3827 Confirm Sewer Imp - Ash Streeti ORDINANCE NO. 3327 Published in the Salina Journa Nx-,V � 193C) AN ORDINANCE ratifying and confirming a contract for the repair and reconstruction of a certain sewer in Ash Street between Des Moines Avenue and the Smoky Hill River, and prr-viding for the issuance of bonds to pay the cost thereof, and for the issuance of temporary notes to pay such cost pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the contractor, as submitted to the Board of Com- missioners December 9, 1929, which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor lying in Ash Street between Des Moines Avenue and the Smoky Hill River in the City of Salina, Kansas, as provided for by ordinance No. 3760, said sewer to be reconstructed of 36" cast: iron pipe sewer including all excavation, piling, sheeting, shoring, concrete work, drainage, pumping, backfill and removal of excess materials and all work incidental thereto, as provided for in said proposal and said contract, at and for the unit prices for all of said work as contained in said proposal, which proposal and contract are here- by referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer on file in the office of the City Olerk, which estimate • is hereby referred to and made a part of this ordinance. Section 2. That said sewer shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer and on file in the office of the City 6lerk, and in accordance with the proposal of said contractor and tinder the terms of said contract, allcf which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interst not to exceed 42 per cent per annum and to mature not later than May lst, 1930 and to be issued in such amounts and at such time as money for the payment of the cost of such work may be reottired, 0 and signed on behalf of the city by its Mayor on December 14, 1929, for the repair and reconstruction of that portion of said sewer lying in Ash Street between Des Moines Avenue and the Smoky Hill River in the City of Salina, Kansas, as provided for by ordinance No. 3760, said sewer to be reconstructed of 36" cast: iron pipe sewer including all excavation, piling, sheeting, shoring, concrete work, drainage, pumping, backfill and removal of excess materials and all work incidental thereto, as provided for in said proposal and said contract, at and for the unit prices for all of said work as contained in said proposal, which proposal and contract are here- by referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer on file in the office of the City Olerk, which estimate • is hereby referred to and made a part of this ordinance.
