ORDINANCE NO. 5002
AN ORDINANCE providing for and authorizing the issuance of Improvement
Bonds of the City of Salina, Kansas, in the sum of $27,20,,74
to pay the cost of constructing certain lateral sanitary sewers in the
City of Salina, Kansas, which bonds shall be designated as Series
S-127.
WHEREAS, pursuant to proceedings duly had according to law certain lateral
sanitary sewers have been constructed in the City of Salina,
Kansas in certain lateral sanitary sewer districts as follows:
Numbers 184, 185, 186, 187, 187-A, 188 and 189,
all as authorized by Ordinances No. 4968, 4969
and 4988; and
WHEREAS, the total cost of s aid sewers constructed in the sewer districts
above mentioned and to be paid by special assessments levied
upon lots and pieces of ground liable for the payment of said
sewers in the sewer districts above mentioned has been ascertained
and is hereby found and determined to be the sum of $3,282.25,
which amount has been heretofore duly assessed and apportioned to
the several lots and pieces of ground liable therefor according
to law and as provided for in the ordinances of the City of
Salina relating thereto, of which amount the sum of $561.51 has
been paid by the owners of property liable therefor, leaving a
bklanee for which bonds will be issued in the sum of $2720.74,
VM THEREFORE:
BE IT ORDAINED btu the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the for egoin g preambles are hereby adopted and
made a part of this ordinance and that for the purpose of providing funds
to pay the cost of the improvements hereinbefore described, there shall be
issued and there hereby are issued Internal Improvement Bonds of the City
of Salina, Kansas in the total principal sum of $2720.74, which issue.;shall
consist of ten bonds numbered from one to ten inclusive, all dated
August 1, 1941 which shall bear interest at the rate of 1-1/4 percent
per annum -from and after said date until the respective maturities of said
bonds, payable semi-annually to be evidenced by interest coupons as herein
provided for and s aid bonds shall become due serially in denominations as
follows:
Bond No. 1 for 0245.74 due August 1, 1942
Bond No. 2 for X275.00 due August 1, 1943
Bond No. 3 for $275.00 due August 1, 1944
Bond No. 4 for $275.00 due August 1, 1945
Bond No. 5 for 4275.00 due August 1, 1946
Bond No. 6 for $275.00 due August 1, 1947
Bond No. 7 for $275.00 due August 1, 1948
Bond No. 8 for X275.00 due August 1, 1949
Bond No. 9 for $275.00 due August 1, 1950
Bond No. 10 for j275.00 due August 1, 1951
Section 2. Said bonds shall be signed by the Mayor and. shall
be attested by the signature of the City Clerk and the corporate seal
of the City shall be affixed thereto, and shall have attached thereto
interest coupons representing the interest thereon, which coupons shall
be in the form provided by law and shall bear the printed or lithographed
fac-simile signatures of the Mayor and City Clerk of said city and said
bonds and interest coupons shall be registered in the offices of the City
Clerk and the State Auditor as required by law.
Section 3. Said bonds shall be designated as Series S-"127and
shall be in the form and shall contain recitals substantially as follows,

of x`ansas, including Sections 10-101 to 10-115 and Sections 12-617 to 12-629
and Sections 13-1013 to 13-1018, General Statutes of Kansas 1935, and
such sections as amended, and all other provisions of the laws of said
state applicable thereto, and this bond and all other bonds ::f this
series, and all interest thereon are to be Paid by the City of Salina,
Kansas.
And it is hereby declared and certified that all acts, conditions
and things required to be done and to exist precedent to and in the
issuance of this bond have been properly done and performed and do exist
in due and regular form and manner as required by the constitution and
laws of the State of Kansas, and that the total indebtedness of said city,
including this series of bonds, does not exceed any constitutional or
statutory limitation.
IN ViITNESS WHEREOF, the said City of Salina, Kansas has executed this
bond by causing it to be signed by its Mayor and its corporate :seal to be
hereto affixed, attested by its City Clerk and the coupons hereto attached
to be signed with the fac-simile signatures of said officers, and this bond
to be dated the first day of 19 .

Section 4. The Mayor and City Clerk are hereby authorized
and directed to prepare and execute the bonds hereinbefore described and
to advertise and sell the same in the manner provided by laza, and, when
duly executed and registered to deliver said bonds to the purchaser or
purchasers thereof.
Section 5. The full faith, credit and resources of the City
of Salina, Kansas, shall be, and the same are hereby irrevocably pledged
for the prompt payment of said bonds and all interest thereon. The Board
of Commissioners of the City of Salina, Kansas, shall annually make pro-
vision of the payment of the principal and interest on said bonds as the
same become due by levying taxes and assessments upon the property liable
therefor as provided by law.
Section 6. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
