AN 01 DINANCE creating and defining certain k,'lain Sewer Districts
in the City of Salina, designated as Main Sewer Districts
"P" and "Q" and providing for the construction of a Main
Sewer in Main Sewer District "P" so created; providing for
the cost thereof and for the levy of special assessments against
the property in such district for the payment of such cosi,
and for the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1, MAIN SEWER DISTRICT "P". That there be and there
is hereby created a Main Sewer District in the City of Salina which
shall be designated as Main Sewer District "P", which shall include
all of the following described property in said city, to -wit:
Lots 12, 132 14 and 15 Block 3, Lots 1, 21 3, 14., 15, 16, 172
18, 19, 20, 21, 22 and the west 21.67 feet of Lot 4 and the west
50 ft. of Lot 23, Block 4, all in Fairview Addition to the City
of Salina according to the recorded plat thereof. Also Lots 10,
11, 12, on Sherman Street in Dimick's Addition and Lots 1 to 12
inclusive in Block 20 in Southern Heights Addition, Lots 6 to 29
inclusive, Block 1, Lots 6 to 29 inclusive, Block 2, Lots 6 to 29
inclusive, Block 3, Lots 6 to 29 Block 4, and all of blocks 5, 61
7, 8, 9, 10, 11, 12, 13, 14, 15 and 16 in Highland Court Addition.
Se ion 2. MAIN SZi,1ER DIS'TRICT "Q" . That there be and there
is hereby c ated a lvlain :Sewer District in the City of Salina 'which
shall be desig ted as Main Sewer District "Q", which shall include
all of the follow\described property in said city, to -wit:
Lots 50 62 10, Crawford Addition, Lots 5, 6, 7, 8,
Block 1 and Lots , 11, 12, 13, 14 and 15 Block 2s Brown's
Addition, Lots 8 to 26 incisive and the west 30 ft. of Lots 4,
51 6, 70 Block 1, and Lots 8 N 15 inclusive, Block 2 and Lots 8
to 11 inclusive, Block 3, all i
9 inclusive on Sherman Street and
irview Addition, also Lots 1 to
s 16 to 36 inclusive; on Custer
Street in Dimicks Addition, also Bloc* 1 to 19 inclusive and Blocks
22, 23, 24 and the ~vest one-half block 21,&uthern Heights Addition
to the City of Salina.
Section 3. 'That it is necessary and it is hereby ordered
that a Main Sewer together with all necessary inlets, inlet
connections, manholes head walls and other appurtenances, be
constructed and built in Main sewer District "P", along the following
described course within said district, as follows:
Beginning at a manhole to be constructed in the intersection
of Jewell and Pershing Streets thence north as an 8" sewer approxi-
mately 164 ft. to a manhole to be constructed in Pershing Street
between Jewell and Ellsworth Streets, thence north as an 8" sewer
approximately 319 ft.. to a manhole to be c, -n structed in Pershing
Street b(:tween Ellsworth Street and Sunset Drive; thence north. as
an 8" sewer approximately 329 ft. to a manhole to be constructed
in Pershing Street between Sunset Drive and Beloit Street; thence
north as an 8" sewer approximately 319 ft. to a manhole to be con-
structed in Pershing Str_�et between Beloit and Republic Streets;
thence north as an 8" sewer approximately 300 ft. to a manhole to
be constructed in Sherman Street approximately 100 ft. north of
Republic Street; thence north as an 8" sewer approximately 350 ft,
to a manhole to be constructed in Sherman Street approximately 150
ft. south of the south line of '','Jilson Street; thence north as an
8" sewer approximately 345 ft. to a manhole to be constructed in
Sherman Street between v+ilson and Fairview Streets.
Section 4. That the City Engineer shall on or before the 16th
day of July, 1928s prepare and file in the office of the City Clerk,
plans and specifications for the construction of the Main Sewer in
Main Sewer District "P" provided for in the preceding section of this
ordinance which shall be of the proper character and along the proper
courses and at the proper grades to serve the property lying within
the district within which such sewer is to be constructed, and shall
on or before said date prepare and submit to the Board of Commissioners
detailed estimates, under oath, of the cost thereof. That thereafter
the City Clerk shall advertise for three consecutive days in the
official city paper for sealed proposals for the building and con-
struction of such a sewer according to such plans and specifications,
which proposals shall be filed with the City Clerk on or before the time
fixed in such notice, at which time the Board of Commissioners may let
a contract for the bu_lding and construction of such a sewer to the
lowest responsible bidder or bidders therefor; provided that such bids
shall not exceed the estimated cost thereof and provided further that
said Board shall reserve the right to reject any and all such proposals
and that if not responsible bias shall be received within said estimated
cost said Board may proceed and build such sewer within such estimated
cost.
Section 5. That for the cost of building and constructing such
a sewer, special assessments shall be made for the full cost thereof,
on all lots or pieces of land within the Main Sewer District within
which such main sewer shall be built, according to the appraised value
thereof, without regard to the improvements or buildings thereon.
Section 6. After the passage and publication of this ordinance
the Board of Commissioners shall appoint three disinterested appraisers
who after having taken an oath to make a true and impartial
appraisement of all lots or pieces of land liable to taxation
for the cost of such improvements, shall within five days after
having been notified of their appointment proceed to appraise all
of the lots or pieces of land within such district, liable to
assessment and taxation as aforesaid, without regard to the build-
ings or improvements thereon, and after making said appraisements
shall return the same to the Board of Commissioners of said city
and said Board shall designate a time for holding a special meet-
ing of said Board for the purpose of hearing any complaints that
may be made as to the value of any lot or piece of land appraised
as aforesaid, of which special session due notice shall be given
in the official city paper, and at which special session said
Board may alter any valuation of any lot or piece of land, if, in
their opinion, the same had been appraised too high or too low.
Section 7. The special assessments herein provided for may
be paid by the person liable therefor in ten approximately equal
annual installments but the owner of any property liable to such
assessment may within thirty days from the date of determining the
amount assessed against his property pay the same in full and his
property shall not be liable for any assessment for the cost of such
improvements, and bonds as hereinafter provided for shall be issued
for the amount of the cost of such improvements remaining unpaid at
the end of thirty days from the time such assessment is fixed.
Section 8 For the purpose of paying for the work and improve-
ments in this ordinance provided for, the Board of Commissioners
are hereby authorized and directed to issue improvement bonds of
the City of Salina in an amount not to exceed the cost of such
improvement and to run for a period of ten years and be payable in
ten approximately equal annual installments, together with interest
not to exceed five percent per annum which bonds shall be issued
and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due
and payable, the Board of Commissioners shall apportion and assess
against the lots or pieces of land within the taxing districts of
such improvements, special assessments covering the cost of such
improvements and the apportionment therein contained shall hold good
for all of the installments that are to oe collected from the
specific property chargeable with said improvement. Such assessment
and apportionment ordinance shall contain the total amount of tax
apportioned to each tract, piece or parcel of land within the taxing

district and shall state the number of annual installments in which
such tax is to be collected; and thereafter the City Clerk shall
annually, at the same time other taxes are certified certify to the
County Clerk of Saline County, Kansas, a full list of all property
liable for such work and improvements, together with the respective
amounts due on each of said tracts, piece or parcels of land , which
amounts shall include the annual installments and interest on all un-
paid balances for one year at the rate of not to exceed 5 percent per
annum, on such amounts so certified, which shall be collected as other
taxes are collected.'
Section 9. This ordinance shall take effect and be in full
force from and after its publication in the official city paper.

AN ORDINANCE creating and defining certain Main Sewer Districts
in the City of Salina, designated as Main Sewer Districts
"P" and "Q" and providing for the construction of a Main
Sewer in Main Sewer District "P" so created; providing for
the cost thereof and for the levy of special assessments
