AN ORDINANCE ORDINANCE amending Section 3 of Ordinance No. 3809 relating
to the vacation of certain alleys in Block 5 and Block 10,
Depot Addition, Salina, Kansas. .
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas.
Section 1. That Section 3 of Ordinance 3809 be and the
same is hereby amended to read as follows:
"Section 3. That the alleys mentioned in Section 1 and
2 of this ordinance are vacated, and this ordinance shall take
effect, upon condition that the City of Salina shall and it
does hereby reserve the right to enter u,, -on t --ie land now com-
prising such alleys at any time hereafter for the purpose of
repairing, maintaining, reconstructing or constructing the
sewers which are now located or which may be hereafter located
in the ground now comprising such alleys, PROVIDED, however, that
the west 110 feet of the sewer in the alley running east and
west in said "lock 5 may be disconnected and blocked off at the
. expense of the owner of the land abutting ftiereon, in which event
the reservation herein contained shall_ not apply to that part of
the east and west alley lying west of the intersection of such
a1 -ley with the north and south alley in said Block 5.n
Section 2. That the original Section 3 of 3809 be and the
same is hereby repealed.
Section 3.
This ordinance shall take effect and b e in force
from and after its publication in the official city paper and after
the same is recorded in the office of the Register of Deeds of
Saline County, Kansas.
