5022 Penny ArcadesORDI:,ANC'E N0, 5022 Published in the Salina Journal November 21, 1942) AN ORDINANCE re-ulating and providing for and requiring the payment of a Ilicense tax for the operation of penny arcades and other places of amusement and repealing certain ordinances or parts of ordinances of j the City of Salina. 1 BE IT ORDAIPED.by the Board of Commissioners of the City cf Salina, Kansas: Section 1. That it shall be unlawful for any person, firm or corporation i to operate or maintain in the City of Salina, any place of amusement commonly known as a 'penny arcade's or any Mace in which there is kept, operated or i maintained amusement devices, including machines which exhibit or display pictures, and came machines or devices, operated by the insertion of a penny P or other coin, without first filing with the City Clerk an application for license on a form to be furnished by the City Clerk, and securing from the iCity Clerk a license for the operation of the same and paying the license i fee provided for herein; Provided that no such place shall be operated or maintained u;less a permit for the same shall be secured fro::, the Board of Public Welfare. Section 2. The license fee for the operation of any place of amusement described in Section 1 of this ordinance shall be 4100.00 which shall be for the period from the date such license is issued until December 31 next ensuing, i provided, that for the remaining portion of the current year 1942, after the i 1 passage of this ordinance, the license tax shall. be 20 percent of the amount i herein specified. 3 Section 3, No gambling device or any machine or device commonly used or which is desicned or susceptible for use as a gamblin` device or for the operation of a game of chance shall be permitted, maintained or operated i in any such place, and no machine or device shall be operated, maintained I or kept in any such place with exhibits or by means of which are exhibited { i any lewd, indecent or immoral pictures, and the exhibition of any such pictures in any such machine or device or otherwise in any .such place, or any other violation of the terms of this ordinance, shall, :in addition to any other penalty provided for herein, be r;rounds for the revocation of such i license at the discretion of the Board of Commissioners, and any such license shall be revoked by said Board if the Board of Public Vvelfare shall revoke s or cancel any permit issued by it covering such place of business, and any - such rermit may be revoked or cancelled by the Board of Pi bl.ic Welfare at i any time for reasons which it deems sufficient, rrith or without notice. i Section 4. Any person, firm or corporation, or any agent, employe or } other representative thereof -.,,:ho shall violate or permit or direct the viola- tion of any provision of this ordinance,shall be guilty of a misdemeanor and t i upon conviction thereof shall be fined not less than 415.00 and not more than a 4100.00 or be prisoned not more than ten days, or shall be punished by both such fine and inTrisonment, and each day mn which any such violation shall i exist or continue shall be deemed to be a separate offense. Section 5. That sub-secti-n 28 of Section 2 of Ordinance No. 1688, being Section 14-135 Revised Ordinances 1939, and any other ordinances or parts thereof specifically in conflict with the provisions of this ordinance be and the same are hereby repealed. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it shall be unlawful for any person, firm or corporation to operate or maintain in the City of Salina, any place of amusement commonly known as a "penny arcade" or any place in which there is kept, operated or maintained amusement devices, including machines which exhibit or display pictures, and game machines or devices, operated by the insertion of a penny or other coin, without first filing vrith the City Clerk an application for license on a form to be furnished by the City Clerk, and securing from the City Clerk a license for the operation of the same and paying the license fee provided for herein; Provided that no such place shall be operated or maintained unless a permit for the same shall be secured from the Board of Public Welfare. Section 2. The license fee for the operation of any place of amusement described in Section 1 of this ordinance shall be $100.00 which shall be for the period from the date such licdnse is issued until December 31 next ensuing, provided, that for the remaining portion of the current year 1942, after the passage of this ordinance, the license tax shall be 20 percent of the amount herein specified. Section 3. No gambling device or any machine or device co:rmonly used or which is designed or susceptible for use as a gambling device or for the operation of a game of chance shall be permitted, maintained or operated in any such place, and no machine or device shall be operated, maintained or kept in any such place with exhibits or by means of which are exhibited any lewd, indecent or immoral pictures, and the exhibition of any such _,pictures in any such :machine or device or otherwise in any such place, or any other violation of the terms of this ordinance, shall, in addition to any other penalty provided for herein, be grounds for the revocation of such license at the discretion of the Board of Commissioners, P, and any such license shall be revoked by said Board if the Board of Public Welfare shall revoke or cancel any permit issued by it covering such place of business, and any such permit may be revoked or cancelled by the Board of Public Welfare at any time for reasons which it deems sufficient, with or without notice. Section 4. Any person, firm or corporation, or any agent, employe or other representative thereof who shall violate or permit or direct the violation of any provision of this ordinance, shall be guilty of a misdemeanor and upon conviction thereof shall be fined not less than 415.00 and not more than $100.00 or be prisoned not more than ten days, or shall be pdnished by both such fine and imprisonment, and each day on which any such violation shall exist or continue shall be deemed to be a separate offense. Section 5. That sub -section 28 of Section 2 of Ordinance No. 1688, being Section 14-135 Revised Ordinances 1939, and any other ordinances or parts thereof specifically in conflict with the provisions of this ordinance be and the same are hereby repealed.
