3862 Confirm Utility ImprovenetsORDINANCE NO. 3862 ----------(P�t�lishe 7_Zalina_J._o-nma AN ORDINANCE ratifying and confirming a contract for the building and construction of certain lateral sanitary sewers in Lateral Sanitary Sewer Districts No. 153 and 157 and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance bt- the City of Salina of the proposal of R.7. Snyder, hereinafter referred to as the "Contractor' as submitted to the Board of Commissioners on March 17, 1930, which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by the Mayor on March 17, 1930, for the construction of certain later, sanitary sewers in Lateral Sanitary Sewer Districts No. 153 and 157 as provided for in Ordinance No. 3812 at and for the unit prices contained in said proposal, which Froposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer filed in the office of the City Clerk, which estimate are hereby referred to and made a part of this ordinance. Section 2. That said lateral sanitar�7 sewers shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the Cit -,%.T Clerk and in accordance with the proposal of said con- tractor and under the terms of said contract entered into between the city and said contractor on March 17, 1930 which said plans, specifications, proposal and contract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in con- nection therewith to be performed and furnished in accordance with said plans and specifications, conditioned however upon the furnishing by the contractor of the contract, maintenance and statutory bonds within the tiiie required of said contract. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to tiffie as the work l;rogresses in the manner and form as required by law, the total amount thereof nct to exceed the contract price for such work, such. notes to bear interest not to exceed 4-1/4`�, per annum and to be issued in such amounts and at such ti e as money for the patrnlent of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
