Revised Ordinances of the City of Salina 1939, being Sections 8, 9, 11,
13 and 14 of Ordinance No. 4837 relating to the division of the City of
Salina into wards and voting precincts and defining the bountLries thereof,

and repealing said ori, -final sections.

BE IT ORDAINED by the Board of Com:issioners of the City of Salina, Kansas:
Section 1. That Section 30-108 of the Revised Ordinances of the City of

Salina 1939, being Secticn 8 of Ordinance No. 4837, be and the sa;e is hereby
I
amended to read as follows: �
"30-108. Third Precinct of Second '-,ard: The Third Precinct of the Second
V9ard shall include all of that part of the Second `ivard herein defined which
lies south of Elm Street, and west of Twelfth Street from E1m.Street to State
Street, and west of Eleventh Street from State Street to Iron Avenue."

Section 2. That Section 30-109 of the Revised Ordinances of the City of

j Salina 1939 being Sectien 9 of Ordinance No. 4837, be and the same is hereby
amended to read as follows:
"30-109 Fourth Precinct of Second lnlard: The Fourth Precinct of the Second
I 'yard shall include all of that part of the Second V,Fard as herein defined which

Ward shall include all of that part of the Third Nard as herein defined which
i lies west of the center line of Twelfth Street between Iron Avenue and the center
line of the alley which runs east and west in Phillips 2nd Addition, and which

lies north of a boundary line described as follows: Commencing at the intersection
of the center line of Twelfth Street and the center line of tine alley which runs

east and west through Phillips 2nd Addit.on, thence west alon the center line
of said alley to the center line of Baker Street, thence north in the center line
of Baker Street to a point 72 feet south of the south line of Cedar Street, thence

west along a line parallel with and 72 feet south of the south line of Cedar Street

include all of that part of the Third ';'lard as herein defined which lie: within the

lines of Santa Fe Avenue and Thlulberry Street, thence west along the center line of
I.,ulberry Street to the west line of Ninth Street, thence south to the northeast corner

of Seitz Addition, thence west along the north line of Seitz Addition to the northwest
corner of said Addition, thence westerly to the intersection of the west line of Eleventh
Street with the center line of the alley which runs east and west in Phillias 2nd
Addition, thence west along the center line of said alley to its intersection with the
center line of Twelfth Street, thence south along the center line of Twelfth Street to
the center line of South Street, thence east along the center line of South Street to
the center line of Eleventh Street (south of South Street) thence south along the center
line of Eleventh Street to the center line of Prescott Avenue, thence east along the
center line of Prescott A-�enue to the point of beginning.
Section 6. That ori; -final Sections .30-108, 30-109, 30-111, 30-113, 30-114, '-Cleing
Sections 8, 9, 11, 13 and 14 of Ordinance No. 4837, be and the same are hereby repealed.

ORDINANCE NO. 4984

AN ORDINANCE amending Ordinance No. 3188 being an ordinance dividing the City of
Selina, Kansas into zones or districts and for other rurposes by creating a new
use zone or district to be known as the "AX" Residence District and defining the
limits thereof and restricting and regulating the use of property located in such
district.
BE IT ORDAIivED by the Board of Commissioners of the City of Salina, Kansas:.
Secticn 1. That Ordinance No. 3188 of the Ci.ty of Salina, Kansas be and the same
is hereby amended by adding thereto certain sections as hereinafter set forth.
Section 2.. That for the purpose of regulating and restricting the locaticn of trades
and industries and the location, erect; -on, alteration and repair of buildings erected
or altered for specified uses, and the uses of land within the specified district re-
ferred to in this ordinance, there is hereby created in addition to the use di-stricts
specified in Section 2 of Ordinance No. 3188, a use district to be known as the "AX11
Residence District.
Sectin 3. That the territory to be included in the "AX" Residence District as
created by this ordinance shall be comprised of the territory now known and described
as Country Club Heights, an addition in the City of Salina, Kansas, except Lot 6, Block 1
in said addition, all as shown by the recorded plat of said addition.
Secticn 4. That in the "AX" Residence District as referred to and defined in this
ordinance no building or premises shall be used and no building shall be hereafter
erected or altered except for use as a one -family dwelling and accessory buildings in-
cidental to such use and located on the same lot.
Section 5. In the "AX" Residence District as defined and provided for in this ordin-
ance all buildings hereafter erected shall observe the same set back lire from any street
which abutts upon or is adjacent to any lot on which such building is erected, as shall
have been observed by any building erected prior thereto facing upon such street in the
same block, and if there shallbe no other house facing on the same street in the same
block then the set back for any building so erected and the location of the same on
zuch lot, including any accessory buildings, shall be the same as that fixed and designated
by the recorded plat of said Country Club Heights Addition.
Section 6. That except to such extent as the same may be specifically in conflict
with any of the provisions of this ordinance, the restri.etons and conditions set forth
in a certain agreement, dated March 1.3, 1926, end entered into betv.,een the Salina
Country Club Development Company and other persons and which is recorded in the office
of the Resister of Deeds of Saline County, Kansas, in Book "T" of Contracts, Page 514,
and each of such conditions and restri.cticns as set forth in paragraphs numbered 1 to
15 inclusive of said agreement, shall apply to and govern the use of the property located
in the said "AX" Residence District as herein defined and provided for, and said restric-
tions and conditions as set forth in said paragraphs or sections numbered 1 to 15 in-
clusive of said agreement are made a part of this ordinance by reference and included
herein to the same extent as if set forth at length in this ordinance.

amended to read as follows:

lies south of Elm Street, and west of Twelfth Street from Elm Street to State
Street, and gest of Eleventh Street from State Street to Iron Avenue."
Section 2. That Section 30-109 of the Revised Ordinances of the City of
Salina 1939 being Section 9 of Ordinance No. 4837, be and the same is hereby
amended to read as follows:
'130-109 Fourth Precinct of Second Vie.rdF The Fourth Precinct of the
Second Ward shall include all of that part of the Second Vtiard as herein de-
fined which lies south of Elm Street, and east of Twelfth Street from Elm
Street to State Street, and east of Eleventh Street from State Street to Iron
Avenue."
Section 3. That Section 30-111 of the Revised Ordinances of the City of
Salina 1,39, being Section 11 of Ordinance No. 4837 be and the same is hereby
amended to read as follows:
"30-111. First Precinct of Third Ward: The First Precinct of the Third
Ward shall include all of that part of the Third Ward as herein defined which
lies west of the center line of Twelfth Street between Iron Avenue and the
center line of the alley which runs east and west in Phillips 2nd Addition,
and which lies north of a boundary line described as follows: Commencing
at the intersection of the center line of Twelfth Street and the center line
of the alley which runs east and west through Phillips 2nd Addition, thence
west along the center line of said alley to the center line of Baker Street,
thence north in the center line of Baker Street to a point 72 feet south of

72 feet south of the south line of Cedar Street to the intersection of said

of Salina 1939, being Section 13 of Ordinance No. 4837 be and the same is
hereby amended to read as follows:

Ward shall include all of that part of the Third eiard as herein defined which
lies within the following described boundaries, to -wit: Co=,iencing at the
intersection of the center lines of Eleventh Street and Prescott Avenue,
thence north in the center line of Eleventh Street to the.center line of
South Street, thence west in the center line of South Street to the center
line of Twelfth Street, thence north in the center line of Twelfth Street to
the center line of the alley which runs east and west in Phillips 2nd Addition,
thence west along the center line of said alley to its intersection with the
center line of Baker Street, thence north in the center line of Baker Street
to a point 72 feet south of the south line of Cedar Street, thence west along
a line which lies parallel with and 72 feet south of the south line of Cedar
Street to the intersection of said line with the center line of Phillips Street,
thence south in the center line of Phillips Street to its intersection with the
center line of Spruce Street, thence west in the center line of Spruce Street to
its intersection with the west city limits, thence south and along the westerly

Section 5, That Section 30-114 of the Revised Ordinances of the City of
Salina 1939, being Section 14 of Ordinance No. 4837, be and the same is hereby
amended to read as follows:
"30-114. Fourth Precinct of Third INard: The Fourth precinct of the Third
Ward shall include all of that part of the Third Ward as herein dafixtzit defined
which lies within the following described boundaries to -wit: Commencing at the
intersection of the center lines of Santa Fe Avenue and 1ulberry Street, thence
west along the center line of Mulberry Street to the west line of Ninth Street
thence south to the northeast corner of Seitz Addition, thence west along the
north line of Seitz Addition to the northwest corner of said Addition, thence
westerly to the intersection of the west line of Eleventh Street with the
center line of the alley which runs east and west in Phillips 2nd Addition,
thence west along the center line of said alley to its intersection with
the center line of Twelfth Street, thence south along the center line of
Twelfth Street to the center line of South Street, thence east along the

Section 6. That original Sections 30-108, 30-109, 30-111, 30-113, 30-114,

hereby repealed.
Section 7. This ordinance shall take effect and be in force from and
after its publication in the official city paper.
