3803 Requiring Sidewalks48 ORDINANCE NO. 3803 E AN ORDINANCE providing for and requiring the construction of certain sidewalks along certain streets in the City of Salina. WHEREAS, petitions each duly signed by ten or more citizens of the City of Salina, have been filed in the office of the City Clerk, praying for the construction of sidewalks along the streets, and in front of and abutting upon the property, mentioned in the following ordinance, and WHEREAS, said petitions have been considered by the Board of Com- missioners of the City of Salina and have been found to be sufficient and the sidewalks hereinafter referred to are by said Board of Com- missioners deemed to be necessary; NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. '2hat concrete sidewalks shall be and the same are hereby ordered to be constructed and laid along the following streets and in front of and abutting upon the following described lots, tracts and pieces of land in the City of Salina, said con- crete sidewalks to be five feet in width, to -wit: Along the south side of Walnut Street in front of and abutting Lot 26, upon the north side of Lot 1, Block 1, Walnut Grove Addition xxAxg*j*jtj Walnut St., Phillips Third Addition and across the right-of-way of the Missouri Pacific Railroad Company. Along the east side of Tenth Street in front of and abutting upon the west side of Lots 1 and 3, Block 17 in South Park Addition. Along the south side of Beloit Avenue in front of and abutting upon the north side of Lot 14 on Ninth Street in the grounds of Kansas Wesleyan University. Along the west side of Sheridan Street in front of and abutting upon the east side of Lots 1 to 8 inclusive, in Block 13 and Lots 1 to 11 inclusive, in Block 18 in Southern Heights Addition. Along the south side of State Street in front of abutting upon the north side of the east 35 ft. of Lot 1, Block 4, Leavenworth Addition. Along the north side of Pacific Avenue in front of and abutting upon the south side of Lots 1 and 2 in Block 4 and Lots 1 and 2 in Block 5 in the Episcopal Military Institute Addition. Section 2. That the sidewalks provided for in the preceding sections of this ordinance shall be constructed and laid in accordance with the provisions of Ordinance No. 2407 and Ordinance No. 3509 and in accordance with the plans and specifications for concrete sidewalks on file in the office of the City Engineer and in the office of the City Clerk, pursuant to the provisions of said Ordinance No. 3509, which plans and specifications have been and are now hereby approved, the same to be constructed at the grade to be furnished by the City Engineer. 1 - c Section 3. That the owners of each of the lots and parcels of land described in the preceding sections of this ordinance be and they are hereby ordered to construct in front of and abutting upon said lots or parcels of land, and along the streets herein- above mentioned, concrete sidewalks as above provided for, and if any one of them shall fail within 15 days from and after the publication ofthis ordinance to construct such sidewalks, the City Engineer shall prepare and file with the City Clerk detailed estimates under oath of the cost of constructing such sidewalks and the Board of Commissioners of said city, shall proceed to construction or cause to be constructed such sidewalks as herein provided for and may let a contract therefor, at a cost not to exceed the estimate of the City Engineer, and shall assess the cost thereof against such lots or parcels of land upon which such sidewalks shall abutt, according to the front foot thereof, and such cost so assessed shall be duly certified by the City Clerk to the County Clerk of Saline County to be collected as other taxes and assessments are collected.
