AN ORDINANCE relating to the condemnation of certain private property for the purpose of widening Ohio Street from the south line of Gypsum Avenue to the south line of the city limits; designating a benefit district and providing for the appointment of com- missioners to make an appraisement and to assess damages and benefits. WHEREAS, pursuant to the provisions of Ordinance No. 3780, the Engineer of the City of Salina has made and filed in the office of the City Clerk a survey and description of the land to be appropriated for the purpose of widening Ohio Street, from the south line of Gypsum Avenue to the south city limits, as provided in said ordinance, and WHEREAS, in the opinion of the governing body of said city certain property will be specifically benefited by said proposed widening of Ohio Street and the benefit district to include the property specially benefited should be fixed and commissioners appointed to appraise the land taken and assess damages and benefits as required by law; NOVI THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the following described tracts or parcels of land be and the same are hereby condemned and appropriated for the purpose of widening Ohio Street in the City of Salina from the south line of Gypsum Avenue to the south city limits at the intersection of Ohio Street and Greeley Avenue, particul;:arly described as follows, to -wit: The east seven feet of Lots 2, 80 91 10, 11, 12 and 6 of Surveyor's Plat No. 12. Section 2. That all of the private property lying with benefit district hereinafter described is in the opinion of the Board of Com- missioners specially benefited by the widening of Ohio Street as herein provided for, and that said benefit district be and the same is hereby designated as follows: All of Lot 3 and all of Lots 2, 8, 92 10, 11, 12 and 6 except the east seven feet thereof taken in this proceeding, all in Surveyorts Plat No. 12; the west half of Block 1 and the west half of Block 5 in Stack place, all in the City of Salina, Saline County, Kansas. Section 3. That an application be prepared and presented by the City Attorney to the Judge of the District Court of Saline County describ- ing the land sought to be taken and settif39 out the benefit district above described and requesting the appointment of commissioners to appraise the value of the land taken and to assess damages therefor and to assess benefits against the property in said benefit district and against the City at large for such benefit as may accrue to the public generally, if any. Section 4. This ordinance shall take effect and be in force from and after its publication in the official city paper.
