5006 Levy Assessments1 1 1 ORDINANCE N0, 5006 Published in the Salina Journal h,�o o _ i i 1,� 'L'-\ AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing and guttering Eighth Street from the center line of Harsh Street to the center line of Hamilton Street; Eighth Street from the center line of A�oodland Avenue to the center line of Grand Avenue; west side of Funston Street south of Republic Avenue; west side of Highland Circle south of llswvrth Avenue; !�ontrose Avenue from the south line of Charles Street to the north line of Crawford venue; west side of Pershing Street south of Republic Avenue; north side of Republic Avenue from the west line of Tenth Street to the east line of Eleventh Street; Republic Avenue from Sheridan Street and Funston Street to Sherman Street and Pershing Street; Second Street from the north line of Ash Street to the south line of Elm treet; west side of Second Street north of Iron Avenue; Tenth Street from the center line of Filson Street, north 300 feet to connect with existing curb and gutter; Venan;o Street from the west line of ''herman Street to the east line of Custer Street; Pvilson Street from the east line of )herman Street to the west line of Eleventh Street; and for the paving of the alley lying between Santa Fe Avenue and Seventh Street from the north line of V,,alnut Street to the south line of Iron Avenue; and the alley lying bet-reer. Santa Fe Avenue and Seventh Street frog the south line of Ash Street to thenorth line of Iron Avenue, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: i Section 1. That for the purpose of paying for that part of the cost of I improvements of certain portions of certain streets as hereinafter set forth in the following sections of this ordinance which is chargeable to the private property i I in the assessment districts for each of such improvements, respectively, as set forth in the following sections of this ordinance with respect to each of such improvements, there are hereby levied and assessed on the property liable therefor, being all of i the lots and pieces of ground lying on either side of said streets so improved, respectively, to the middle of the block for the distance improved, with respect i to the improvements mentioned in Sections 2, 3, 4, 59 6, 7, II, 9, 10, 11, 12, 13 and 14 of this ordinance, and being all of the lots and pieces of sound abutting upon the alleys, with respect to the improvements mentioned in Sections 15 and 16 of this i ordinance, according to the appraised value of such lots and pieces of ground with respect to each such improvement, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements said special assessments being based on the special valuation and appraisement of said lots and pieces of ground heretofore glade by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to each such improvement, w.ich said appraisements are hereby referred to and made parts of this ordinance, and the several amounts levied, apportioned and assessed against the lots and Nieces of ground for each of such improvements, respectively, for the purposes aforesaid are hereby found and determined to be the amounts set forth in the follow- ing sections of this ordinance with respect to each of such improvements. Section 2. Said amouint,levied, apportioned and assessed aforesaid shall be due and collectible in ten eoual installments the first becoming due with the taxes levied for the year 1942 and one of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance provided; PROVIDED HOWEVER, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by paying into the City Treasury the entire amount chargeable against the same, as in this ordinance designated, at any time within thirty days after the publication of this ordinance and before the issuance of the bonds of said City in payment of the balance of the cost of said improvements, and the property so paid on shall not there- after be liable for any further assessments for the cost of said improvements nor for any part of said bonds. There is hereby further levied and assessed aua.inst each lot and piece of *round described in this ordinance interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to be determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the dsl.te of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof, as by law provided, to the time of the collection of the last installment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certi- fied and until all of said assessments so apportioned and levied herein have been certified, to certify to the County Clerk of Saline County, Kan- sas, a full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments Rforesaid have been paid in full as hereinbefore provided, together with the respective amour4s due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts so certified as herein provided for shall be placed upon the tax roll by the County Clerk of Saline County, Kansas and collected as other taxes are colle cted.
