3834 Light Industrial Districti 1 E LJ • 1 • ORDINANCE NO. 3834 (Published in the Salina Journal _ �z�, G,,l /^S_ 1930 AN ORDINANCE amending Ordinance No. 3188 being an ordinance dividing the City of Salina into zones or districts and regulating and restticting the location of trades and industries and the uses of lands in such districts or zones and defining an additional industrial district or zone. WHEREAS, the City Planning Commission of the City of Salina has recommended to the Board of Commissione s certain changes in the zones or c',istricts defined by Ordinance No. 3188 as amended as hereinafter set forth, and due notice thereof has been given as renuired by lajU and in the opinion of the Board of Commissioners such changem and should be :lade, no valid protest in writing against such change having been filed as required by law, NOti,T THEREFORE BE IT ORDAINED by the Board of Uommissioners of the City of Salina, Kansas: Section 1. That the following land within t' -ie City of Salina, to -wit: All of Block 1 in Hansen Court an addition in the City of Salina, be and the same is hereby included within, added to and made a part of the "D" light industrial district as defined in ""rdinance No. 3188 and said ordinance as amended, and that said land may be used for the purposes permitted in such "D" light industrial district as provided for in said ordinance, subject to the restrictions and regula- tions '_Hereinafter provided for. Section 2. That any building erected on any of the land described in the prccedirg section of this ordinance shall be of such t,m e as may be approved by the Board of Commissioners and by the City Planning Commission of said city, and all architectural and landscape plans in connection with any such building and all advertising signs used in connection therewith shall be submitted to and approved by the Board of Commissioners and by the Cite Planning Commission before any building permit for any such building shall be issued, provided that no such building shall be used for any purpose other than for the manu- facture and sale of ice cream, or other milk products, or for uses incidental thereto, except with the permission of the Board of Commissioners of said city, PROVIDED FYRTHER that any such building shall 'ave a set back of 100 ft. from the south line of Iron Avenue and 75 ft. from each of the other streets abutting upon the land described in Section 1 of this ordinance, and any building erected on or any use made of anysuch land contrary to the, foregoing pro- visions or contrary to the plans approved as provided for herein shall be deemed to constitute a violation of said Ordinance No. 3188 by any person responsible or causing such violation; AND PROVIDED 4 230 further that if any restriction contained in this ordinance shall be held invalid for any reason then this entire ordinance shall be deemed invalid and of no effect, it being the intention of the Board of Connissioners to adopt this ordinance as a whole only with re- strictions and conditions herein contained. WHEREAS, the City Planing Commission of the City of Salina has recommended to the Board of Commissioners certain changes in the zones or districts defined by Ordinance No. 3188 as amended as hereinafter set forth, and due notice thereof has been given as required by law and in the opinion of the Board of Commissioners such changes should be made, no valid protest in writing against such change having been filed as required by law, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. That the following land within the City of Salina, to -wit: All of Block 1 in Hansen Court an addition in the City of Salina, be and the same is hereby included within, added to and made a part of the "D" light industrial district as defined in Ordinance No. 3188 and said ordinance as amended, and that said land may be used for the purposes permitted in such "D" light industrial district as provided for in said ordinance, subject to the restrictions and regula- tions hereinafter provided for.
