1111 O_RDIi;A1TCE providing for and authorizing the issuance of Inrrovement -Bonds of
the City of Salina, Kansas,.in the sum of 418,045.52 to pay the cost of
improvin5- certain streets and alleys in said city to be designated as
Series P-126.
r`rBE.:�EAS, pursuant to proceedings duly had according to law certain street and alley
improvements have been constructed by the City of Saliba under the direction of its
City Engineer according to law within the estimated cost thereof after the advertise-
i7lent for and rejection of bids, no bids having been received for the construction of
such improvements within the Engineer's estimate, and said improvements have been
constructed and the work thereof done under '�V. P. A. Projects No. 7787-4 and 7787-5,
to -wit.
Curbing, guttering, and grading of Oakdale Avenue from the north line
of Ash Street to the south line of Elm Street as provided for by
Resolution No. 778 and Ordinance No. 4970.
Curbing, gutterinr, and grading of Tenth Street from the center line
of Pacific Avenue to the center line of I-.arsh Avenue as provided for
by Resolution No. 779 and Ordinance No. 4970.
Curbing, �utterin and grading of Frost Street from the west line of
Eleventh Street to the east line of Sherman Street as urovided for
by Resolution No. 780 and Ordinance No. 4970.
Curbing, guttering and grading of Brown Street from tiie west line of
Eleventh Street to the east line of Sherman Street as provided for
by Resolution "o. 781 and Ordinance No. 4970.
Curbing, guttering and grading of Tenth Street from the: south line
of Franklin Stre...t to a point 300 feet south of the south line of
Franklin Street as provided for by Resolution No. 782 and Ordinance
No. 4970.
Paving of the alley lying bet*reen Santa Fe Avenue and l'ifth Street
from the south line of Ash Street to the north line of Iron Avenue
as provided for by Resolution No. 783 and Ordinance No. 4970.
The paving of the unpaved portion of Broadway Boulevard, being 8-1/2
feet on each side of said street lying between the existing pavement
thereon heretofore constructed by the State Highway Coiiimission and
the existing curb and gutter on each side of said street from the
west line of Ninth Street at the intersection of Ninth and Pacific
Streets to a point 3978- feet southwesterly along the center line
of said street, being a point 248 feet south of the south line of
Forth Street as provided for by Resolution No. 744 and Ordinance
iso. 4967, and
`i -fa REAS, the total cost of said improvements has been ascertained and the total
portion thereof to be paid by a general tax to be levied upon all taxable property
within said city for the improvement of the squares and areas formed by the cross-
ing of streets and alloys and for the improveirent of any of said streets where the
sale is through or adjacent to property of the city or of the State of Kansas and
to be paid for by the city at large as provided by law, for which the city is liable
and for which bonds will be issued as hereinafter provided for has been ascertained
and is h-reby determined to be the surf of 0810.11 and it is hereby found and deter-
mined that the repair and general iaprovemen.t funds are insufficient to meet the
cost and expense of such portion of any of said improvements as might otherwise be
paid therefrom; and
�a=Rr;AS, that portion of the cost of said improvements to be paid by special assess-
laents levied upon the lots and pieces of ground liable for the paynnent of said im-
proveraents has been ascertained and is hereby found and determined to be the sum
of X12,308.25 which said last amount has heretofore been duly assessed and appor-
tioned to the several lots and pieces of ground liable therefor, payable in install-
ments according to law and as provided in the ordinances of said city relating thereto
duly passed and approved, of which amount the sura of 42,072.84 has been paid to the
city by the owners of property liable therefor, leaving a balance of said sum for
which bonds shall be issued in the sum of $10,235.41; and
rHEREAS, the total cost of said improvements for which bonds ti^rill be issued ex-
clusive of the amounts heretofore paid in cash by the property owners has been and
is hereby determined to be the sum of 418,045.52;
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles be and they are hereby adopted as a

part of this ordinance and that for the purpose of providing funds to pay the cost
of the improvements herein above referred to and described in the ordinances and
resolutions hereinbefore referred to, there shall be issued Internal Improvement
Bonds of the City of Salina, Kansas, in the total principal sum of 418,045.52 which
shall consist of 37 bonds numbered from one to 37 inclusive, all dated January 1,
1941, which shall bear interest at the rate of 1-1/4 per cent per annum from and
after paid date until the respective maturities of said bonds, payable semi-annually,
said interest to be evidenced by interest coupons as herein ;provided for and said bonds
shall become due serially in denominations as follows:
No. 1 for X45.52 and Nos. 2, 3 and 4 for $500.00 each, due January 1, 1942
Nos. 5, 6 and 7 for $500.00 each, due January 1, 1943
140s. 8, 9 and 10 for X500.00 each, due January 1, 1944
Nos. 11, 12 and 13 for 4500.00 each, due January 1, 1945
Nos. 14, 15, 16 and 17 for 0500.00 each, due January 1, 1946
Nos. 18, 19, 20 and 21 for $500.00 each, due January 1, 1947
Taos. 22, 23,24 and 25 for $500.00 each, due January 1, 1948
Nos. 26, 27, 28 and 29 for $500.00 each, due January 1, 1949
Nos. 30, 31, 32 and 33 for 000.00 each, due January 1, 1950

Section 2. Said bonds shall be signed by the T.avor and shall be attested by
the signature of the City Clerk and corporate seal of the city shall be affixed there-
to and said bonds shall have attached thereto interest coupons representing the in-
terest thereon, which coupons shall be in the form provided by lave and shall bear the
printed or lithographed fac-simile signature of the lrtiayor and City Clerk of said city
and said bonds and interest coupons shall be registered in the office of the City Clerk
and in the office of the Auditor of State as required by law.
Section 3. Said bonds shall be designated as Series P-126 and shall be in the
form and shall contain recitals substantially as follows, to -wit:

of Saline, State of Kansas, acknowledges itself to be indebted and for value
received hereby pro..ises to pay to the bearer the sum of

in lawful money of the United States of America, on the first day of January
19 , with interest thereon from the date hereof at the rate of one and
one-fourth percent per annum, payable sei.ii-annually on the first days of
January and July in each year, on presentation and surrender of the interest
coupons hereto annexed as said coupons severally beco:::e due, both principal

of the State of Kansas, in the City of Topeka, Kansas. And said City of
Salina, Kansas, is held and firmly bound by these presents and the full faith,
credit and resources of said city are hereby irrevocably pledged for the pay-

This bond is one of a series of 37 bonds of like date and tenor,
ex-cepting denomination and _aaturity, aggregating the principal sum of X18,045.52
issued by the City of Salina, Kahsas, for the purpose of paying the cost of
E constructing certain curbing and guttering and paving improvements in said
city by the authority of and in full compliance with the provisions, restric-
tions and limitations of the constitution and laws of the State of Kansas,
including Sections 10-101 to 10-115, 12-601 to 12-608, and 13-1011 and 1011x,
j General Statutes of Kansas 1935, and such sections as amended, and all other
provisions of the laws of said state applicable thereto, and this bond and
all other bonds of this series, and all interest thereon are to be paid by
the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and
thins required to be done and to exist precedent to and in the issuance of
this bond have been properly done and performed and do exist in due and regular
form and manner as required by the constitut on and laws of the State of Kansas,
and that the total indebtedness of said city, including this series of bonds,
does not exceed any constitutional or statutory limitation.
IN ''VITIZSS ".HEREOF, the said City of Salina, Kansas, has executed this
bond by causing it to be signed by its mayor and its corporate seal to be
hereto affixed, attested by its City Clerk and the coupons hereto attached
to be signed with the fac-simile signatures of said officers, and this bond
to be dated the first day of January, 1941.

Section 4. The Llayor and City Clerk are hereby authorized and directed to

prepare and execute the bonds hereinbefore described and to advertise and sell
the same in the manner provided by law, and vrhen duly executed and re,-istered
to deliver said bonds to the purchaser or purchasers thereof.
Section 5. The full faith, credit and resources of the City of Salina, Kansas,
shall be, and the same are hereby irrevocably pledged for the projlpt paynent of
said bonds and all interest thereon. The Board of Cornr:,issioners of the City of
Salina, Kansas, shall annually make provision of the payment of the principal and
interest on said bonds as the same become due by levying taxes and assessments
upon the property liable therefor as provided by law.
Section 6. This ordinance shall take effect and be in force from and after
its publication in the official city paper.

ORDINANCE NO. 4994
AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds
of the City of Salina, Kansas, in the sum of $18,045.52 to pay the cost
of improving certain streets and alleys in said city to be designated as
Series P-126.
WHEREAS, pursuant to proceedings duly had according to law certain street and
alley improvements have been constructed by the City of Salina under the direc-
tion of its City Engineer according to law within the estimated cost thereof
after the advertisement for and rejection of bids, no bids having been received
for the construction of such improvements within the Engineer's estimate, and
said improvements have been constructed and the work thereof done under W. P. A.
Projects No. 7787-4 and 7787-5, to -wit:
Curbing, guttering and grading of Oakdale Avenue from the north line
of Ash Street to the south line of Elm Street as provided for by
Resolution No. 778 and Ordinance No. 4970.
Curbing, guttering and grading of Tenth Street from the center line
of Pacific Avenue to the center line of Harsh Avenue as provided for
by Resolution No. 779 and Ordinance No. 4970.
Curbing, guttering and grading of Frost Street from the west line of
Eleventh Street to the east line of Sherman Street as provided for
by Resolution No. 780 and Ordinance No. 4970.
Curbing,, guttering and grading of Brown Street from the west line of
Eleventh Street to the east line of Sherman Street as provided for
by Resolution No. 781 and Ordinance No. 4970.
Curbing, guttering and goading of Tenth Street from the south line
of Franklin Street to a point 300 feet south of the south line of
Franklin Street as provided for by Resolution No. 782 and Ordinance
No. 4970.
Paving of the alley lying between Santa Fe Avenue and Fifth Street
from the south line of Ash Street to the north line of Iron Avenue
as provided for by Resolution No. 783 and Ordinance No. 4970.
The paving of the unpaved portion of Broadway Boulevard, being 8-1/2
feet on each side of said street lying between the existing pavement
thereon heretofore constructed by the State Highway Commission and
the existing curb and gutter on each side of said street from the
west line of Ninth Street at the intersection of Ninth and Pacific
Streets to a point 3978' feet southwesterly along the center line
of said street, being a point 248 feet south of the south line of
North Street as provided for by Resolution No. 744 and Ordinance
No. 4967# and
'•MREAS, the total cost of said improvements has been ascertained and the
total portion thereof to be paid by a general tax to be levied upon all
taxable property within sa'd city for the improvement of the squares and
areas formed by the crossing of streets and alleys and for the improvement
of any of said streets where the same is through or adjacent to property
of the city or of the State of Kansas and to be paid for by the city at
large as provided by law, for which the city is liable and for which ponds
will be issued as hereinafter provided for has been ascertained and is here-
by determined to be the sum of .07810.11 and it is hereby found and determined
that the repair and general improvement funds are insufficient to meet the
cost and expense of such portion of any of said Luproverents as might other-
wise be paid therefrom; and
WHEREAS, that portion of the cost of said improvements to be paid by
special assessments levied upon the lots and pieces of ground liable
for the payment of said improvements has been ascertained and is hereby
found and determined to be the sum of 412,308.25 rhich said last amount
has heretofore been duly assessed and apportioned to the several lots
and pieces of ground liable therefor, payable in installments according
to law and as provided in the ordinances of said city relating thereto
duly passed and approved, of which amount the sum of ;2'2,072.84 has been
paid to the city by the owners of property liable therefor, leaving a bal-
ance of said sum for which bonds shall be issued in the sum of :10,235.41;
and
