AN ORDIINANCE creating and defining certain Lateral Sanitary Sewer
Districts in the City of Salina, designated as Lateral
Sanitary Sewer Districts No. 152 and 155 and providing
for the construction of lateral sanitary sewers in the
districts created; providing for the cost thereof and for
the levy of special assessments to pay such cost.
BE Ii, UhDAII'�ED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. LATERAL SANITAFY SEI+'ISR DISTIRICT 110. 152. That
there be and there is hereby created a Lateral Sanitary Sewer
District in the City of Salina which will be designated as Lateral
Sanitary Sewer District No. 152, which shall include all of the
following described property in said city, to -wit:
West 1/2 of Blocks 1 and 10 and the east 1/2 of Blocks
2 and 9 in Southern Heights Addition.
Section 2. That it is necessary and it is hereby ordered
that a Lateral Sanitary Sewer together with all necessary inlets,
inlet connections, manholes, head walls and other appurtenances,
be constructed and built in Lateral Sanitary Sewer District No.
152 along the following described course within said district,
as follows:
Beginning at a manhole in Hain Sewer "Q" at Venango and
Custer Streets, thence north approximately 460 ft. as an 8" sewer
to a manhole to be constructed in the intersection of Illinois
and Custer Streets; thence north in Custer Street approximately
385 ft. as an 8" sewer to a flush tank to be constructed in
Custer Street apprxoimately 45 ft. south of the south line of
Crawford Street.
Section 3. LATERAL S ,.NITt:RY SEVVEh DIS'I'hICT N0. 155. That
there be and there is hereby created a Lateral Sanitary Sewer
District in the City of Salina which shall be designated as
Lateral Sanitary Sewer District No. 155, which shall include all
of the following described property in said city, to -wit;
The west 1/2 of Blocks 4 and 7 and all of Blocks 5 and 6
in Southern Heights Addition.
Section 4. That it is necessary and. it is hereby ordered
that a Lateral Sanitary Sewer together with all necessary inlets,
inlet connections, manholes, head walls and other appurtenances,
be constructed and built in Lateral Sanitary Sewer District No.
155 along the following described course within said district as
follows:

Beginning at a manhole on Niain Sewer 'IQ" at the intersection
of Venango and Hancock Streets; thence north in Hancock Street
approximately 460 ft. as an 8" sewer to a manhole to be constructed
in the intersectionof Illinois and Hancock Streets; thence north
in Hancock Street approximately 385 ft. as an 8" sewer to a flush
tank to be constructed in Hancock Street approxirf:ately 45 ft. south
of the south line of Crawford Street.
Section 5. That the City engineer shall on or before the
8th day of October, 1928, prepare and file in the office of the
City Clerk, plans and specifications for the construction of the
lateral sanitary sewers in Lateral Sanitary Sewer District Nos.
152 and 155, provided for in the preceding sections of this ordinance
which shall be of the proper character and along the proper courses
and at the proper grades to serve the property lying within the
districts within which such sewers are to be constructed, and shall
on or before said date prepare and submit to the Board of Commissioners
detailed estimates, under oath, of the cost thereof. That thereafter
the City glerk shall advertise for three consecutive days in the
official city paper for sealed proposals for the building and
construction of such sewers according to such plans and specifi-
cations, which proposals shall be filed with the City Clerk on or
before the tine fixed in such notice, at which time the Hoard of
Coc,missioners may let a contract for the building and construction
of such sewers to the lowest responsible bidder or bidders therefor;
provided that such bids shall not exceed the estimated cost thereof
and provided further that said Board shall reserve the right to
reject any and all such proposals and that if' not responsible bids
shall be received within said estimated cost said Board may proceed
and build such sewers within such estir,.ated cost.
Section 6. That for the cost of building and constructing
such sewers special assessments shall be made for the full cost
thereof, on all lots or pieces of land within the Lateral SaniL:-ry
Sewer Districts within which such sewers shall be built, according
to the appraised value thereof, without regard to t? --e ir.provements
or buildings thereon.
Section 7. after the passage and publication of this
ordinance, the Board of Comriissioners shall appoint three dis-
interested appraisers �rho after having taken an. oati to make a
true and imp.4rtial appraisement of all lots or pieces of land
liable to taxation for the cost of such irc Y-ovements, shall
within five days sifter having been notified of their appointr;,ent
proceed to appraise all of the lots or pieces of land ,ithin such
districts, liable to assessment and taxation as aforesaid, without
regard to the buildings or it„ :roverr,ents thereon, and after making
said appraisements shall return the sarre to the i:�oard of Cor:missioners
of said cite and said Board shall designate a time for holding; a

state the niu-mber of annual installments in which such tax is to be
collected; and thereafter the City Clerk shall annually, at the same
time ether taxes are certified cei•ti.fy to the County Clerk of Salina
County, Kansas, a full list of all property liable for such work and
special meeting of said Board for the purpose of hearing any complaints
that rray be made as to the value of any lot or piece of land appraised
as aforesaid, of which special session due notice shall be given in
the official city paper, and at which special sessior said Board may
later any v-tiluation of any lot or piece of land, if, in their opinion,
the samie has been appraised too hiLh or too low.
Section 8, 'line special assessment herein provided for, may be
paid by the person liable therefor in ten approximately equal arrnAal

AN ORDINANCE creating and defining certain Lateral Sanitary
Sewer Districts in the City of Salina, designated as
Lateral Sanitary Sewer Districts No. 152 and 155 and
providing for the construction of lateral sanitary sewers
in the districts created; providing for the cost thereof

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:

be constructed and built in Lateral Sanitary Sewer District No.
155 along the following described course within said district
as follows:

the lateral sanitary severs in Lateral Sanitary Sewer District
Nos. 152 and 155, provided for in the preceding sections of this
ordinance which shall be of the proper character and along the
proper courses and at the proper grades to serve the property
lying within the districts within which such sewers are to be
constructed, and shall on or before said date prepare and submit
to the Board of Commissioners detailed estimates, under oath,
of the cost thereof. 'shat thereafter the City Clerk shall
advertise for three consecutive days in the official city paper
for sealed proposals for the building and construction of such
sewers according to such plans and specifications, which pro-
posals shall be filed with the City Clerk on or before the time
fixed in such notice, at which time the Board of Commissioners
may let a contract for the building and construction of such
sewers to the lowest responsible bidder or bidders therefor;
provided that such bids shall not exceed the estimated cost
thereof and provided further that said Board shall reserve the
right to reject any and all such proposals and that if not
responsible bids shall be received within said estimated cost
said Board may proceed and build such sewers within such
estimated cost.
Section 6. That for the cost of building and constructing
such sewers special assessments shall be made for the fall cost
thereof, on all lots or pieces of land within the Lateral Sanitary
Sewer Districts within which such sewers shall be built, according
to the appraised value thereof, without regard to the improvements
or buildings thereon.
Section 7. After the passage and publication of this
ordinance, the Board of Commissioners shall appoint three dis-
interested appraisers who after having taken an oath to make a
true and impartial appraisement of all lots or pieces of land
liable to taxation for the cost of such improvements, shall
within five days after having been notified of their appointment
proceed to appraise all of the lots or pieces of land within such
districts, liable to assessment and taxation as aforesaid, without
regard to the buildings or improvements thereon, and after making
said appraisements shall return the same to the Board of Com-
missioners of said city and said Board 4Qi11 designate a time
for holding a special meeting of said Board for the purpose of
hearing any complaints that may be made as to the value of any
lot or piece of land appraised as aforesaid, of which special
session due notice shall be given in the official city paper,
and at which special session said Board may later any valuation
of any lot or.piece of land, if, in their opinion, the same has
been appraised too high or too low.
Section 8. The special assessment herein provided for may
be paid by the person liable therefor in ten approximately equal
annual installments but the owner of any property liable to such
assessment may within thirty days from the date of determining
the amount assessed against his property pay the s ame in full
and his property shall not be liabl8 for any assessment for the
cost of such imA vements, and bonds as hereinafter provided for
shall be issued for the amount of the cost of such improvements
remaining unpaid at the end of thirty days from the time such
assessment is fixed.
Section 9. For the purpose of paying for the work and im-
provements in this ordinance provided for, the Board of Commissioners
are hereby authorized and directed to issue improvement bonds of
the City of Salina in an amount not to exceed the cost of such
improvement and to run for a period of ten years and be payable
in ten approximately equal annual installments, together with
interest not to exceed five percent per annum which bonds shall
be issued and payable according to law; and for the purpose of
paying the principal and interest on said bonds as they severally
become due and payable, the Board of Commissioners shall apportion
and assess against the lots or pieces of land within the taxing
districts of such improvements, special assessments covering the
cost of such improvements and the apportionment therein contained
shall hold good for all of the installments that are to be
collected from the specific property chargeable with said improve-
ments. Such assessment and apportionment ordinance shall. contain
the total amount of tax apportioned to each tract, piece
parcel of land within the taxing district and shall state the
number of annual installments in which such tax is to be collected;
and thereafter the City Clerk shall annually, at the same time
other taxes are certified certify to the County Clerk of Saline
County, Kansas, a full list of all property liable for such work
and improvements, together with the respective amounts due on
each of said tracts, piece or parcels of land, which amounts shall
include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed 5 percent
per annum, on such amounts so certified, which shall be collected
as other taxes are collected.
Section 10. This ordinance shall take effect and be in full
force from and after itspublication in the official city paper.
