AN ORDINANCE providing for and authorizing the rebuilding and reoon-
struetion of certain parts of certain sewers of the City of
Salina, and providing for the issuing of bonds to pay the cost
thereof.
WHEREAS, certain portions of the main sewer in Ash Street in the City
of Salina, between and point where said main sewer crosses the Smoky
Hill River near Front Street, and the terminus of said sewer at the
Smoky Hill River at the east end of Ash Street and at the Sewage Pumping
Station at said place, and the sewage force main running along the westerly
bank of the Smoky Hill River between Ash Street and Ohio Street, are, by
reason of damgge to said sewers and sewer lines by flood waters inadequate,
defective and worn out;
WHEREAS, in the judgment of the governing body of the City of Salina such
portions of said sewers and sewer lines should be rebuilt and reconstructed
in the manner provided by law; and
WHEREAS, said main sewer and sewer line within the limits above mentioned
are so located that they receive the sewage or drainage from all of the
sewer districts within the City of Salina, and in the judgment of the
governing body the cost of rebuilding and reconstructing the same should
be born by the City at large and paid for out of the general funds of said
city; NOW THEREFORE'#
BE IT ORDAINED by the Board of Corar.issioners of the City of Salina, Kansas.
Section 1. That the main sewer in Ash Street in the City of
Salina from the point where such sewer crosses the Smoky Hill river at
Front Street, to the terminus of such sewer at the Smoky Hill River at
the east end of Ash Street andat the sewage pumping station located at
such place, and the sewage force main running from said pumping station
along the westerly bank of the Smoky Hill River between Ash Street and
Ohio Street, which main sewer and sewer line have been damaged and in-
jured by flood waters and which are by reason thereof inadequate, de-
fective or worn out, be rebuilt and reconstructed wherever the same may
be necessary within the limits above mentioned.
Section 2. That on or before the 4th day of September 1928 the
City Engineer shall prepare and file with the City 81erk plans and
specifications for the rebuilding and reconstruction of such portions
of such sewers and sewer line as may be necessary, together with a
detailed estimate of the cost thereof, under oath, and thereafter the
City Clerk shall advertise in the official city paper for three con-
secutive days for sealed proposals for the rebuilding and reconstruction
of said sewer and sewer line. Upon receipt of such proposals the govern-
ing body shall let the work by contract to the lowest responsible bidder
therefor, if there be any whose bid does not exceed the estimate of the
City Engineer, but the city shall reserve the right to reject any and all
bids, and if no responsible bid shall be received within the estimate,
the governing body shall have power to make such improvements within the
estimated cost thereof as provided by law.

Section 3. That for the purpose of paying the cost of said
improvements, general improvement bonds, not to exceed the con-
tract price for such work, or the cost thereof if done by the city,
shall be issued and sold in the manner provided by law. Said bonds
shall bear interest at not to exceed 44 per cent per annum and shall
be issued to mature in installments of approximately equal amounts
each year for ten years and when issued such bonds shall be sold in
the manner provided by law or delivered to the contractor or con-
tractors constructing such improvements. For the purpose of pay-
ing such bonds and interest as the same become due and payable
the Board of Commissioners shall levy a general tax upon all tax-
able property in the City of Salina in the time and manner provided
by law.
Section 4. This m dinance shall take effect and be in force
from and after its publication in the official city paper.
