3576 B Residence DistrictORDINANCE NO. 3576 v AN ORDINANCE amending Ordinance No. 3188 adopted November 23rd, 1925, being an ordinance dividing the City of Salina into zones or districts and regulating and restricting the location of trades and industries, etc., and the uses of land within each of such districts or zones, etc. WHEREAS, the City Planning Commission has recommended to the Board of Commissioners of the City of Salina certain changes in and amendments to Ordinance No. 3188, as hereinafter set forth, and pur- suant to such recommendation Public Notice has been given for thirty days in the Salina Journal of such proposed changed, and that a pub- lic hearing thereon would be held by the Board of Commissioners of said city at 5:00 P.M. on July 2nd, 1928, and at said meeting so held pursuant to such notice, no objections to such proposed change were offered for consideration; NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the following described land in the City of Salina, now situated within the "B" Residence District as defined by Section 4 of Ordinance No. 3188, and said ordinance as amended, shall be and the same is hereby in cluded, added to and made a part of the "C" Commercial District as defined in Section 5 of said 4, dinance No. 3188, and that such territory may be used for the purposes designated in Section 10 of said Ordinance No. 3188, to -wit: All of Blocks 2 and 3 in Episcopal Military Institute Addition; The South 60 feet of Lots 16, 18, 20 and 22 on Elm Street, and the North 60 feet of Lots 11, 122 13 and 14 on Park Street, in Weaver's Addition, and Lot 1 on Walnut Street in University Addition and Lot 2 and the east 50 feet of Lots 1 and 3 in Block 4, Leavenworth Addition. Section 2. That the following described land in the City of Salina, now situated in the "At' Residence District as defined by Section 3 of Ordinance No. 3188, be included within, and added to and made a part of the "C" Commercial District as defined in Section 5 of said Ordinance No. 3188, subject to the conditions and provisions hereinafter set forthy to wit: The south 48 feet of Lot 3 and all of Lots 4, 51 6 and 8 in Block 1 in Pleasant View Addition; Lots 1 and 2 in Block 1 in Evergreen Park Addition; and Lot 68, 70, 72 74 and 76 on Ninth Street in the Grounds of the Kansas Weselyan University; pro- vided however, that any commercial building constructed in the territory last described shall be of a residential type with the same set back, as required of residentail buildings in the residence district adjoining such Commercial District as hereby created, and that the use of any commercial buildings to be constructed within such district, and all architectural and landscape plans for any such commercial building and any advertising signs to be used in connection therewith shall be sub- mitted to and approved by the City Planning Commission and by the Board of Commissioners of the City of Salina before any building permit for any building to be erected therein shall be issued by the Building Inspector of the City of Salina; and provided further that if any part of this section of this ordinance shall be held invalid, that the whole sec- tion shall be deemed invalid and of no effect it being the intention of the Board of Commissioners to adopt the same only with the conditions and restrictions herein contained. Section 3. That the following described land now situated in "A" Residence District as defined in Section 3 of Ordinance No. 3188 be and the same is hereby included in, made a part hereof, and included in "B" Residence, District as defined in Section 4 of said Ordinance No. 3188 and that the same may be used for the purposes designated in Section 9 of said Ordinance No. 3188, to -wit; Lots 28 and 30 in Block 6 in Riverside Park Addition; Lots 10 20 3 and 4 on University Place, and Lot 2 on Walnut Street in University Addition. Section 4. That no advertising sign, billboavd, or any name plate, exceeding one square foot in area, except signs not exceeding 8 square feet in area which appertain to the lease, hire or sale of a building or premises upon which such sign is situated; and except signs now in use upon business or commercial buildings in the "A" or "B" Residence Districts which were in existence at the time of the adoption of Ordinance No. 3188 shall be permitted in any part of the "A" or "B" Residence District as defined in said Ordinance No. 3188, or in said ordinance as now or hereafter amended and any person who shall erect or maintain or permit the erection or maintenance of any such sign, billboard or any name plate, contrary to the provisions of this ordinance shall be deemed guilty of a misdemeanor shall be subject to the same penalty as provided in Section 27 of said Ordinance No. 3188, Section 5.
