AN ORDINANCE amending Ordinance No. 3188 being an ordinance
dividing the City of Sal1na into zones or districts and
regulating and restricting the location of trades and in-
dustries and the uses of lands in such districts or zones
and defi.ning additional commercial districts or zones.
WHEREAS, the City Planning Commission of the City of Salina has
recommended to the Board of Commissioners certain changes in the
zones or districts defined by Ordinance No. 3188 as amended as
hereinafter set forth, and due notice thereof has been given as
required by law and in the opinion of the Board of Commissioners
such changes should be made, NOW THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the following land within the City of
Salina shall be and the same is hereby included, added to and
made a part of the "C" Commercial District as defined in Section
5 of Ordinance No. 3188 and said ordinance as amended, and that
said land may be used for the purpose designated in Section 10
of said Ordinance No. 3188, subject to the restrictions and
regulati-ns hereinafter provided for, to -wit: All that part
of Blocks 3,4,5,6 in the Episcopal Military Institute Addition
and Block 1 Golden Belt Subdivision, and the unplatted ground
lying between Block 1 Golden Belt Subdivision and Block 6
Episcopal Military Institute Addition, not already in said
"C" Commercial District; Lots 117, 119, 121 and 122 on Third
Street Original Town; Lot 1 Block 1 Bonds Addition; Lot 21 on
Ninth Street in Prescott Addition; the south 1/2 Lot 10, Block
17, South Park Addition.
Section 2. That any commercial bui ding constructed on
any of the land described in the preceding section of this
. ordinance shall be of residential type, and all architectural
and landscape plans for any such commercial building and any
advertising signs to be used in connection therewith shall be
submitted to and approved by the City Planning Commission of the
City of Salina before any building permit for any building to
be erected they -,on shall be issued, and any such commercial
building shall have the same set back from any abutting street
as is required for a residential building in any residential
district adjoining such commercial district created by the pre-
ceding section of this ordinance, unless the Board of Commissioners
shall by ordinance permit a less or different set back, and any
budding erected on or any use made of any of such land contrary
to the foregoing provisions shall be deemed to constitute a
violation of said Ordinance No. 3188 by any person responsible
for or causing such violation; provided that if any section or

part of this ordinance shall be held invalid for any reason, then
this entire ordinance shall be deemed invalid and of no effect,
it being the intention of the Board of Commissioners to adopt this
ordinance as a whole and only with the restrictions and conditions
herein contAined.
Section 3. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
