3624 Prohibiting Storage of ExplosivesOrdinance No. 3624 (Published in the Salina Journal-, 192q) AN OhDINnNCE prohibiting the storage of certaine xplosives in the Cite of Salina. BE IT UkDAINED by the Board of Commisgioners of the City Of Salina, Kansas: Section 1. It shall be unlawful to store or keep any dynamite, nitroglycerine, giant powder or other explosives other than gunpowder in any storeroom, wareroom, building, or on any premises within the city limits, except by special pern;it granted by the board of Com- missioners, which permit shall specificially state the location at which, and the conditions under which, any such explosive shall be kept or stored, and which permit shall be revocable at any time by such Board, and. su.ch explosives when any such permit is granted, shall be kept only in a building specifically provided for such purpose, and xhich when so used shall be placarded on each side with red signs on which the words "Danger", "Explosives" and "Keen i°wa.y" in letters at least six inches high shall be placed and such building small not be nearer to any other building or structure than the distance fixed in such permit, and it shall be unlawful for any owner or person in charge of such. building to permit :any other person, except tike duly authorized employees of such owner or person in charEe, to go nearer to such building, or to smoke, or to light any match or other fire, or to permit to be lighted any match or other fire, or to have any light, fire or any lighted cigar, cigareete or pipe, or to have or permit any electric wire, electric liLht, or other light, or to set off or to cause or permit to be set off' any ex- plosive charge, nearer to such building than the distance fixed in such permit; Provided, howetver, that nothin�z herein contained shall relieve any such person, firm or corporation from any liability from damage caused by the keeping or storing of such explosives, whether by virtue of such permit or otherwise, nor, shall the City of Salina be responsible for any damage caused by the keeping or storing of any such explosives, by virtue of any such permit. Section 2. 'That the keeping and storage of gunpowder in the City Of Salina shall be regulated in all respects by the provisions of Section 516,7 and 8 of ordinance No. 3076, as now,. in 'orce, being Section 10-122 to 10-125 inclusive, of hevised Ordinances 1925. Section 3. tiny person, firm or corporation violating any of the provisions of this ordinance or the provisions or conditions of any special permit issued as provided for herein, shall be fined not less than 'x'5.00 nor more than X500.00 for each offense and every aay that any of the terms, conditions or provisions of this ordinance or any such per- mit are not corr:plied with or are violated, shall be considered a separate offense. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Sedtion 1. It shall be unlawful to store or keep any dynamite, nitroglycerine, giant powder or other explosives other than gunpowder in any storeroom, wareroom, building, or on any premises within the city limits, except by special permit granted by the Board of Commissioners, which permit shall specifically state the location at which, and the conditions under which, any such explosive shall be kept or stored, and which permit shall be revocable at any time by such Board, and such explosives when any such permit is granted, shall be kept only in a building specifically provided for such purpose, and which when so used shall be placarded on each side with red signs on which the words "Danger", "Explosives" and "Keep Away" in letters at least six inches high shall be placed and such building shall not be nearer to any other building or structure than the distance fixed in suc$ permit, and it shall be unlawful for any owner or person in charge of such building to permit any other person, except the duly authorized employees of such owner or person in charge, to go nearer to such building, or to smoke, or to light any matc$ or other fire, or to permit to be lighted any match or other fire, or to have any light, fire or any lighted cigar, cigarette or pipe, or to have or permit any electric wire, electric light, or other light, or to set off or to cause or permit to be set off any ex- plosive charge, nearer to such building than the distance fixed in such permit; Provided, however, that nothing herein contained shall relieve any such person, firm or corporation from any liability from damage caused by the keeping or storing of such explosives, whether by virtue of such permit or otherwise, nor shall the City of Salina be responsible for any damage caused by the keeping or storing of any such explosives, by virtue of any such permit. Section 2. That the keeping and storage of gunpowder in the City of Salina shall be regulated in all respects by the provisions of Section 5, 6, 7 and 8 of Ordinance No. 3076, as now in force, being Section 10-122 to 10-125 inclusive, of Re= vised Ordinances 1925. Section 3. Any person, firm or corporation violating any of the provisions of this ordinance xkKit or the provisions or conditions of any special permit issued as provided for herein, shall be fined not less than $5.00 nor more than $500.00 for each offense and every day that any of the terms, conditions or pro- visions of this ordinance or any such permit are not complied with or are violated, shall be considered a separate offense.
