AN ORDINANCE relating to and providing for the condemnation of
certain land and easements necessary to construct certain
drains, canals and artificial water courses, or to widen or
straighten existing drains or water courses, including the
cleaning of the same; or to construct the necessary levees
and embankments or to raise the grades of any streets or
alleys and approaches to bridges, or to raise said bridges,
sofar as the same may be necessary for the construction of
said improvements for the protection of the City of Salina
and public and private property therein from the overflow
or damage by water of the waters of Dry Creek, a water course
running in and near, and through, the City of Salina, said
land and easements lying within the City of Salina or without
the city limits of said city and within five miles therefrom,
all as provided for by Ordinance No. 3820 of the City of Salina;
designated by a benefit district and providing for the appoint-
ment of commissioners to make an appraisement of the land or ease-
ments taken and to assess the damages therefor and benefits
accruing therefrom.
THEREAS, pursuant to the provisions of Ordinance No. 3820 duly passed
by the Board of Commissioners December 30, 1929, and duly published
in the Salina Journal, the official city paper, on January 15, 1930,
the City Engineer of the City of Salina has made and filed in the
office of the City Vlerk a survey and description of the lands or
easements to be appropriated and condemned for the purpose mentioned
in said Ordinance No. 3820, which is hereby referred to and made a
hart of this ordinance by reference, and
NHEREAS, in the opinion of the Board of Commissioners of said city
all of the property within the City of Salina will be specifically
benefited by suchproposed improvements and commissioners should be
appointed to appraise the value of the lands and easements taken and
to assess damages and benefits as reauired by law; NOW THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas.
Section 1. That there be and there are hereby appropriated
and condemned, upon, in and over the private property herein as
specifically described, within the City of Salina and without the
city limits of said city and within five miles therefrom, and ease-
ment or easements for the purpose of constructing thereon and therein
such drains, canals and artificial water course, and for the widening
. of existing drains and water courses thereon, including the cleaning
of the same, and for the construction of such levees and embankments
thereon, as shall be necessary for the construction of certain im-
provements and for the doing of the work as provided for in Ordinance
No. 3820 of the City of Salina for the purpose of protecting the City
of Salina and public and private property therein from the overflow
or damage by water of the waters of Dry Creek, a water course running
in and near, and through, the City of Salina, Kansas, sofar as the same
may be necessary for construction_ of such ini-rovements and for the
protection of said city and the property therein, as aforesaid, and
for the purpose of forever maintaining, repairing, rebuilding, re-
constructing the same at any time when the same may be come or may
be deemed necessary by the governing body or by the City Engineer of
said city and for the purpose of going upon and entering and using the
same for any or all such purposes, by any employee or officer of said

city, or any person with whom the city may contract for such purposes,
or his employees, the easements to be taken and condemned and appro-
priated for such purposes, being upon, over, along and in the following
described real estate in Saline County, Kansas, to -wit:
The west 20 feet of Lots 1,2,3, Block 2, Leavenworth Addition;
The west 25 feet of Lots 4,5,6 and 7, Block 2 Leavenworth Addition:
The east 15 feet of Lots 1,2,3,4,5,6 and 7 Block 1 Leaven�,iorth

Section 2. That all private property and all pl-hlic property
lying within the City of Salina is in the opinion of the Board of
Commissioners of the City of Salina is and will be specially benefited
by the construction of said work and improvements herein above referred
to, and that the entire City of Salina; Kansas is hereby designated
as a benefit district.
Section 3. That an application be prepared by the City
Attorney and that the same be presented by him to the Judge of the
District Court of Saline County, Kansas, describing the land and
easement sought to be taken and condemned, as in this ordinance set
forth, and setting out the benefit district above described, and
requesting the appointment of commissioners to appraise the value
of the lands or easements taken and condemned under the provisions
of this ordinance, and to assess the other damages, if any, done to
the owners of such property, respectively, by such appropriation,
and to assess against the City of Salina the amount of the benefit
to the public generally and the remainder of such damages against
the property within the benefit district which shall in the opinion
of the appraisers be especially benefited by the proposed improvements.
Section 4. This ordinance shall take effect and be in force
from and after its publication in the official city paper.

Section 2. That all private property and all public
pro-erty lying within the City of Salina�ist in the opinbn of
the Board of Commissioners of the City of Salina "is and will be
specially benefited by the construction of said work and improve-
ments herein above referred to, and that the entire City of
Salina, Kansas is hereby designated as a benefit district.
Section 3. That an application be prepared by the
City Attorney and that the same be presented by him to the
Judge of the District Court of Saline County, Kansas, describing
the land and easement sought to be taken and condemned, as in
this ordinance set forth, and setting out the benefit district
above described, and requesting the appointment of commissioners
to appraise the value of the lands or easements taken and con-
demned under the provisions of this ordinance, and to assess
the other damages, if any, done to the oviners of such property,
respectively, by such appropriation, and to assess against the
City of Salina the amount of the benefit to the public generally
and the remainder of such damages against the property within
the benefit district which shall in the opinion of the apr_raisers
be especially benefited by the proposed improvements.
Section 4. This ordinance shall take effect and be
in force from and after its publication in the official city
paper.
