AN ORDINANCE ratifying and confirming a contract for the building and
construction of a certain main sanitary sewer in train Sewer Dis-
trict "Q" and for the construction of certain lateral sanitary
sewevs in Lateral Sanitary Sewer Districts No. 152 and 155 and
providing for the issuance of temporary notes to pay the cost
thereof pending issuance and sale of bonds.
BE, IT OnDAINED by the board of Commissioners of the City of Salina,
Kansas;
Section 1. That the acceptance by the City of Salina of the
proposal of H. J. Taylor Construction Company, hereinafter referred
to as the "Contractor" as submitted to the Board of Commissioners on
October 15th, 1928, which is hereby found and determined to be the
lowest and best bid for such work, and the contract awarded by the
Board of Commissioners of said city to said contractor and signed on
behalf of the city by the Mayor on October 15th, 1928, for the building
and construction of a certain main sanitary sewer in wain Sewer Dis-
trict "Q" as provided for in Ordinance No. 3606 and for. the construction
of certain lateral sanitary sewers in Lateral Sanitary Sewer Districts
No. 152 and 155 as provided for in Ordinance No. 3607 at and for the
unit prices contained in said proposal, which proposal and contract are
hereby referred to and made parts of this ordinance, be and the same is
hereby ratified and confirmed, said proposal beim; within the estimated
cost of said improvements as shown by the sworn estimate of the City
Engineer filed in the office of the City Clerk, which estimates are here-
by referred to and made a part of this ordi:,ante.
Section 2. That said main sanitary sewer and said lateral sanitary
sewers shall be built and constructed in accordance with the plans and
specifications therefore prepared by the City zngineer on file in the
office of the City Clerk and in accordance with the proposal of said con-
tractor and under the terms of said contract entered into between the
city and said contractor on October 15th, 1928, which said plans,
specifications, proposal and contract are hereby referred to and made
parts of this ordinance, said work to be done and the material, equipment,
appliances and appurtenances necessary and required in connection there-
with to be performed and furnished in accordance with said plans and
specifications, conaitioned however upon the furnishing by the contractor
of the contract, maintenance and statutory bonds within the time required
of said contract.
Section 3. That temporary notes signed by the hiayor and attested
by the City Clerk be issued from tirrie to time as the work progresses
in the manner and form as required by law, the total amount thereof
not to exceed tree contract price for such work, such notes to bear
interest not to exceed 4-1/4% per annum and to mature not later than
June 1st, 1929, and to be issued in such amounts and at such time as
money for the payment of the cost of such work may be required, such
notes to be issued to said contractor and to be redeemed and cancelled
at the time that permanent bonds are issued in lieu thereof.
