3883 Emenient Domain flood wayORDINANCE NO. AN ORDINANCE relating to and providing for the condemnation of certain lands and easements necessary to construct certain drains, canals and artificial water courses, or to widen or straighten existing drains or water courses, including the cleaning of the same, or to construct the necessary levees and embankments or to raise the grades of any streets or alleys and approaches to bridges, or to raise said bridges, so far as the same may be necessary for the construction of said i7provements for the protection ^f the City of Salina and public and private property therein from the overflow or damage by water of the waters of the Smoky Hill River, a water course running in and near and through, the City of Salina, said land and easements lying within the City of Salina or without the city limits of said city and with- in five miles therefrom, all as provided for by Ordinance No. 3837 of the City of Salina; designating a benefit dis- trict and providing for the appointment of commissioners to make an appraisement of the lands or easements taken and to assess the damages therefor and benefits accruing therefrom. 1'N,'HF+,REAS'pursuant to the provisions of Ordinance No. 3837 duly passed by the Board of Commissioners February 17th, 1930, and duly published in the Salina Journal, the official city paper, on March 1st, 1930, the City !'ngineer of the City of Salina has made and filed in the office of the Gity �'lerk a survey and description of the lands or easements to be appropriated and condemned for the purpose mentioned in said ordinance, which is hereby referred to and made a part of this ordinance by re- ference, and WHEREAS, in the opinion of the boardof Commissioners of said city all of the property within the City of Salina will be specifically benefited by such proposed improvements, and com- missioners should be appointed to appri.ise the value of the lands and easements taken and to assess damages and benefits as required by law; NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. 'that there be and there are hereby appropriated and condemned, upon, in and over the private property heredin as specifically described, within the City of Salina and without the city limits of said city, and within five miles therefrom, lands and easements for the purpose of constructing thereon and therein such drains, canals and artificial water courses, and for the widening of existing drains and water courses thereon, including the cleaning of the same, and for the construction of such levees and embankments thereon, as shall be necessary for the construction of certain improvements and for the doing of the work as provided for in Ordinance No. 3837 of the City of Salina for the purpose of protecting the City of Salina and public and private property there- in from the overflow or damage by water of the waters of the Smoky Hill River, a water course running in and near, and through, the City of Salina, Kansas, so far as the same may be necessary for construction of such improvements and for the protection oP said city and the property therein, as aforesaid, and for the purpose of forever maintaining, repairing, rebuilding, reconstructing the same at any time when the same may become or may be deemed necessary by the governing body or by the City Engineer of said city, and for the purpose of going upon and entering and using the same for any or all such purposes, by any employee or officer of said city, or any person with whom the city may contract for such purposes, or his employees, the lands and easements to betaken and condemned and appropriated for such purposes, being upon, over, along and in the real estate in Saline County, "'ansas, described in sections 2 and 3 of this ordinance. SPetion 2. That the following described private property in Saline County, Kansas, be taken, condemned and appropriated for the purposes aforesaid, to -wit: (1) All of that part of Lot 1 Surveyor's Plat No. 34, be- ginning at a point 183 ft. south of the northwest corner of the northeast quarter of Section 18, Township 14,south, Range 2 west, thence south 240 ftl to the north line of Iron Avenue extended, thence east 75 ft. along the north line of iron Avenue extended, thence north and parallel with the west line of said northeast quarter 240 ft., thence west and parallel with the north line of Iron Avenue extended 75 ft. to place of beginning. That an application be prepared by the City Attorney and that the same be presented by him to the Judge of the District `'ourt of Saline County, Kansas, describing the lands and easements sought to be taken and condemned, as in this ordinance set forth, and setting out the benefit district above described, and requesting the appointment of commissioners to appraise the value of the lands and easements taken and condemned under the provisions of this ordinance, and to assess the other damages, if any, done to the owners of such property, respectively, by such appropriation, and to assess against the City of Sal na the amount of the benefit to the public generally and the remainder of such damages against the property within the benefit district which shall in the opinion -f the appraisers be especially benefited by the proposed improvements.
