4976 Issue GO Bonds, Series P-1251 ORDININCE NO. 4976 (Published in the Salina Journal �_ 1940) AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $6932.49 to pay the cost of improving certain streets in said city to be designated as Series P-125. IYHEREASI pursuant to proceedings duly had according to law certain street improve- ments have been constructed by the City of aalina under the direction of its City Engineer according to law within the estimated cost thereof after the advertise- ment for and rejection of bids, no bids havinp- been received for the construction of such improvements within the Engineer's estimate, and said improvements have been constructed and the work thereof done under P. A. Project No. 7787-19 to -wit: Curbing, guttering and grading of Beloit Avenue from the east line of Fourth Street to the center line of Osborne Street as provided for by Resolution No. 763 and Ordinance No. 4937. Curbing, guttering and grading of Kirwin Street from the west line of Ninth Street to the west line of Pershing Avenue as provided for by Resolution No. 764 and Ordinance No. 4937. Curbing, guttering and grading of Jewell Avenue from the east line of South Court Place to the east line of Funston S reet on the north side of Jewell, and from the west line of Pershing Street to the west line of Lot 4, Parkview Addition on the south side of Jewell Avenue as provided for by R solution Nol 765 and Urdinance No. 4937. P Curbing, guttering and grading of Seventh Street from the center line of Harsh Avenue to the center line of Hamilton Avenue as provided for by Resolution No. 766 and Urdinance No. 4937. Curbing, guttering and grading of Johnstown Avenue from the wrest line of Columbia Avenue to the east line of Oakdale A enue as provided by Resolution No. 767 and Ordinance No. 4937; I Curbing, Sutterin6 and grading of Twelfth Street from the south line of Prescott Avenue to the north line of Crawford Avenue as provided for by Resolution No. 768 and Ordinance No. 4937. "HEREAS, the total cost of said improvements has been ascertained and the total portion thereof to be paid by a general tax to be levied upon all taxable property within said city for the improvement of the squares and areas formed by the cross- ing of streets and alleys and for the improvement of any of said streets where the sal -le is throu-h or adjacent to property of the city and to be paid for by the city at large as provided by law, for which the city is liable and for vjhi.ch bonds -,vill be issued as hereinafter provided for has been ascertained and is hereby determined to be the sum of X505.63 and it is hereby found and determined that the repair and general improvement funds are insufficient to rieet the cost and expense of such portion of any of said improvements as right otherwise be paid therefrom; and 1%HEREAS, that portion of the cost of said improvements to be paid by special assess- ments levied upon the lots and pieces of ground liable f'or the pay-ent of said i,n- proven,ents has been ascertained and is hereby found and determined to be the sum of X7,273.06 i%hich said last amount has heretofore been duly assessed and a portioned to the several lots and nieces of ground liable therefor, payable in installments according to law and as provided in the ordinances of said city rcla.ting thereto duly passed and approved, of which amount the sum of X846.20 has been paid to the city by the owners of property liable therefor, leaving a balance of said sum for which bonds shall be issued in the sum of 66426.86; and l,: EREAS, the total cost of said improveinents for which bonds will be issued exclusive of the amounts heretofore paid in cash by the property owners has been and is now hereby determined to be the sum of X6932.49; ?'i0?":" T3ERE1'ORE BE TT O:RDAIEID by the Board of Commiss-I.oners of the Citir of Salina, Kansas: Section 1. That., the foregoing preambles be and they are hereby adopted as a part of this ordinance and that for the purpose of providing funds to nay the cost of the improvercents herein above referred to and described in the ordinances and resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas in the total prir:cipal sum of J6932.49 which shall consist of 14 bonds numbered from one to 14 inclusive, all dated v,arch. lst, 1940, which shall bear interest at the rate of 1-3/4 ner cent per annum fror,.and after said date until the respective maturities of said bonds, payable semi-annually, said. interest to be evidenced by interest coupons as herein provided for and said bonds shall become due serially in denominations as follows; No. 1 for X432.49 due karch 1, 1941 No. 2 for x;500 due March 1, 1942 No. 3 for 4500 due Driarch 1, 1943 No. 4 for $500 due March 1, 1944 No. 5 for $500 due ;:arch 1, 1945 No. 6 for $500 due march 1, 1946 Nos. 7 and 8 for $500 each due harch 1, 1947 Nos. 9 and 10 for 4;500 each due a;arch 1, 1948 Nos. 11 and 12 for 0500 each due yareh 1, 1949 Nos. 13 and 14 for x$`500 each due March 1, 1950 Section 2. Said bonds shall be signed by the yayor and shall be attested by the signature of the City Clerk and corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, ,^!hich coupons shall be in the form provided by law and shall bear the printed or lithographed fac-simile signature of the Nayor and City Clerk of said city and said bonds and interest coup.ns shall be registered in the office of the City Clerk and in the office of the Auditor of State as reuuired by law. Section 3. Said -bonds shall be. desiPnated as Series P-125 and shall be in the form and shall contain recitals substantially as follows, to -wit: 1 C UNITED STATES 01' AMERICA STATE OF KAiuSAS COUNTY OF SALINE CITY OF SALINA Series P-125 No. INTEHEAL DP_PROV MENT BOND KNOW ALL iuIEN BY THESE PRESEP;TS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of Dollars in ].awful money of the United States of America, on the first day of with interest thereon from. the date hereof at the rate of percent per annum, payable semi-annually on the first days of and in each year, on presentation and surrender of the interest coupons hereto annexed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 14 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of � issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain curbing, and guttering improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-115, 12-601 to 12-608, and 13-1011 and 1011a, General Statutes of Kansas 1935, and such sections as amended, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond nave been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. WHEREAS, the total cost of said improvements has been ascertained and the total portion thereof to be paid by a general tax to be levied upon all taxable property within said city for the improvement of the squares and areas formed by the crossing of streets and alleys and for the improvement of any _of_said streets where the same is through or adjacent to property of the city;,and to be paid for by the city at large as provided by law, for which the city is liable and for which bonds will be issued as here- inafter provided for has been ascertained and is hereby determined to be the sum of 505.63 and it is hereby found and determined that the repair and general improvement funds are insufficient to meet the cost and expense of such portion of any of said improvements as might other- wise be paid therefrom; and GwHEREAS, that portion of the cost of said improvements to be paid by special assessments levied upon the lots and pieces of ground liable for the payment of said improvements has been ascertained and is hereby found and determined to be the sum of 47i274.06 which said last amount has heretofore been duly assessed and apportioned to the several lots and pieces of ground liable therefor, payable in installments according to law and as provided in the ordinances of said city relating thereto duly passed and approved, of which amount, the sum of 846,.20 has been paid to the city by the owners of property liable therefor, leaving a balance of said sum for which bonds shall be issued in the sum of � 6426.66 ; and WHEREAS, the total cost of said improvements for which bonds will be issued exclusive of the amounts heretofore paid in cash by the property oti�mers has been and is now hereby determined to be the sum of , sp'2.49 D!07 THEREFORE BE IT ORDAIBtED by the Board of Commissioners of the City of Salina, Kansas: Section 1.
