Any person or persons desiring a license under this ordinance shall make application therefor in writing, over his or their signature, to the Board of Commissioners. Such appli- cation shall state the number of billiard and pool tables to be set up, kept and used; the location of the room or rooms in which such tables are to be set up and used and shall contain a certificate of at least two reputable citiznes of said city as to the good character of the applicant or applicants and their recommendation that such license be granted. Section 4. If the Board of Commissioners shall deem the appli- cant to be a fit person to engage in such business, and shall approve such application and the bond submitted therewith, the City Clerk shall upon payment of the license tax herein provided for, issue such license. Section 5. It shall be unlawful for any person or persons to keep open or cause or permit to; be kept open any billiard or pool hall, bowling alley, or any other place where billiard or pool tables or other gaming tables or devises are kept for pay on the first day of the week, commonly known as Sunday, or between the hours of 11 p.m. and 6 a.m. on any day, or permit any game to be played therein on Sunday or between such hours of 11 p.m. and 6 a.m. on any day. Section 6. It shall be unlawful for the owner, manager, keeper or person in charge of any place described in the preceeding section hereof to permit or allow any person under the age of nineteen years to play at or take part in any game in any said place, or to loiter or congregate in or about any such place. Section 7. It shall be unlawful for the owner, manager, keeper or person in charge of any pool or billiard hall to kno Xingly per- mit the use of profane or indecent language or to permit any riotous or disorderly conduct in such place. Section 8. It shall be unlawful for the owner, manager, keeper or person in charge of any poor or billiard hall to seel or keep for sale or free distribution any intoxicating liquors or to permit any intoxicating liquor to be kept or used in or about said premises, or to permit any disorder in or about said premises, or to permit any gambling in or about said premises. Section 9. It shall be unlawful for the owner, manager ,keeper or peron in charge of any pool or billiard hall to permit such place to be connected with any other separate room or compartment either in the same or any adjoining building, unless the connecting door- ways or passageways between such premises and any such room or com- 95 partment shall be at all times kept open and free from any door, gate or other device which may be shut or locked, and there shall be no door, gate or other device capable of being shut or locked betweon any such pool or billiard hall and any such adjoining room or com- partment either in said room or adjoining room, except that this section shall not apply to rooms designed for and used solely for toilet purposes. Section 9 Every license granted under the provisions of this ordinance shall be revokable and cancellable at the pleasure of the Board of Commissioners of the City of Salina, Kansas, irrespective of any other provision contained in this ordinance for the revocation • of any such license, provided however, that if such revocation or cancellation shall be made by the Board of Commissioners without or prior to the conviction of the owner, manager, of such pool or billiard hall for any violation of this ordinance, the pro rata portion for the license fee for the unexpired term of the license shall be returned to the person who shall have paid the same. Section 10. Any person or persons who shall violate any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be fined not less than $10.00 nor more than $100.00 or be imprisoned not to exceed thirty days, or shall be subject to both such fine and imprisonment, for each offense, and upon the conviction of any person or persons to whom a license as provided for in this ordinance shall have been issued, or upon the conviction of any manager, keeper, or person • in charge of any pool or billiard hall licensed under this ordinance, or any employee thereof, of any such violation, or upon the con- viction of any of such person of selling or keeping for sale or free distribution, or of using or permitting the keeping or use of any intoxicating liquors, or of permitting any gambling in or about said premises, or upon the conviction of any other person upon the charge of gambling in or about said premises, the Board of Com- missioners may revoke such license, and after any such revocation, no license shall at any time thereafter be granted or issued to any such person so convicted, or in whose premises any such act was committed, and upon any such conviction, an action shall at once accrue upon the bond given by any such person or persons, and the person or persons to whom any such license is issued shall be deemed responsible for and guilty of any violation of this ordinance caused or permitted by any manager, keeper, or employee i of such pool or billiard hall. Section 11. Any person or persons who shall keep or maintain any pool or billiard table required to be licensed by this ordinance, without first obtaining a license therefor, or who shall keep or maintain any such pool or billiard table or keep open any billiard or pool hall after any sue$ license shall be revoked shall f or each day or part of a day that any such pool or billiard hall is kept open, be deemed guilty of a misdemeanor and for each separate offense shall upon conviction be punished by a fine of not less than $50.00 nor more than $100.00; or by imprisonment; and provided further that if any bond given under this ordinance shall be cancelled by the surety, or otherwise, the operation or use of any pool or billiard table thereafter and before a new bond is given shall be deemed an operation thereof without a license, and any such license shall be deemed null and void during any period in which no bond as herein required is in effect. Section 12. That no more than 8 licenses shall hereafter be granted or be in effect at any time under the provisions of this ordinance; provided however that nothing in this section shall be construed to prevent the re -issuing of licenses to persons now engaged in such business in the City of Salina, or to bona fide purchases of any such business, but in the event of the cancellation of the license of any such person or persons, or of their successors in business, no additional licenses shall be gflanted in excess of the number above specified. Section 13. At least two copies of this ordinance, and the license issued hereunder, shall be,poMd in conspicuous places in each pool or billiard hall licensjclke provisions of this ordinance, and a faiAre to ko6v such copies and license posted shall be deemed a violat`of the provisions of this ordinance. Section 14. That Ordinance No. 3255 passed and approved June 14th 1926 be and the same is hereby repealed. Section 15.
