3872 Issue Temp Notes and BondsJ ORDINANCE NO. 3872 AN ORDINANCE ratifying and confirming a contract for the construction of Storm Sewers No. 17 and 18 in the City of Salina, and orovid- ing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the Citi- of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor Construction Company hereinafter referred to as the contractor as submitted to the Board of Commissioners on April 7, 1930, which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on be- half of said city by its Mayor on April R, 1930, for the construc- tion of storm sewers No. 17 and 18 as provided for by Ordinance No. 3861, said storm sewers to be constructed of Lock Joint reinforced concrete pipe in sizes Y) inch to 54 inch, inclusive, and of No. 2 double strength vitrified clay pipe in sizes 12 inch to 27 inch, inclusive, at and for the unit prices contained in said proposal, w1lich -proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer filed in the office of the City Clerk, which estimates are hereby referred to and made parts of this ordinance. Section 2. That said storm sewers No. 17 and 18 shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer and on file in the office of the City Clerk, and in accordance with the proposal of said con- tractor and under the terms of said co) -,,tract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the Citv Cl­rk be issued from time to time as the work progresses in the mariner and form as required by law, the total amount thereof not to exceed the contract price for such work, szch notes to bear interest not to exceed 41 percent per annum and to mature not later than January lst, 1931, and to be issued in such amounts and at such time as mone'r for the payment of the cost of such work may be re- quired, such notes to be issued to said contractor and to be re- deemed and cancelled at the time that permanent bonds are issued in lieu thereof, 40 Section 4. That said storm sewers No. 17 and 18 shall be built and constructed in accordance with the plans and specifications there- for prepared by the City Engineer and on file in the office of the City Clerk, and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Magor and attested by the City k'lerk be issued from time to time as the ,:vork progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 41 percent per annum and to mature not later than January lst, 1931, and to be issued in such amounts and at such time as money for the pW ment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in force from and after its publication in the official city paper.
