The Board of Comn,_issioners deem it necessar,r for the preservation of rood order in the City of Salina and to prevent injury to or the destruction of or interference v;ith public and private property and to prevent introduction and spread of contagious diseases into said city and for the protection of the safety and morals i ! and general welfare of said city, to adopt and enact the provisions hereinafter set forth in this ordinance and the regulation set forth and contained herein. Section 2. Definitions: hhenever used in this ordinance, unless a different meaning appears from the context: (a) An "Automobile 'frailer", "Trailer Coach", or "Trailer" mans any vehicle or structure so designed and constructed in such manner as will permit occupancy thereof as sleeping quarters for one or gore .persons, or the conduct of any busi- ness or profession, occupation or trade, (or use as selling; or advertising device), and so designed that it is or may be mounted on wheels and used as a conveyance on I hiThti,•ays or city streets, propeeled or drawn by its own or other _votive powers, ex- ceptinm a device used exclusively upon a stationary rails or tracks, and whether or I _ i not wheels ,re attached thereto or detached or removed therefrom. (b) A "`frailer Camp" means any park, trailer park, trailer court, court, camp, i i site, lot, parcel, or tract of land designed, maintained or intended for the purpose i of sup-)lyinm a location or accommodations for one or ,..ore trailer coaches and upon which one or more trailer coaches are parked and shall include all building s used or intended for use as part of the equipment thereof whether a charge is made for the use of the trailer camp and its facilities or not. "Trailer Camp" shall not include automobile or trailer sales lots on which unoccupied trailers are parked for purposes of inspection and sale. i i (c) A "unit" means a section of ground in a trailer camp of not less than 700 square feet of unoccupied space in an area designated as the location_ for only i one automobile and one trailer. i t (d) the word "person" shall be construed to include persons, partnership, firm, i company, corporation, tenant, olvner, lessee, or licensee, their agents, heirs, or i assigns. i (e) Por the nurnose of this ordinance the term "Health Officer" shall be j deemed to refer to the County health Officer of Saline County, Kansas, who shall be, ex -officio, for the purpose of this ordinance, the Health Director of the City of Salina. i I I j Section 3. A Board of Investi ators consisting of the Health Director, Chief of I the Fire Department, the Chief of Police and Building Inspector is hereby created, with the Health Director as Chairman. The Chairman shall, with the approval of the members of said Board, a�!point a secretary for the Board from among the present employees of the city. It is hereby made the duty of.' Laid Board and of the police department of the City of Salina to enforce all provisions of this ordinance as -orescribed herein or such provisions as may ifiereafter be enacted, and for the nurpose of securing such enforcement, any of the above members of the Board, or their duly authorized repre- sentagives, or any police officer of the City of Salina shall have the rip•ht and are hereby empowered to enter upon any premises on w_:ich any automobile trailers are about to be located, and inspect the same and all ac=-rii.odations connected therewith at any reasonable ti:iie, and to make and enforce all orders for co,.pliance with this ordinance. The Board is further empowered to issue orders granting, renewing, and revoling such permits and licenses as are provided for in accordance with the pro- visions of this ordinance. Section 4. Location Outside Camps:_ (a) It shall be unlawful, within the limits of the City of Salina for any person to park any trailer on any street, alley, or himhivay, or other ublic place, or on any tract of land owned by any person. occupied I or unoccupied, within the City of Salina, except as provided in this ordinance. (b) rmer`ency or temporary stopping or parking is permitted on any street, alley, or hirimay, for not longer than one hour subject to any other and further prohibitions, remulations, or limitations imposed by the traffic and parking regulations or ordinances or other ordinances of said city. (c) iuo person shall park or occupy any trailer on the premises of any occupied dwelling or on any lot which is a part of the premises of an occupied dwelling or on any vacant lot or tract in the City of Salina, any of which are located outside of a duly authorized trailer camp except, the parking of only one trailer in any accessory Private a-arage building in any district outside of the fire limits of the City of Salina, is qcn-pitted provided such trailer is not used for living quarters, provided, however, that the owner and occupant of any house in the City of Salina, havin7 a, -)proved sewer and ti,ater connections, :pay .;ark a trailer owned by him, on :;is own premises adjacent to and in the rear yard of such house, for occupancy by himself and the 1erbers of his imrsediate family but for no other persons. Section 5. License for Trailer Car,rps; Application therefor and Issuance thereof: (a) It shall be unlawful for any person to establish, operate or maintain, or permit to be est�1lished, operated or .maintained upon any property owned or controlled by him, a trailer camp within the limits of the City of Salina, without havilir, first 11 secured a license therefor and for each of them, from the City Clerk, after approval of the same by the Board of Investir-ators, in compliance with the terms of this ordinance. 11 i 1 Such license shall expire on December 31st following the date of issuance but may be renewed under the provisions of tnis ordinance for additional periods of one yrear. L (b) The application for such license or tae renewal thereof shall be filed with the City Clerk and shall be acco::panied b;;r a fee of X2.00 for each unit in any existing or proposed trailer ca,:,p. The application for such license or re- newal thereof shall be made on forms furnished by the City Clerk and shall include the name and address of the owner in fee of the tract, (and if the fee is vested in some person other than the applicant, a duly verified state: -.-lent by that person that the applicant is authorized by hLI to construct or maintain the trailer camp, and to wake the application,) and s.:ch a legal description of the premises upon which the trailer camp is or will be located as will readily :identify and definitely locate the premises. The application shall be accompanied by four conies of the ca -:_p plan showin- the following, either existing or as proposed: (1) The extent and areas used for camp purposes; (2) Roadways and driveways; (3) Location of sites or units for trailer coaches; (4) Loc:at-.on and number of sanitary conveniences, including toilets, vrashrooms, laundries and utility rooms to be used by occupants of units; (5) I:ethod and nlan of sewa?e disnosal; (6) I: et% od and nlan of arba.r e removal; (7) Plan 'or crater sup ply; (3) Plan for electrical li,;hting of uhits, 7rounds and buildinfs. (c) Before such license --air be issued, there must be a favorable recommenda- tion by a r_ajority of the Planning- Coruaission of the City of Sal_na, approving the ca:,ip plan and location, and the oremises :gust be inspected and a, -);)roved by the Board of Investiffators as ca::plying; with the provisions of taxis ordinance. Section 6. Zoning of Trailer Carps: (a) The location cf trailer caps :herein provided for shall be limited to such districts or areas within the City of Salina as may be pro -Tided under the zoning ordinances, and shall in no event be located in either the "A" or "B" residence use districts as provided for in said zoning ordinance. (b) No trailer camp shall be located within the limits of the City of Sal',na, unless city water and seder connections and ,.'ire orotection facilities are available, a::d electric current for li­ht'_n- is orovided for. Section 7. Camp Plan: (a) Every trailer camp shall be located on a well - drained area, and the nrernises shall be properlyf,.raded so as to "recent the accumulation of storm or other ti:aters. (b) bnits shall be clearly desi,-.nated and tie ca.,,o so arran"ed that all units shall face or abut on a driveway of not less than t,.,:enty feet in width, F;ivi.n - easy access fron all units to a pui)lic street. Such driveway scall be r.aintained in condition, ha -,Ting natural drainage into a city street catch basin, be well lighted at nig-ht and free from all obstructions. (c) The carp shall be so laid out that no unit shall be located farther than 100 feet from tine toilets and service bu' ldi.nt.s pro ,-ided for herein and i-.alIc;,,a.ys to such buildins shall ue naved or gravelled and ;_ept ;,roll li ;hted at ni,,ht. (d) Ever-" trailer unit shall be furnished -rith an electric service outlet. i Such outlet shall be ecj.:.ic.ped with an externally o:erated si%itch of not lest; than 30 Amperes capacity, and a heavy duty receptacle. (b) No common drinking; vessels shall be permitted, nor shall any drinking nater faucets be placed in any toilet room or ,^rater closet compartcent. (c) An abundant supply of hot water shall be provided at all tines for bathing, vrashinr, and laundry facilities. Section 9. Service Building and Accoruroelations: (a) Every trailer camp shall have erected thereon, at a distance not Treater than 150 feet from any unit it is desi-ned to serve, a suitable buildinrr for 'cousin,• toilets, shovers and laundry facilities as required by this ordinance, suci buildinT to be rnoti�m as the service Building. (b) There shall be provided separate toilet rooms for each sex. Flush toilets provided with an adeluate vrater supply shall be enclosed in separate con:partr.ents having a zni.ni.uura width of three feet and shall be provided for each sex in the ratio of one toilet for each eicht units or fraction thereof'. Every ,,,ale toilet room. shall have one urinal for each sixteen units, but in no case shall any male toilet be vrith- out one urinal. Toilet roorr:s shall contain lavatories with hot ar<d cold vrater in the ratio of one lavatory to e-rery two or less closets. (c) Ser;arate bathinE facilities for each sex shall be )rovi_ded t,ith one shov.1er encl6sed in a cor.nartment at least four feet square, for each ei~at units or fraction tihereof. Each sliovrer co,:�-)art�:.ent; shall be supplemented by an individual dressing co,;.,)artrnent of at least twelve square feet. (d.) Laundry facilities shall be provided in the r atio of one double tray and one ironing board f.'or each ten trailer units. (e) The above acco:ru�odations shall be based on the total cutup capacity accord- ing to accepted plans. (f) r'loors of toilets, shoe^rers, and the laundry shall be of concrete, tile, or similar material impervious to :eater and easily cleaned and pitched to a floor drain, 1,hich shall be connected to the city sever system. 1 1 1 Section 10. Section 11. Limitation: (a) Ido trailer may be inhabited or occupied by a mreater number of persons than that for-Friich it was designed and will reasonably accomr-lodate, or by a ^-renter number of persons than shall be a. -)proved by the :'-'oard of Investigators. Section 12. r:anagement: (a) The owner or authorized representative of a trailer ca::m, shall :r,aname the ca: -.n and be responsible for the enforcez.zent of all of the provisions of this ordinance and any ariendnents thereto. (4) Report to the Director of Health all cases of persons or animals affected or suspected of being affected with any comriuni cable, contagious or in- fectious disease. (5) Prevent the running loose of dogs, cats, or other animals or nets. (6) 1:.aintain in convenient places, a -)proved bJr the r'ire Department, :rand fire extinguishers of a size and t_,rpe approved by the Chief of the Fire Department. j i I (7) Prohibit the lighting, of open fires on the premises. i g (8) Prohibit the use of any trailer by a Sreater number of occupants than that which it is desi-ned to accorimodate. Section 13. Plumbing, huildin Health and Safety g, y 3equirements: All plLu-1bi.ng in trailer ca;;ps or units shall comply nith the state plurr.bin� code, the rules and re^ulations of the state depart:r.ent of health, and with any or all local ordinances pertaining to plumbing and the disposal of sewage and other water carried wastes. (b) Service buildinCs should be well constructed, havinE good, natural and artificial li�.hting, adequate ventilation, and floors of concrete or siirilar imper- vious material. Concrete curbings extending at least 6" above the floor shall be i provided, and the floor sloped to adequate drains. The interior iAralls and ceilings 4 of such builCinrs shall be of smooth material painted :with a lif~ht colored paint. (c) Separate toilet facilities shall L.e ,narked by appropriate signs and all toilet and service buildings shall be kept well li hted between one hour after sun- set and orze :our before sunrise. (d) All floors in shower and toilet rooms shall be disinfected daily by the use of chlorine cor.ipounds or other: :r.aterials in strengths approved by the state department of health, or by the health Director. hooden or cloth mats, -rids, boards or ln.,alkT.,ays are prohibited.. (e) 'i'�ater fror,r sinks and refri gerators must not be discharged on the surface of the -round. (f) All camping areas shall be kept free of litter, rubuish, and inflairZuable material at all times. Portable fire extinguishers shall be available and in good repair for use in fighting fires. (?) Fires shall be made only a stoves, incinerators or other equip-ent intended for that nurnose. (h) In addition to the requirements set forth in those remulations, all house trailer camps and facilities shall be established and constructed and maintained in co.pliance with all existing state and local statutes, ordinances, codes, and reg;ulet:ions. Section 14. Nuisances and Abatement: Any trailer cairp which is estaLlished, constructed, or maintained in the Cit�,r of Salina or within three riles of the corporate limits of t_lle City of Salina otherwise than in accordance with the requirer,,ents and provisions of this ordinance shall be deemed to be and to constitute a nuisance and in addition to any other penalties provided for in this ordinance, any such nuisance i shall be abated and removed in the manner provided by law for the abaterrent and re- moval of nuisances; provided however, in the case of trailer camps located outside j I of the corporate li pts of the Citi* of Salina and within three n_iles t'zereof, nro- lI jlll %risions and requirements for the connection of the sai:e with city water and sewer i systems ahall not be enforced if other satisfactory and an_proved met -ods and syster:s of sanitation and water supply are provided to the satisfaction of said Board of Investicators. Section 15. ievocation and Suspension: (a) The Loard of Investigators is 1 I hereby authorized to revoke any license issued pursuant to the terms of this ordin- ance if after due investigation they determine that the holder thereof has violated any of the provisions of this ordinance, or that any trailer or trailer camps, is i beim; maintained in an unsanitary or unsafe manner or constitutes a public nuisance. Section 16. Penalties: Any person found guilty of violating any provisions of this ordinance or of perm'tting, authorizing or directing the violation of the t same or who shall fail to a._ide by any of the requirements or provisions hereof, shall be deemed guilty of a misdemeanor and shall be rn.anished by a fine of not less than ;5.00 nor more than 4100.00 or by imprisonment not to exceed three months, r or by both such fine and imprisonment, and every day such violation exists shall i constitute a separate offense and be punishable hereunder. i Section 17. Unconstitutionality: (a) Should any sect; -on, sub -section, clause or portion of this ordinance be declared unconstitutional or invalid for any reason by a court of competent ,jurisdiction, such section, sub -section, clause 4 or n_ortion of this ordinance shall be deemed a separate and distinct provision and j such holding shall not effect the validity of the remaining portions thereof. � I i (b) None of the provisions of this ordinance shall be interpreted so as to conflict with the laws of the State of Kansas relating to Public Health or the I operation and n.aintenance of trailer camps and tourist camps. i Section 18. The application shall be accompanied by four copies of the camp plan showing the following, either existing or as proposed: r (1) The extent and areas used for camp purposes; (2) I�oadvrays and driveways; (3) Location of sites or units for trailer coaches; (4) Location and number of sanitary conveniences, including toilets, washrooms, laundries and utility rooms to be used by occupants of units; (5) Pvethod and plan of sewage disposal; (6) :,ethod and plan of garbage removal; (7) Plan for water supply; (8) Plan for electrical lighting of units, grounds and buildings. (c) Before such license inay be issued, there must be a favorable recommenda- tion by a majority of the Planning Commission of the City of Salina, a,)proving the camp plan and location, and the premises must be inspected and approved by the Loard of Investigators as cor!plyinp; with the provisions of tliis ordinance. Section 6. Zoning of Trailer Camps: (a) The location of trailer camps herein provided for shall be limited to such districts or areas within the City of Salina as may be provided under the zoning ordinances, and shall in no event be located in either the "A't or "B" residence use districts as ;provided for in said zoning ordinance. (b) =10 trailer camp shall be located within the lij:.its of the City of Salina, unless city water and sevrer connectiots and fire protection facilities are available, and elextric current for lighting is provided for. Section 7. Camp Plan: (a) Every trailer camp shall be located on a well - drained area, and the premises shall be properly graded so as to prevent the accumulation of storm or other waters. (b) Units shall be clearly designated and the camp so arranged that all units shall face or abut on a driveway of not less than twenty feet in width, giving easy access from all units to a public street. Such driveway shall be maintained in good condition, h.avinc; natural drainage into a city street catch basin, be vrell lighted at night and free frori all obstructions. (c) The camp shall be so laid out that no unit shall be located farther than 100 feet from the toilets and service buildings provided for herein and walkways to such buildings shall be paved or gravelled and kept well lighted at night. (d) Every trailer unit shall be furnished with an electric service outlet. Such outlet shall be equipped with an externally operated switch of not less than 30 Amperes capacity, and a heavy duty receptacle. Section 8. iter Supply: (a) An, adequate supply of ->ure .nater, furnished through a pipe distribution system connected directly with the city water main, with suppler faucets so located that there v1ill be at least one water faucet for each tyro units, for drinking; and domestic :,urposes, and in no case shall any trailer be :::ore than 150 feet from a faucet. (b) 1uo common drinking vessbls shall be permitted, nor shall any drinking water faucets be placed in any toilet room or water closet compartment. 11 (c) An abundant supply of hot v.ater shall be provided at all times for bathing, washing, and laundry facilities. Section 9. Service Building and Accom;..odations: (a) Every trailer camp shall have erected thereon, at a distance not -reater than 150 feet from any unit it is designed to serve, a suitable building for :housing toilets, showers and laundry facilities as required by this ordinance, such building to be known as the Service Building. (b) There shall be provided separate toilet rooms for each sex. Flush toilets provided vrith an adequate water supply shall be enclosed in separate co:apartments having a minimum vd dth of three feet and shall be provided for each sea; in the ratio of one toilet for each eight units or fraction thereof. Every reale toilet room shall have one urinal for each sixteen units, but in no case shall any male toilet be with- out one urinal. Toilet rooms shall contain lavatories urith act and cold -..,rater in the ratio of one lavatory to every two or less closets. (c) Separate bathing facilities for each sex shall be provided with one shower enclosed in a coripartment at least four feet square, for each eight units or fraction thereof. Each shower compartr.,ent shall be supplemented by an individual dressing compartment of at least twelve square feet. (d) Laundry facilities shall be provided in the ratio of one double tray and one ironing board for each ten trailer units. (e) The above accormodations shall be based on the total camp capacity accord- ing to accepted plans. (f) Floors of toilets, showers, and the laundry s''nall be of concrete, tile, or similar material impervious to water and easily cleaned and pitched to a floor drain, which shall be connected to the city sewer system. Section 10. Waste and Garbage Disposal: (a) All waste from snowers, toilets, laundries, faucets and lavatories shall be wasted into a sewer syttem extended from and connected with the city sewer system. (b) All sanitary facilities in any trailer which are not connected with the city sewer system by means of rigid pipe connections shall be sealed and their use is hereby declared unlawful. (c) Each faucet site shall be equipped with facilities for drainage of v+.�aste and excess water into the sewer. In no case shall any waste water be thrown, or discharged upon the surface of the ground. (d) Every unit shall be provided with a substantial fly tight metal garbage depository or can from which the contents shall be removed and disposed of, off the premises, each day in a manner approved by the H ealth Director. Section 11. Limitation: (a) No trailer may be inhabited or occupied by a greater number of persons than that for which it was debt gned and will reasonably accommodate, or by a greater number of persons than shall be approved by the Board of Investigators. Section 12. la.nagement: (a) The ovmer or autiorized representative of a trailer camp shall manage the camp and be responsible for the enforcement of all of the provisions of this ordinance and any amendments thereto. A co,)y of the camp license and of this ordinance shall be kept posted in the cam. -p office. (b) It is hereby made the duty of the attendant or rerson in charge, together v^ th the licensee to: (1) Keep at all times a register of all guests and occupants which shall be be open at all ti.:.es to inspection by State and Federal and County officers and officers of the City of Salina showing for all guests: (a) 'dames and addresses, ages, sex and relationaship of all occupants. (b) Place or places of employment of each occupant. (c) Dates of entrance and departure. (d) License numbers of all trailers and towing or other auto::iobiles. (e) States issuing such licenses. (f) Place of last location, and length of stay. Such registration shall be made in a book or on cams provided by the City for such purpose, shall be in duplicate, and shall be signed by the person so registering or the person in charge of the party covered by such registration, and witnessed by the camp licensee or his agent, and a copy shall be mailed to the police department of the city within 24 hours of the date of registration. (2) Idaintain the camp in a clean, orderly and sanitary condition, at all ti --es. (3) See that the provisions of this ordinance are cor)plied with and enforced and report promptly to the proper authorities any violations of this ordin- ance or any other violations of law which may coxae to his attention. (4) Report to the Director of Health all cases of persons or animals affected or suspected of being affected with any communicable, contagious or in- fectious disease. (5) Prevent the running loose of dogs, cats, or other animals or pets. (6) �:aintain in convenient places, approved by the fire Departa;-ent, hand fire extinguishers of a size and type approved by the Chief of the Fire Department. (7) Prohibit the lighting of open fires on the premises. (8) Prohibit the use of any trailer by a greater number of occupants than that which it is designed to accommodate. Section 13. Plumbing, Building, Health and Safety Requirements: All plumbing in trailer camps or units shall comm ly with the state plumbing, code, the rules and regulations of the state department of health, and with any or all local ordinances pertaining to plumbing and the disposal of sewa_-_e and other water carried wastes. (b) Service buildings should be well constructed, having; ;food, natural and artificial lighting, adequate ventilation, and floors of concrete or similar imper- vious material. Concrete curbings extending at least 6" above the floor shall be provided, and the floor sloped to adequate drains. The interior walls and ceilings of such buildings shall be of smooth material painted with a light colored paint. (c) Separate toilet facilities shall be marked by appropriate signs and all toilet and service buildings shall be kept well lighted between one 'rtour after sun" set and one pour before sunrise. (d) All floors in shol-Ter and toilet rooms shall be disinfected daily by the use of chlorine compounds or other materials in strengths approved by the state department of health, or by the Health Director. Isooden or cloth i; -tats, grids, boards or T.alkwa.ys are prohibited. (e) 'seater from sinks and refrigerators must not be discharged on the surface of the ~round. (f) All camping areas shall be kept free of litter, rubbish, and inflammable material at all times. Portable fire extinguishers shall be available and in good repair for use in fighting fires. (g) sires shall be made only in stoves, incinerators or other equip:ent in- tended for that-)urpose. (h) In addition to the requirements set forth in those regulaticns, all house trailer caanj>s and facilities shall be established and constructed and -ma _ntained in co:_pliance with all existing state and local statutes, ordinances, codes, and regulations. Section 14. Nuisances and Abatement: Any trailer camp i%rhich is established, constructed, or maintained in the City of Bali a or within three _piles of the corporate limits of the City of Salina otherwise than in accordance :°rith the requirements and provisions of this ordinance shall be deemed to be and to constitute a nuisance and in a dditio:,i to any other penalties )rovided for in this ordinance, any such nuisance shall be abated and removed in the manner -provided by law for the abatement and re- moval of nuisances; provided however, in the case of trailer camps located outside of the corporate limits of the City of Salina and within three iailes thereof, pro- visions and requirements for the connection of the same with city v,,uter and sewer systems shall not be enforced if other satisfactory and approved met'.nods and systems of sanitation and ,-rater supply are provided to the satisfaction of said Board of Investiators. Section 15.:. Revocation and Suspension: (a) The Board of Investizators is hereby aut!,.orized to revoke any license issued pursuant to the terms of this ordinance if after due investic-ation they determine that the holder thereof has violated any of the provisions of this ordinance, or th..t any trailer or trailer camp, is being maintained in an unsanitary or unsafe manner or constitutes a public nuisance. Section 16. Penalties: Any person found guilty of violatin`; any provisions of this ordinance or of permitting, aut:iorizing or directing the violation of the sauce or wio shall fail to abide by any of the requirements or )rovisions hereof, shall be deemed guilty of a misdemeanor and shall be punished by a fine of not less than Y?5.00 nor .:Lore than X100.00 or by imprisonment not to e xceed three months, or by both such fine and imprisonment, and every day such violation exists shall constitute a separate offense and be 2unishable hereunder. Section 17. Unconstitutionality: (a) Should any section, sub -section, clause or ^ortion of this ordinance be declared unconstitutional or invalid for any reason by a court of competent jurisdiction, such section, sub -section, clause or ;;ortion of this ordinance shall be deemed a separate and distinct provision and such holding shall not effect the validity of the retaining por- tions thereof. (b) None of the ;provisions of this ordinance shall be interpreted so as to conflict with the laws of the State of Kansas relating to Public health or the operation and Yvaintenanee of trailer ca. s and tourist camps. Section 13. This ordinance shall tare eff.ct and be in full force from and after its passage and ,publication in the official city ,;aper.
