Revised Ordinances 1925; Sections 1 and 2 of Ordinanod
3076 being Sections 10-119 Revised Ordinances 1925 and Sections 44
of Ordinance 635 being Sections 15-110 Revised Ordinances 1925 and
all other ordinances or parts of ordinances in conflict with the
provisions of this ordinance be and the same are hereby repealed.
Section 14. This ordinance shall take effect and be in
force at the expiration of 30 days from and after its publication
in the official city paper.
