5010 Issue GO Bonds Series P-1281 ORDI ,!'ANCE NO. 5010 6ublished in the Salina Journal (v 1942 AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of •j6315.09 to pay the cost of improving certain streets and alleys in said city to be designated as Series P-128. i j WHEREAS, pursuant to proceedings duly had according to law certain streets and alley improvements have been constructed by the City of Salina under the direc- tion of its City Engineer according to law within the estimated cost thereof after the advertisement for and rejection of bids, no bids having been received for the construction of such improvements within the Engineer's estiiate'and said im- provements have been constructed and the work thereof done under ay. P. A. Project j No. 8254-4, to -wit: Curbing, guttering and grading of h1ontrose Street from Charles Street to Crawford avenue; Second Street from Ash Street to Elm Street; Republic Avenue from Sheridan Street and Funston Street to Sherman Street and Pershing Street; Venango Street from Sherman Street to Custer Street; Wilson Street from Sherman Street to Eleventh Street; Republic Avenue (north side) from Tenth Street to Eleventh Street; Eighth Street from Harsh Street to Hamilton Street; Tenth Street from 'Id4ilson Street north 300 feet to connect I on existing curb and gutter; EJ-hth Street from Grand Avenue to Woodland Avenue; a portion of Funston Street between Republic Avenue and Sunset Drive; a portion of Highland Circle between Ellsworth and Jewell Avenue; a portion of Pershing Avenue between h:epublic Avenue and Beloit Avenue; a portion of Second Street lyii_.g north of Iron Avenue; paving of the alley lying between Santa r'e Avenue and Seventh Street from Ash Street to Iron Avenue and from. Iron Avenue to V"alnut Street, all as provided for by Resolutions numbered 786, 788, 739, 793, 794, 795, 803, 804, 806, 807, 808, 80S, 310, 791 and 805, respectively, and by Ordinances numbered 4996 and 4998; and VFEREAS, the total cost of said improvements has beer_ ascertained and the total portion thereof to be paid by a general tax to be levied upon all taxable property within said city for the improvement of the squares and areas formed by the cross- ing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city or of the State of Kansas and to be paid for by the city at large as provided by law, for which the city is liable and for which bonds will be issued as hereinafter provided for has been ascertained and is hereby determined to be the sum of $1165.18 and it is hereby found and de- termined that the repair and general improvement funds are insufficient to meet the cost and expense of such portion of any of said improvements as mi;ht other- wise be paid therefrom; and VMEREAS, that portion of the cost of said improvements to be paid by special assessments levied upon the lots and pieces of ground liable for the payment of said improvements has been ascertained and is hereby found and determined to be the sum of 47789.64 which said last amount has heretofore been duly assessed and apportioned to the several lots and pieces of ground liable there- for, payable in installments according to law and as provided in the ordinance of said city relating thereto duly passed and approved, of which amount the sum of 42639.73 has been paid to the city by the owners of property liable therefore, leaving a balance of said sum for which bonds shall be issued in the sum of qp5149.91; and ,.UE'3EAS, the total cost of said improvements for which bonds will be issued ex- clusive of the amounts heretofore paid in cash by the property owners has been and is now hereby determined to be the sum of $6315.09; BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby adopted as a part of this ordinance and that for the purpose of providing funds to pay the cost of the improvements herein above referred to and described in the ordinances and resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $6315.09, which shall consist of 10 bonds numbered from one to 10 inclusive, all dated February 1, 1942, which shall bear interest at the rate of one per cent per annum from and after said date until the respective maturities of said bonds, payable semi-annually, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due serially in denominations as follows: J No. 1 for $465.09, due February 1, 1943, and Nos. 2 to 10 inclusive for 4650.00 each, due i I I respectively, one each year from r'ebruary 1, I' 1943 to February 1,1952, inclusive. J Section 2 Said bonds shall be sighed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed fac-simile signatures of the Payor and City Clerk of said city and said bonds and interest coupons shall be registe,ed in the office of the City Clerk and in the office of the Auditor of State as required by law. Section 3. Said bonds shall be designated as Series P-128 and shall be in form and shall contain recitals required by law, and shall be substantially in I r the form, so far as applicable, as set forth in Section 3 of Ordinance No. 4994, to which reference is hereby made. J Section 4. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and when duly executed and registered to deliver said bonds to the purchaser or Purchasers thereof. i Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be, and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Comt;:issioners of the City of Salina, Kansas, shall annually make provision of the payrent of the principal and interest on said bonds as the same become due by levying taxes J and assessments upon the property liable therefor as provided by law. i Section 6. Said bonds shall be designated as Series P-128 and shall be in form and shall contain recitals required by law, and shall be sub- stantially in the form, so far as applicable, as set forth in Section 3 of Ordinance No. 4994, to which reference is hereby made. r Section 4.
