3873 Confirm Utility Improvements• ORDINANCE; NO. 3873 C .( Publ i U AN ORDINANCE ratifying and confirming a contract with L. W. Rexorad for the constructi-n of certain curbing, guttering and paving improvements on certain streets in the City of Salin, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BF IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, of the proposal of L. W. Rexroad hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on April 7th, 1930, •r:hich is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city • by its Mayor on April 7th, 1930, for the construction of certain public improvements in the City of Salina, to -wit: Curbing and guttering and paving of Chicago Street from the south line of Ash Street to the north line of State Street, as provided for by Ordinance No. 3847. Curbing and guttering and paving of Columbia Avenue from the south line of Ash Street to the north line of Iron Avenue, as provided for by Ordinance No. 3848. Curbing and guttering and paving of Ellsworth Av-nue from the west line of Highland Avenue to the east line of Ninth Stre:-t, as provided for by Ordinance No. 3849. Curbing and guttering and paving of Gypsum Avenue from the east line of Ohio Street to the east line of Columbia Avenue, as provided for by Ordinance No. 3852. Curbing and guttering and paving of Highland Avenue from ti -le south line of Claflin Avenue to the north line of Cloud Street, as provided for by Ordinance No. 3853. Curbing and guttering and paving of Park Place from the west line of Oakdale Avenue to the east line of Oakdale Drive, as provided for by Ordinance No. 3854. • Curbing and gut`ering and paving of Washington Avenue from the west line of Tenth Street to the east line of Eleventh Street; as provided for by Ordinance No. 3859. Curbing and guttering and paving of Seventh Street from the north line of Elm Street to the south line of North Street, as provided for by Ordinance No. 3858. Curbing and guttering and paving of Front Street from the south line of Pine Street to the south line of North Street, as provided for by Ordinance No. 3851, Paving Center Street from the east line of Fifth Street to the entrance to Kenwood Park, as provided for by Ordinance No. 3846. Paving Prescott Avenue from the west line of Eleventh Street to the east line of Twelfth Street, as provided for by Ordirnnce No. 3855. at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said. improvements as shown by the sworn estimates of the Citi* Engineer on file in the • office of the City Clerk, which estimates are hereby referred to and 342 made a part of this ordinance. - Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accord - ante with the proposal of said contractor and under the teras of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work -progresses in the manner and form as required bN lallr, the total smount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 42 percent per annum and to mature not later than December 31st, 1930, and to be issued in such amounts and at such ti ue as money for the pa-.nnent of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds and issued in lieu thereof.
