5023 Street Improvements - Ash StreetORJILANCE No. 5023 (Published in the Salina Journal Q,J a 1942) N ORDINANCE providing for the repair and reconstruction of a certain portion of a certain sewer in Ash Street in the City of Salina in additicn to that portion provided for in Ordinance No. 5018 and providing for the payment of the cost of such improvement by the city at large and for the issuance of Teneral improvement bonds of said city to pay such cost. iE"r EAS, a certain portion of the main sanitary sewer and appurtenances thereto in Ash Street in the City of Salina lying between Columbia Aven,ie and Kansas Avenue, for a distance of approximately 88 feet, in addition to that portion provided for in Ordinance No. 5018, is in need of repair and reconstruction by reason of damage caused by flood waters; and i,14EREAS, in the judgment of the governing body of the City of Salina such portion of said sewer and appurtenances thereto should be repaired and reconstructed in the manner Provided by law; and H said sewer serves a substantial portion of said cit- and in the judg- ment of the body of said city the cost of repairing and reconstructing the same would be borne by the city at lar, -e; and Vv'HEREASIV the general fund of said city is insufficient to pay such cost and such SoverninV body deems it necessary to issue general improvement bonds of said city in the manner provided by law to pay such cost; !_'0Vv TTHERL.FoRE BE IT ORDAIXED by the Board of CoNz.-iissioners of the City of Salina, Kansas; Section 1. That the foreroinE preambles be and they are hereby adopted as a part of this ordinance and that a certain portion of the sanitary sewer in Ash Street in the City Of Salina lying between Columbia Avenue and Kansas Avenue, approxiij;ately 88 feet in length in addition to that portion provided for in Ordinance No. 5018, and the necessary appurtenances thereto be repaired and reconstructed to such extent as will be necessary within the limits herein mentioned. Section 2. That on or before the 30th day of November, 1942 the City Engineer shall prepare and file with the City Clerk plans and specifications for the repair and reconstructin- of the nortion of said sewer and appurtenances dea- 0 cribed in Section 1 hereof, together with a det!�iled estimate of the cost thereof, under oath, and thereafter the City Clerk shall advertise in the official city paper for three consecutive days for sealed proposals for the construction of such work according to the plans and specifications of the City Engineer. Upon receipt of such proposals the governing body shall let a contract for such work whose and improvements to the lowest responsible bidder therefore, if -there be any/bid does not exceed the estimate of the City En-ineer, but the city shall reserve the right to reject any or all bids and. if no bid shall be received within such estimate the governing; body shall have thenower to do such work and make such improvements within the estimated cost thereof as provided by law. Section 3. That for the Purpose of payinx,, the cost of said work and improve- r,ients, general improvement bonds in an amount not to exceed the contract price for such work or the cost thereof if done by the city, shall be issued and sold in the manner provided by lai^.- and for the purpose of paying such bonds and interest as the Sp-.,r,e becone due and pay -able, t Board of Commissioners shallv le y a general tax upon all taxable property in the City of Salina in the time and manner provided by law.
