AN ORDINANCE relating to and apportioning and levying special
assessments on certain lots and pieces of ground in the
City=of Salina, Kansas, to pay the cost of grading and
paving North Street from the east line of Twelfth Street
to the west ne oT Whittredge Street in the City of Salina,
Kansas, and relating to and providing for the collection
and payment of such assessments.
WHEREAS, pursuant to Resolution Number 442 duly adopted by the
Board of Commissioners of the City of Salina on April 23rd, 1928
and which resolution was duly adopted and ratified by the Board
of County Commissioners of Saline County, Kansas as required by
law and in accordance with Ordinance Number 3531 of said city
duly passed on May 7th, 1928 and Ordinance Number 3557 of said
city, duly passed on June 18th, 1928s a contract has been let
for the grading and paving of North Street in said city, which
said improvement is to be paid in accordance with provisions
of Section 13-1032 to 13-1035, inclusive, of the Revis6d Statutes
of Kansas 1923 as follows: 30 per cent by the City of Salina,
Kansas; 30 percent by Saline County, Kansas; and 40 percent by
the property liable to special assessment as Fr ovided by law;
and
WHEREAS, the cost of said improvement as determined by the final
estimate of the City Engineer of the City of Salina, filed in the
office of the City Clerk as provided by law on the 9th day of
July, 1928 has been determwned and found to be the sum of $13,825.11
which amount 30 per cent thereof or $4147.53 is to be paid by the
City of Salina, and 30 per cent thereof or $4147.53 is to be paid
by Saline County, Kansas, and the remaining 40 per cent thereof
or $5530.05 is to be paid by the property liable to special assess-
ment therefor as provided by law; NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of paying for that part of
the cost of grading and paving North Street from the east line of
Twelfth Street to the west line of Whittredge Street in the City
of Salina, Kansas, which is to be paid by the property owners with-
in the benefit district provided by law, there are hereby levied
and assessed on the property liable therefor, being all the lots
and pieces of ground lying on either side of said street above
mentioned for the distance improved, as aforesaid, to the center
of the block according to the appraised value of such lots and
pieces of ground without regard to the buildings or improvements
thereon, special assessments covering that portion of the cost of
such work and improvements assessable against such property, said
special assessments being based on the special valuation and appraise-
ment of said lots and pieces of ground heretofore made by three
disinterested appraisers, appointed by the Board of Commissioners
of he City of Salina, Kansas and duly approved by the Board of
County Commissioners of Saline County, Kansas, which said appraise-
ment is hereby referred to and made a part of this ordinance, and
the several amounts levied, apportioned and assessed against such
lots and pieces of ground for the purpose aforesaid are hereby found
and determined to be as follows:

Section 2. Said amounts, levied, apportioned and assessed as
aforesaid, shall be due and collectible in ten equal installments,
the first becoming due with the taxes levied for the year 1928 and
one of said installments falling due each and every year thereafter
until all are paid, and all to be collected with interest as in this
ordinance provided; PROVIDED, that the owner of any piece of property
liable for any such assessment may redeem his property from such
liability by paying into the City Treasury the entire amount charge-
abie against the same, as in this ordinance designated, at any time
within thirty days after the publication of this ordinance and before
the issuance of the bonds of said city in payment of the balance of
said improvements, and his property so paid on shall not thereafter
be liable for any further assessments for the cost of said improvements,
nor for any part of said bonds.
Section 3. There is hereby further levied and assessed against
each lot and piece of ground described in this ordinance 4 1/4,% in-
terest per annum on all of said installments therein mentioned from
the date of the bonds, which may be issued at the end of thirty days,
as specified in the preceding section hereof, as by law provided to
the time of collection of the last installment, as provided by law,
which said interest shall be collected annually at the same time and
in the same manner as said installments are collected; and after the
taking effect of this ordinance it shall be the duty of the City Jerk
of said city to annually at the same time other taxes are certified
and until all of said assessments so apportioned and levied herein
have been certified, to certify to the County Clerk of Saline County,
Kansas, a full list of all property liable to assessment and taxation
for such work and improvement except such property on which the special
assessment aforesaid have been paid in full as hereinbefore provided,
together with the respective amounts due on each of such lots and
pieces of ground, which amounts shall include the annual installments
of such special assessments together with the interest for one year
at the rate of 4-1/4% per annum, on all unpaid balances of such
assessments at the beginning of each such year as aforesaid, and
such amounts so certified as herein provided shall be placed upon
the tax roll by the County Clerk of Saline County, Kansas, and
collected as all other taxes are collected.
Section 4. This ordinance shall take effect and be in full
force from and after its publication once in the official city
paper.

Section 2. Said amounts, levied, apportioned and assessed
as aforesaid, shall be due and collectible in ten equal in
•,stallme,nts`;;the first becoming due with the .£axes levied! for the
year 1928 and one of sa id installments falling due'each and
every year thereafter until all are paid, and'all to,be col-.
lected with interest as in this ordinance provided; PROVIDED,'
that the owner of any piece of property liable for any such
assessment may redeem his property from such liability'by,
paying .into the City Treasury the entire amount chargeable
against the same, as it tiffs ordinance designated, `atany time,
viithin thirty days aftei the publication'of.this. ordinance and.
before the issuane'e of the bonds of said'City in.payment of
the balance of said improvements, and�his.property s'o paid on
shall not thereafter be liable for any further"assessments for
the cost of said improvements, nor for any part.of,said bonds.
