3580 Utility Improvements4 11 ORDINANCE NO. 3580 1 AN ORDINANCE creating and defining certain Lateral Sanitary Sewer Districts in the City of Salina, designated as Lateral Sanitary Sewer Districts No. 148 and 150 and providing for the construction of lateral sanitary sewers in the districts created; providing for the cost thereof and for the levy of special assessments to pay such cost. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. LATERAL SANITARY SEWER DISTRICT N0. 148. That there be and there'is hereby created a Lateral Sanitary Sewer District in the City of Salina which will be designated as Lateral Sanitary Sewer District No. 148, which shall include all of the following described property in said city, to -wit: All of Lots 6 to 29 inclusive, in Block 2, and all of Block 6, Highland Court Addition. Section 2. That it is necessary and it is hereby ordered that a Lateral Sanitary Sewer together with all necessary inlets, inlet connections, manholes, head walls and other appurtenances, be constructed and built in Lateral Sanitary Sewer District No. 148 along the following described course within said district, as follows: Beginning at a flush tank to be constructed on the south line of Lot 29, Block 2, Highland Court Addition and 5 feet east of the southwest corner thereof; thence west as an 8" sewer along the center line of Block 3 ar�proximately 333 feet to a manhole to be constructed; thence west as an 8" sewer approximately 253 feet to a manhole to be constructed in Highland Circle between Sunset Drive and Ellsworth Street; thence west as an 8" sewer approximately 360 feet to a manhole on Main Sewer "P" located in Pershing Street between Sunset Drive and Ellsworth Street. Section 3. LATERAL SANITARY SENDER DISTRICT NO. 150. That there be and there is hereby created a Lateral Sanitary Sewer District in the City of Salina which shall be designated as Lateral Sanitary Sewer District No. 150, which shall include all of the following described property in said city, to -wit; Lots 6 to 29 inclusive, Block 4 and all of Block B. Highland Court Addition to the City of Salina. Section 4. That it is necessary and it is hereby ordered that a Lateral Sanitary Sewer together with all necessary inlets, inlet connections, man:_oles, head walls and other appurtenances, be constructed and built in Lateral Sanitary Sewer District No. 150 along the following described course within said district as follows: Beginning at a flush tank to be constructed on the south line of Lot 29, Block 40 Highland Court Addition to the City of Salina and 5 feet east of the southwest corner thereof and thence west along the center line of said Block 4 as an 811 sewer approximately 333 feet to a manhole to be constructed; thence west as an 8" sewer approximately 253 feet to a manhole to be constructed in Highland Circle between Ellsworth Street and Jewell Street; thence west as an 8" sewer approxi- mately 360 feet to a manhole on Main Sewer "P" located in Pershing Street between Ellsworth Street and Jewell Street. Section 5. That the City Engineer shall on or before the 30th day of July, 1928, prepare and file in the office of the City Clerk plans and specifications for the construction of the lateral sanitary sewers in Lateral Sanitary Sewer District Nos. 148 & 150, provided for in the preceding sections of this sections of this ordinance which shall be of the proper character and along the proper courses and at the proper grades to serve the property lying within the dis- tricts within which such sewers are to be constructed, and shall on or before said date prepare and submit to the Board of Commissioners detailed estimates, under oath, of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and con- struction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest responsible bidder or bidders therefor; provided that such bids shall not exceed the esti:ated cost thereof and provided further that said Board shall reserve the right to reject any and all such proposals and that if not responsible bids shall be re- ceived within said estimated cost said Board may proceed and build such sewers within such estimated cost. Section 6. That for the cost of building and constructing such sewers special assessments shall be made for the full cost thereof, on all lots or pieces of land within the Lateral Sanitary Sewer Districts within which such sewers shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 7. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers who after having taken an oath to make a true and impartial appraise- ment of all lots or pieces of land liable to taxation for the cost of such improvements, shall Atithin five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such districts, liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of lans appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section S. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual installments bu t the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such improvements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 9. For the purpose of paying for the work and im- provements m- provements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvement and to run for a period of ten years and be payable in ten approximately equal installments, together with interest not to exceed five percent per annum which ponds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering the cost of such improvements and the apportionment therein contained N sa- M shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, piece or parcels of land, which amounts shall include the annual installments and in- terest on all unpaid balances for oneyear at the rate of not to exceed 5 per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected.
