AN ORII NANCE granting Union Pacific Railroad Company, its successors,
and assigns, the right to construct, maintain and operate
standard gauge railroad tracks over and across North Street
between Ninth and Eleventh Streets and across the east and
west alley and along the North and South alley in Block 5,
depot Addition to the City of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Union Pacific Railroad Company is hereby granted
the right to construct, and it and its successors and assigns the
right to maintain and operate four standard gauge railraod tracks
over and across North Street, as established by Ordinance No. 3499,
dated January 28, 1928, between Ninth Street and Eleventh Street,
and one standard guage railroad track over and across the alley
extending in and easterly and westerly direction through Block 5
in Depot Addition and upon and along the alley extending in a
northerly and southerly direction through said Block 5, the center
lines of such track being along courses described as follows, to -wit:
Track No. 1
Commencing at a point on the south line of North Street
approximately 144 feet westerly from the west line of Ninth
Street, when measured along said south line of North Street;
thence in a northerly direction, curving to the left to a
point on the north line of said North Street approximately
122 feet west of said west line of Ninth Street, when measured
along said north line of North Street.
Also, commencing on the north line of Lot No. 17, in
Block 5 of Depot Addition and running thence north on a straight
line parallel with and approximately 118.5 feet west, at right
angles, from the east line of said "lock 5 over and across the
alley extending in an easterly and westerly direction through
said Block 5, and upon and along the alley extending in a northerly
and southerly direction through said block 5 to a point in the
north line, extended, of said Block 5.
Track No. 2
Commencing at a point on the south line of North Street
approximately 166 feet westerly from the west line of Ninth
Street v.hen measured along said south line of N rth Street,
thence in a northerly direction, curving to the °left, to a
point on the north line of said N rth Street approximately 137
feet westerly from said west line °of Ninth Street, when measured
along said North line of North Street.
Track No. 3
Commencing at a point on the south line of North Street
approximately 497 feet westerly from the west line of Ninth Street,
when measured along said south line of North Street; thence in a
northerly direction, curving to the left, to a point on the north
line of said North Street arlproximately 472 feet westerly from
said west line of Ninth Street, when measured along said north
line of North Street.
Track No. 4
Commencing at a point on the south line of North Street
approximately 517 feet westerly from the west line of Ninth Street,
when measured along said south line of North Street, thence in a
northerly direction, curving to the left, to a point on the north
line of said North Street approximately 488 feet westerly from
said wF:st line of Ninth Street, when measured along said north
line of North Street.
Section 2. Said railroad tracks shall be constructed, maintained
and operated in accordance with the laws of the State of Kansas and
the ordinances of the City of Salina now in force or hereafter enacted,
and all paving, sidewalks, crossings and drainage, crossed or affected
by such track, or which, as now existing or hereafter provided for,
cross or affect such track, shall be constructed, reconstructed and
maintained by said grantee, its successors and assigns, in such
manner as may be required by the governing body of said city. Upon
failure to comply with any such requirements, the city may at the
expense of the grantee, its successors and assigns, proceed to do
any such work as may have been required hereunder.
Section 3. The exercise of any of the privileg6s herein
granted, shall constitute an acceptance by the grantee, its successors
and assigns of all of the conditions of this ordinance.
Section 4. This ordinance shall take effect and be in force
from and after its passage and publication once in the official city
paper.
