AN ORDINANCE ratifying and confirming a contract for the building
and construction of a certain main sanitary sewer in Main
Sewer District "P" and a sewage pumping station, and for
the construction of certain lateral sanitary sewers in
lateral Sanitary Sewer Districts No. 143, 146, 14:8 and 150
and provide for the issuance of temporary notes to pay the
cost thereof pending issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kan sas:
Section 1. That the acceptance by the City of Salina of the
-proposal of H. J. Taylor Construetim Company, hereinafter referred
to as the "Contractor" as submitted to the Board of Commissioners on
August 20th2 1928, which is hereby found and determined to be the
lowest and best bid for such work, and the contract awarded by the
Board of Commiss' oners of said city to said contractor and signed
on behalf of the city by the Mayor on August 20th, 1928, for the
building and construction of a certain main sanitary sewer in h1ain
Sewer District "P" as provided for in Ordinance loo. 3567 and for
the construction of a sewage pumping station as provided for in
Ordinance No. 3568, and for the construction of certain lateral
sanitary sewers in Lateral Sanitary Sewer Districts No. 143, 1469
148 and 150 as provided for In Ordinances No. 3571 and 3580 at and
for the unit prices contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance,
be and the same is hereby ratified and confirmed, said proposal
being within the estimated cost of said improvements as shown by
the sworn estimate of the City Engineer filed in the office of the
City Clerk, which estimates are hereby referred to and made a part
of this ordinance.
Section 2. That said main sanitary sewer and said pumping
station and said lateral sanitary sewers shall be built and con -
strutted in accordance with the plans and specifications therefore
prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and
under the terms of said contract entered into between the city and
said contractor on August 20th, 1928, which said plans, specificiations,
proposal and contract are hereby referred to and made parts of this
ordinance, said work to be done and the material, equipment, appliances
and appurtenances, necebsarg: and. -required in connection therewith to
be performed and furnished in accordance with said plans and speci-
fications, conditioned however upon the furnishing by the contractor
of the contract, maintenance and statutory bonds wit hin the time re-
quired of said contract.
Section 3. That temporary notes signed by the Mayor and attested
by the City Clerk be issued from time to t ime as the work progresses
in the manner and form as required by law, the total amount thereof
not to exceed the contract price for such work, such notes to bear
interest not to exceed 4-1/4% per annum and to mature not later than
March 1st, 1929, and to be issued in such amounts and at such time
as money for the payment of the cost of such work may be required, such
notes to be issued to said contractor and to be redeemed and cancelled
at the time that permanent bonds are issued in lieu thereof.
Section 4. }his ordinance shall take effect and be in force
from and after its publication in the official city paper.
