3606 Utility ImprovementsORDINANCE NO. 3606 (Published in the Salina Journal 1928) AN ORDI14ANCE providing for the construction of a main sewer in Main Sewer District "Q" as created by Ordinance No. 3567; providing for the cost thereof and for the levy of special assessments against the property in such district and for the payment of such cost, and for the issuing of bond there- for. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. J -hat it is necessary and it hereby ordered that a r,iain Sewer together with all necessary inlets, inlet con- nections, manholes and other appurtenances be constructed and built in Pain Sewer District "Q" as created and described in Section 2 in Ordinance 3567 of the City of Salina, said main sewer to be constructed and built along the following described course within said district as follows: Beginning at an existing manhole in Sherman Street between Fairview Avenue and iTilson Avenue; thence north in Sherman Street as an 8" sewer approxirr:ately 327.5 ft. to a manhole to be con- stracted; thence north approximately 335 ft. in :Sherman Street as an 8" sewer to a manhole to be constructed; thence north in Sherman Street approximately 230 ft. as an 8" sewer to a manhole to be constructed in the intersection of Sherman Street and Venango Street; thence west in Venango Street approximately 325 "t. as an 8" sewer to a manhole to be constructed in the inter- section of Venango and Custer Streets; thence west in Venango Street approximately 325 ft. as an 8" sewer to a manhole to be constructed in the intersection of Venango and Sheridan Street; thence west 325 ft. as an 8" sewer to a manhole to be constructed in the intersection of Venanoo and P�ierril.l Streets; thence west in Venan6o Street approximately 325 ft. as an 8" sewer to a man- hole to be constructed in the intersection of Venango and Hancock Streets, Section 2. That the City Engineer shall on or before the character and alon,; the proper courses and at the proper grades to serve the property lying within the district within which such sewer is to be constructed, .and shall on or before said date prepare and submit to the Board of Commissioners detailed estimates, under oath, of t:•.e cost thereof. T,,lat thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and 8th day of October, 1928, prepare and file in the office of the City Clerk, plans and specifications for the construction of the Main Sewer in Main Sewer District 'IQ" provided for in the preced- ing section of this ordinance which shall be of the proper character and alon,; the proper courses and at the proper grades to serve the property lying within the district within which such sewer is to be constructed, .and shall on or before said date prepare and submit to the Board of Commissioners detailed estimates, under oath, of t:•.e cost thereof. T,,lat thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such a sewer according to such plans and specifications which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such a sewer to the lowest responsible bidder or biaders therefor; provided that such bids shall not exceed the estimated cost thereof and provided further that said Board shall reserve the right to reject any and all such proposals and that if not responsible bids shall be received within said estimated cost said hoard may proceed and build such sewer within such estimated cost. Section 3. That for the cost of building and constructing such a sewer, special assessments shall be made for the full cost thereof, on all lots or pieces of land within the slain Sewer District within which such main sewer shall be built, according to the appraised value thereof, without regard to the irpr,ovements or buildings thereon. Section 4. After the passage and publication of this ordinance the Board of Commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraise - merit of all lots or pieces of land liable to taxation for the cost of such ircprovements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or tDieces of land within such district, liable to assessment and taxation as afore- said, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the board of Commissioner:of said City and said Board shall designate a time for holding a special meeting of said Board for the purpose of hear- ing any complaints that may be Trade as to the value of any lot or piece of land appraised as aforesaid., of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same had been appraised too high or too low. Section 5. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determine the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improvements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. I Section 6, For the purpose of paying for the work and improve- ments in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improve- ment and to run for a period of ten years and be payable in ten approximately equal annual installments, together with interest not to exceed five percent per annum which bonds shall be issued and pa;7able according to law; and for the purpose of paying; the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall appprtion and assess against the lots or pieces of land within the taxing districts of such improve- ments, special assessments covering the cost of such improvements and the apportionment therein contained shall hold `,00d for all of the installments that are tote collected from the specific property chargeable with said ir::proveraent . Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, piece or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5 percent per annum, on such amounts so certified, which shall be collected as other taxes are collected. That for the cost of building and constructing such a.sewer, special assessments shall be made for the full cost thereof, on all lots or pieces of land within the MAin Sewer District within which such main sewer shall be built, according to the appraised value thereof, without regard.to the improvements or buildings thereon. Section 4. After the passage and publication of this ordinance the Board of Commissioners shall appoint three dis- interested appraisers who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appoint- ment proceed to appraise all of the lots or pieces of land within such district, liable to assessment and taxation as afore- said, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same had been appraised too high or too low. Section 5. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equgl annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improvements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 6. For the purpose of paying for the work and improve- ments in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvement and to run for a period of ten years and be payable in ten approximately equal annual installments, together with interest not to exceed five percent per annum which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Boardoof Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified certify to the County Clerk of Saline County, Kansas, a full list of,all property liable for such work and improvements, together with the respective amounts due on each of said tracts, piece or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5 percent per annum, on such amounts so certified, which shall be collected as other taxes are collected.
