3770 Regulating Billboradsr; ORDINANCE NO. 3770 (Published in the Salina Journal 1�z _1929) AN (R DINANCE relating to and regulating the construction and location of billboards, signboards and board fences on public streets and property adjacent thereto in the City of Salina, and providing for and requiring the removal of billboards, signboards and board fences erected, constructed or maintained contrary to the provisions of this ordinance, and providing a penalty for the violation of this ordinance. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it shall be unlawful for any person, firm or corporation to construct or erect any billboard or signboard or any board fence exceeding three feet in height upon which signs or ad- vertisements are or may be painted, posted or attached, within sixty feet of any public street or highway in the City of Salina, Kansas, or within one hundred feet of any railroad grade crossing, street intersection, or entrance to a driveway off of any public street in the City of Salina, or to keep or maintain any such billboard, signboard or board fence, the erection or construction of which would be prohibited by the provisions of this ordinance; provided that this section shall not apply to any sign not exceeding nine square feet in area, and not exceeding three feet in height, used solely for the purpose of advertising the sale or rental of the property upon which such sign is located. Section 2. It shall be the duty of the owner of any billboard, signboard or board fence which is kept or maintained on any property in the City of Salina contrary to the provisions of Section 1 of this ordinance, and of the owner, tenant and occupant of the land on which any such billboard, signboard or board fence is kept and maintained, to remove such billboard, signboard or board fence with- in thirty days from the date this ordinance takes effect. If any such person, firm or corporation shall fail, refuse or neglect to remove any such billboard, signboard or board fence as herein re- quired, within such time, it shall be the duty of the Street Super- intendent of the City of Salina to give a written notice requiring such removal to the owner of such billboard, signboard or board fence, if the name of such owner can be determined and if such owner is a resident of the City of Salina and he shall give notice to the owner, or to the agent of the owner, and to the tenant or occupant to remove or cause to be removed any such billboard, signboard or board fence within ten days from the date of the giving of such notice. Section 3. If the owner of any such billboard, signboard or board fence, or the owner, agent, occupant or tenant of the land upon which the same may be located, shall fail to remove the same 12 within the time provided for in such notice, it shall be the duty of the Street Superintendent of the City of Salina to proceed to remove the same, and to file a statement of the cost thereof in the office of the City Clerk, and all billboards, signboards or board fences which are not removed as provided for herein, within the time pro- vided for in such notice, are hereby declared to be public nuisances, the cost of removing the same as shown by the statement of the Street Superintendent filed as aforesaid shall be assessed against the land from which any such billboard, signboard or board fence shall be re- moved by the Street Superintendent as provided for herein and such cost shall be certified by the City Clerk to the County Clerk and collected as other taxes are collected; but nothing herein contained shall be deemed to supersede or take the place of the penalty provided herein for the violation of this ordinance. Section 4. Any person, firm or coporation or the agent, representa- tive, officer or member or director or any person, firm or corporation who shall violate any of the provisions of this ordinance, or who shall permit the violation thereof shall be deemed guilty of misdemeanor qnd for each offense shall be punished by fine not less than $5.00 or more than $50.00, and each day during which the violation of any part of this ordinance shall continue shall be deemed a separate off®nae.
