AN ORDINANCE creating and defining certain lateral sanitary sewer districts in
the City of Salina designated as Lateral Sanitary Sewer Districts
Nos. 187A and 189, and providing for the construction of lateral
sanitary sewers in the said districts so created and providing for
the cost thereof and for the levying of special assessments against
the property in said districts for the payment of such construction
for the issuing of bonds therefore.
BE IT ORDAINED by the Board of Coim-iissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District No. 187A. That there be and there
is hereby created a lateral sanitary sewer district in the City of Salina which
shall be designated as Lateral Sanitary Sewer District No. 187A, and which shall
include all of the following described property in the City of Salina, to-Witt
Lots 79, 81, 83, 85, 87, 89, 91, 93, 95, and 97 on Fourth Street and Lots 80,
82, 84, 86, 88, 90, 92, 94, 96 and 98 on Fifth Street in Jones Addition in the City
of Salina, Kansas.
Section 2. That it is necessary and it is hereby ordered that a lateral sani-
tary sewer with all the necessary connections, manholes, flush tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District No. 187A, as created by Section 1 of this ordinance, along the following
course, to-mlt:
Beginning at a manhole now existing on sewer 187 in the alley running north
and south between Fourth and Fifth Streets, 35 feet north of the south line of
Forest Avenue; thence south as an 8 inch sewer in said alley 45 feet to a manhole
to be (;onstructed; thence south as an 8 inch sewer in said alley 240 feet to a man-
hole to be constructed.
Section 3, Lateral Sanitary Sewer District No, 189. That there be and there
is hereby created a lateral sanitary sewer district in the City of Salina which
shall be designated as Lateral Sanitary Sewer District No. 189 and which shall
include all of the following described property in the City of Salina, to-witt
Lots 1 to 20 inclusive, in Block 5 and Lots 1 to 22 inclusive, in Block 6,
being all of Blocks 5 and 6 in Woodland Addition.
Section 4. That it is necessary and it is hereby ordered that a lateral sani-
tary sewer wit# all the necessary connections, manholes, flush tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District No. 189 as created by Section 3 of this ordinance along the following
course, to-wit:
Beginning at a point in the alley which runs north and south between Second
Street and Third Street at a point 4.5 feet north of the south line of Pacific
Avenue, thence south in said alley an 8 inch sewer 1165 feet to a flush tank to
be constructed in said alley at a point 44 feet north of the north line of Forest
Avenue.
Section 5. That the City Engineer shall on or before January 15th, 1941, prepare
and file in the office of the City Clerk plans and specifications for the construction
of the Lateral Sanitary Sewers provided for in the preceding sections of this ordinance
which shall be of proper character to serve the property lying within the districts
within which such sewers are to be constructed and shall on or before the same date
prepare and submit to the Board of Commissioners detailed estimates under oath of the
cost thereof. That thereafter the City Clerk shall advertise for three donsecutive
days in the official city paper for sealed proposals for the building and construction
of such sewers according to such plans and specifications, which proposals shall be
filed with the City Clerk on or before the time fixed in such notice, at which time
the Board of Commissioners may let a contract for the building and construction of
such sewers to the lowest and best responsible bidder therefor, if there be any whose
bid does not exceed the estimated cost thereof, but said Board shall reserve the right
to reject any or all such proposals and if no bid shall be received within such estimate,
the Board of Commissioners shall have the power to do such work and make such improve -
meats within the estimated cost thereof as provided by law.
Section 6. That for the cost of building and constructing such sewers special
assessments shall be made for the full cost thereof on all lots or pieces of land
within the sewer districts within and for which such sewers shall be built, according
to the appraised value thereof, without regard to the improvements or buildings there-
on, except such portion of said cost as may be secured from the Vyorks Progress Admin-
istration or any other governmental agency, and the City Engineer, City Manager, City
Clerk and City Attorney of Salina, Kansas are hereby authorized and directed to make
and execute on behalf of said city all proper applications, reports or other vnritten
instruments which may be required or necessary for the purpose of securing a contri-
bution or grant of funds from the Works Progress Administration or any other govern-
mental agency, to be used for paying for a portion of the cost of such improvement.
Section 7. After the passage and publication of this ordinance the Board of Com-
missioners shall appoint three disinterested appraisers who after having taken an oath
to make a true and impartial appraisement of alllots or pieces of land liable to taxa-
tion for the cost of such improvements, shall within five days after having been noti-
fied of their appointment proceed to appraise all of the lots or pieces of land within
such districts, liable to assessment and taxation as aforesaid, without regard to the
buildings or improvements thereon, and after making said appriisements shall return the
same to the Board of Commissioners of said city and said Board shall designate a time
for holding a special meeting of said Board for the purpose of hearing any complaints
that may be made as to the value of any lot or piece of land appraised as aforesaid, of
which special session due notice shall be given in the official city paper, and at which
special session said Board may alter any valuation of any lot or piece of land, if,
in their opinion, the same had been appraised too high or too low.

Section 8. The special assessments herein provided for may be paid by the person
liable therefor in ten approximately equal annual installments but the owner of any
property liable to such assessment may within thirty days from the date of determin-
ing the amount assessed against the property pay the same ;n full and his property
shall not be liable for any assessment for the cost of such improvements, and bonds
as hereinafter provided for shall be issued for the amount of the cost of such im-
provements remaining unpaid at the end of thirty days from the time such assessment
is fixed.
Section 9. For the purpose of paying for the work and improvements in this ordin-
ance provided for, the Board of Commissioners are hereby authorized and directed
to issue improvement bonds of the City of Salina in an amount not to exceed the
cost of such improvements or such portion of such cost as may be in excess of any
funds received from the Works Progress Administration or any other governmental
agency which may contribute to the cost of such improvements and to run for a period
of ten years and be payable in ten approximately equal annual installments, together
with interest not to exceed five percent per annum which bonds shall be issued and
payable according to law; and for the purpose of paying the principal and interest
on said bonds as they severally become due and payable, the Board of Commissioners
shall apportion and assess against the lots or pieces of land within the taxing
districts and such improvements, special assessments covering the cost of such
ir,provements and the apportionments therein contained shall hold good for all of
the installments that are to be collected from the specific property chargeable
with said improvements. Such assessment and apportionment ordinance shall contain
the total amount of tax apportioned to each tract, piece or parcel of land within
the taxing districts and shall state the number of annual installments in which such
tax is to be collected; and thereafter the City Clerk shall annually, at the same
time other taxes are certified certify to the County Clerk of Saline County, Kansas,
a full list of all property liable for such work and improvements, together with
the respective amounts due on each of said tracts, piece or parcels of land, which
amounts shall include the annual installments and interest on all unpaid balances
for one year at the rate of not to exceed 5 percent per annum, on such amounts so
certified, which shall be collected as other taxes are collected.
Section 10. This ordinance shall take effect and be in full force from and after
its publication in the official city paper.

proposals shall be filed with the City Clerk on or before the time fixed in
such notice, at which tine the Board of Commissioners may let a contract for
the building and construction of such sewers to the lowest and best responsible
bidder therefor, if there be any whose bid does not exceed the estia�ted cost
thereof, but said Board shall reserve the right to reject any or all such
proposals and if no bid shall be received within such estimate, the Board of
