5018 Street Improvement Ash StreetORDINANCE NO. 5018 (Published in the Salina Journal (� �,n� 1942) f AN ORDINANCE providing for the repair and reconstruction of a certain portion of a certain sewer in Ash Street in the City of Salina and providing for the payment of the cost of such improvement by the city at large and for the issuance of general improvement bonds of said city to pay such cost. AHEREAS, a certain portion of the main sanitary sewer and appurtenances there- to in Ash Street in the City of Salina lying between Columbia Avenue and Kansas Avenue, for a distance of approximately fifty feet, is in need of repair and I reconstruction by reason of damage caused by flood waters; and INFHEREAS, in the judgment of the governing body of the City of Salina such portion of said sewer and appurtenances thereto should be repaired and recon- structed in the manner provided by law; and WHEREAS, said sewer serves a substantial portion of said city and in the judg- i ment of the governing body of said city the cost of repairing and reconstructing the same should be borne by the city at large; and WHEREAS, the general fund of said city is insufficient to pay such cost and such governing body deems it necessary to issue general improvement bonds of said city in the manner provided by law to pay such cost; NOVV THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby adopted as a part of this ordinance and that a certain portion of the sanitary sewer in Ash Street in the City of Salina lying between Columbia Avenue and Kansas Avenue, approximately fifty feet in length, and the necessary appurtenances thereto, be repaired and reconstructed to such extent as will be necessary ithin the limits herein mentioned. I Section 2. That on or before the 10th day of August, 1942 the City Engineer shall prepare and file with the City Clerk plans and specifications for the repair and reconstructing of the portion of said sewer and appurten- ances described in Section 1 hereof, together with a detailed estimate of the cost thereof, under oath, and thereafter the City Clerk shall advertise in the official city paper for three consecutive days for sealed proposals for the construction of such work according to the plans and specifications of the City Engineer. Upon receipt of such proposals the governing body shall bt a contfact for such work and improvements to the lowest resi;onsible bidder there- fore, if there be any whose bid does not exceed the estimate of the City Engineer, but the city shall reserve the right to reject any or all bids and if no bid shall be received within such estimate the governing body shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 3. That for the purpose of paying the cost of said work and im- provements, general improvement bonds in an amount not to exceed the contract price for such work or the cost thereof if done by the city, shall be issued and sold in the manner provided by law and for the purpose of paying such bonds and interest as the same becot:e due and payable, the Board of Commissioners shall levy a general tax upon all taxable property in the City of Salina in the time and manner provided by law. Section 4. That the foregoing preambles be and they are heretyy adopted as a part of this ordinance and that a certain portion of the sanitary sewer in Ash Street in the City of Salina lying between Columbia Avenue and Kansas Avenue, approximately fifty feet in length, and the necessary appurtenances thereto, be repaired and reconstructed to such extent as will be necessary within the limits herein mentioned.. Sedtion 2. That on or before the 10th day of August , 1942 the City Engineer shall prepare and file with the City Cleric plans and specifica- tions for the repair and reconstructing of the portion of said sewer end appur- tenances described in Section 1 hereof, together with a detailed estimate of the cost thereof, under oath, and thereafter the City Clerk shall advertise in the official city paper,for three consecutive days for sealed proposals for the construction of such work according to the plans and specifications of the City Ln-ineer. Upon receipt of such proposals the governing body shall let a con- tract for such work and improvements to the lowest responsible bidder therefore, if there be any whose bid does not exceed the estimate of the City engineer, but the city shall reserve the right to reject any or all bids and if no bid shall be received within such estimate the governing body shall have the nower to do such work and make such improvements within the estimated cost thereof as pro- vided by law. Section 3.
