ORDINANCE NO. 3799
AN ORDINANCE appropriating $6,000.00 to H. J. Taylor Uonstruction
Company out of the sewage disposal fund in the city treasury.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas.
Section 1. That the sum of $6,000.00 be and the same is
hereby appropriated out of the sewage disposal fund in the city
treasury to H. J. Taylor Qonstruction Company in payment of the
amount remaining due to said H. J. Taylor Construction Company on
account of a contract of said company with the City of Salina, Kansas,
dated December 15, 1926, the payment of which has heretofore been
withheld on account of the lack of opportunity to test three sewage
pumps erected by said contractor in the sewage pumping station
at Ash Street and Rive side Drive, this appropriation being made
in consideration of the execution and delivery by said contractor
of a bond in the sum of $6,000.00 with Southern Surety yompany of
New York as surety, dated October 12, 1929 which bond is hereby
approved, conditioned that such pumps shall upon final test prove
satisfactory to and be accepted by the City of Salina, Kansas or
that if said pumps, or any of them, shall upon final test prove
unsatisfactory, that they or any of them which may be unsatisfactory
shall be replaced by the contracot with pumps complying with the
specifications therefor and tivh.ich shall be satisfactory to and
accepted by the City of Salina, Kansas, provided that such final
test shall be made and such pumps be aceopted or rejected within
five years from the date of said bond.
Section 2. That the director of finance be and he is hereby
authorized to issue a warrant countersigned by the City Manager,
upon the city treasurer, for the payment of the amount provided
for in Section 1 of this ordinance.
