3601 Issue Improvement BondsORDINANCE NO. 3601 blished in the Salina JournalY1 J- 1928 AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, Kansas in the sum of $71,804:.82, to pay the cost of improving certain streets and alleys, and con- structing certain main and lateral sanitary sewers and construct- ing certain storm sewers in said city. "JHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in said city, to -wit: Excavating, grading and paving of the alley running north and south between, and parallel with, Seventh Street and Eighth Street., from the north line of Ash Street to the south line of Elm Street; Excavating, grading and paving Cedar Street from the west; line of Phillips Street to the east line of Coilege Avenue; Curbing and guttering Center Street from the east line of Fifth Street, east to the entrance to enwoo ark; Curbing and guttering north side of Euclid Avenue from the west line of Fifth Street to the east line of Ninth S ree ; Curbing and guttering, excavating, grading and paving Lincoln Avenue from the west line of Santa Fe Avenue to the east line oath street; Curbing, guttering, excavating, grading and paving Minneapolis Avenue from. the west line of Highland Avenue to the east line ]7' i—n Street; Excavating, grading and paving of the unpaved portion of Ninth Street lying in the center of the street, from North Street to J.1—n=on Avenue; Curbing and guttering, excavating, grading and paving North Street from the west line of Ninth Street to the east line of Twe fth Street; Curbing and guttering, excavating, grading, and paving Oakdale Avenue from the south line of Iron Avenue to the north line of Gypsu, xve ue; and WHEREAS, the total cost of said improvements has been ascertained, and the total portion thereof to be paid by a general tax to be levied upon all the taxable property within said citIT for the improvement of squares and areas formed by the crossing of streets and alleys, and for the improvement of any of said. streets where the same is through or ad- jacent to property of the city for which the city is liable, and for which bonds will be issued as hereinafter provided, has been ascertained and is hereby determined and found to be the sung of x,12,748.30; and WHEREAS, the portion of said street improvements to be paid by special. assessment levied upon the lots and pieces of ground liable for the payment of said street improvements has been ascertained and is here- by found and determined to be the sum of439,596.88, which said last amount has been heretofore duly assessed and apportioned to the several. lots and pieces of ground on such streets liable therefor, payable in ten equal installments, according to law, and as provided in the ordinances of the City of Salina relating thereto duly passed and approved, of which amount the sum of F15,037.12 has been paid by the property owners liable therefore leaving a balance for which bonds are to be issued in the sum of X24,559.76. WHEREAS, pursuant to proceedings duly had according to law relat- ing to the construction of certain improvements on a certain street in the City of Salina.. Kansas, which connects an existing pavement in said city with a certain county road in Saline County, Kansas, a contract has been let and performed f& the construction of the following improvement, to -wit: Excavating, grading and paving North Street from the east; line of Twelfth Street to the City limits at the west line of 4hittredge Street, being at the intersection of Forth Street with the right-of-way of the Union Pacific Railroad; and WHEREAS, the total cost of said improvements have been as- certained and the portion thereof to be paid by the City at large by general tax upon all taxable property within the city being 30 percent of the total cost of said work, for which bonds are to be issued, has been ascertained and is hereby determined and found to be the sum of $4,147.53; and WHEREAS, 40 percent of the cost of such improvement, being the portion of the cost of said improvement to be paid by special assessments against the private property within the benefit district liable for such cost, within the City of Salina, has.been ascertained and is hereby found and determined to be the sum of $5,529.93, which said. la: t amount has been duly assessed and apportioned -to the several lots and pieces of ground in the benefit district liable therefor, payable in ten equal annual installments, according to law and as provided in the ordinance of the City of Salina relating thereto, duly passed and approved, of which. amount $1,867.86 has been paid in cash by the property owners liable therefor, and leaving unpaid a balance of said amount in the sum of P,3,662.07 for which bonds are to be issued as hereinafter provided for; and WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the following work; The construction of lateral sanitary sewers in Lateral Sewer Districts No. 141 and 142; The construction of certain storm sewers designated as Storm Sewers No. 7-A, 8-A and. No. 8; and WHEREAS, the cost of lateral sanitary sewers constructed in Lateral Sewer Districts 141. and 142, to be paid by special assessments levied upon all the lots and pieces of ,;round liable for the payment of said lateral sanitary sewers in said lateral sewer districts last mentioned, respectively, has been ascertained and is hereby found and determined to t,e the sum of yp1,928.23.. which amount has been heretofore duly assessed and apportioned to the several lots and pieces of E round liable therefor payable in ten equal installments according to law, and as provided in ordinance of the City of Salina relating thereto duly passed and approved, of which amount the sum of $746.87 has been paid by the property owners liable therefor, leaving a balance for which bonds will be issued in the sum of $1,181.36; and WHEREAS, the amount to be paid by general taxation to be levied upon all the taxable property within said city for the construction of said storm sewers No. 7-A, 8-A and 8, for which bonds will be issued as hereinafter provided has been ascertained and is hereby found and determined to be the sum of $25,505.80; and WHEREAS, the total amount of said special assessments for which bonds will be issued as herein provided, in anticipation of said specii assessments which remain unpaid, has been ascertained and is hereby found and determined to be the sum of x$29,403.19, the difference be- tween the last named amount and the total amounts assessed against private property for the improvements hereinabove mentioned having been paid by the property owners liable for such improvements, whose property has been thereby discharged from any further assessment for the cost of said. improvements in the amount so paid; and the total amount for which bonds will be issued to be paid by general taxation upon all the taxable property in the City of Salina has been determined and found to be the sure of X42,401.63, making a total amount for which bonds are to be issued in the sum of $71,804.82; NOW WHEREFORE BE IT ORDAINED by the Board of Coranissioners of the City of Salina, Kansas: Section 1. That for the purpose of providing funds to pay the cost of the improvements hereinbefore described, there shall be issued and hereby are issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $71,804.82, said shall Issue/consist of 80 bonds, nurnbered from 1 to 80 inclusive, all dated May 1st, 1928, and shall become sue serially in denominations as follow No. l for $4,82 and No. 2 to 8 incl. 41000 each due May 1st, 1929, No. 9 for $200 and No. 10 to 16 incl. jp1000 each due May 1st, 1930, No. 17 for �200 and No. 18 to 24 incl. X1000 each due May 1st, 1931, No. 25 for 4p200 and No. 26 to 32 incl. 01000 each due May lst, 19322 No. 33 for 4200 and No. 34 to 40 incl. 'p1000 each due May 1st, 1933, No. 41 for X200 and No. 42 to 48 incl. X1000 each due May 1st, 1934, No. 49 for X200 and No. 50 to 56 incl. g$1000 each due May 1st, 1935, No. 57 for $200 and No. 58 to 64 incl. All of said bonds shall bear interest at the rate of 44% per annum, payable semi-annually on May lst and November 1st in each year, except that the first interest on all of said bonds shall become due and pay- able on May 1st, 1929. Section 2. Said bonds shall be executed by the M ayorand shallbe attested by the City* Clerk, and the corporate seal of the City shall be affixed thereto. Said bonds shall have attached thereto interest coupons representing the interest thereon and said interest coupons shall bear the fac-simile signatures of the Mayor and City Clerk of said city. Section 3. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irre- vocably pledged for the payment of said. principal and interest at maturity, This bond is one of a series of 80 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $71,804.82, issued by the City of Salina, Kansas. for the purpose of paying the cost of improving certain streets in said city, including public highways, connecting existing pavements in said city with certain county roads at the corporate limits of said city, and to pay the cost of constructing certain sanitary sewers and storm sewers in said city, by the authority of and in full compliance with the provisions, restrictions and limitations of the Constitution and laws of the State of Kansas, including Sections 10-101 to 10-1151 12-681 to 12-610, 12-617 to 12-675 and 13-1032 to 13-1035 of the Revised Statutes of Kansas, 1923, and all amendments thereof, and all other provisions of the laws of said State applicable thereto, and this bond and all of the other bonds of this series, and all interest thereon are to be paid by said City of Salina, Kansas. Ant it; is hereby declared and certified that all acts, con- ditions and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and per- formed and do exist in due and regular form and manner as required by the Constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation.
