AN ORDIJANCE creating and defining certain lateral sanitary sewer districts
in the City of Salina designated as Lateral Sanitary Sewer Districts
Nos. 184, 185 and 186, and providing for the construction of lateral
sanitary sewers in the said districts so created and providing for the
cost thereof and for the levying of special assessments against the
property in said districts for the payment of such construction and
I I for the issuing of bonds therefore.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District No. 184. That there be
and there is hereby created a lateral sanitary sewer district in the City
of Salina which shall be designated as Lateral Sanitary Sevier District No.
184 and which shall include all of the following described property in the
City of Salina, to -wit:
Lots 5 and 6, Block 2, Morrison's Third Addition; Lots 2, 4, 6, 8, 10,
i 12, 14, Replat of Block 2, Morrison's Third Addition; Lots 5, 7, 9, 11, 13,
14, 17, 18, 19, 20, Replat of Block 3, Morrison's Third Addition.
Section 2. That it is necessary and it is hereby ordered that a lateral

sanitary sewer with all the necessary connections, manholes, flush tanks and

other appurtenances be constructed and built in and to serve said Lateral
Sanitary Sewer District No. 184 as created by Sect' -on 1 of this ordinance,
along the following course, to -wit:
Beginning at an existing manhole in the intersection of Phillips and
Morrison Avenue, thence south in Phillips Street as an 8 inch sewer a dis-
tance of 563.5 feet more or less to a manhole to be constructed on said sewer.
Beginning at a manhole to be constructed in the intersection of Phillips
and Washington Street, thence east in Washington Street as an 8 inch sewer a
distance of 407.9 feet more or less to a flush tank to be constructed on said
sewer in Washington Street,
Section 3. Lateral Sanitary Sewer District No. 185. That there be and
there is hereby created a lateral sanitary sewer district in the City of
Salina which shall be designated as Lateral Sanitary Sewer District No. 185,
and which shall include all of the following described property in the City
of Salina, to -wit:
Lots 29, 30, 31, 32, 33, 34, 35, 36, 37 and 38 Cedar Street, Phillips

Third Addit=ion.
Section 4. That it is necessary and it is hereby ordered that a lateral

sanitary sewer with all the necessary connections, manholes, flush tanks and

other appurtenances be constructed and built in and to serve said Lateral
Sanitary Sewer District No. 185 as created by Section 3 of this ordinance,
along the following course, to -wit:
Beginning at an existing manhole in the intersection of College and

Cedar Street, thence west in Cedar Street as an 8 inch sewer a distance of

377 feet more or Less to a manhole to be constructed on said scorer.
Section 5. Lateral Sanitary Sewer District No. 186. That there be and
there is hereby created a lateral sanitary sewer district in the City of Salina

which shall be designated as Lateral Sanitary Sewer District No. 186, and which
shall include all of the following described property in the City of Sal-na, to -wit:

Lots 2, 4, 6, 8, 10 and 12, Block 1, College View Addition; Lots 1, 3, 5, 7,
9 and 11, Block 3, College View Addition.
Section 6. That it is necessary and it is hereby ordered that a lateral
sanitary sewer with all the necessary connections, manholes, flush tanks and
other appurtenances be constructed and built in and to serve said Lateral Sanitary
Sewer District No. 186 as created by Section 5 of this ordinance along the following
described course, to -wit:
Beginning at an existing manhole in Fifth Street, located 381 feet west of
the west lot line of Lot 12, Hutchinson's Addition, thence east, (49.25 feet north
of the south property line of Lot 12, Hutchinson}s Addition), as an 8 inch sewer
across Lot 12 to a manhole in Fourth Street, thence north in Fourth Street 26.85
feet to a manhole in the intersection of Fourth and Rahm Streets, thence east in
Rahm Street a distance of 290 feet more or less to a flush tank to be constructed
in Rahm Street.
Section 7. That the City Engineer shall on or before March 4, 1940, prepare
and file in the office of the City Clerk plans and specifications for the construc-
tion of the Lateral Sanitary Sewers provided for in the preceding sections of this
ordinance which shall be of proper character to serve the property lying within
the districts within which such sewers are to be constructed and shall on or be-
fore the same date prepare and submit to the Board of Commissioners detailed es-
timates under oath of the cost thereof. That thereafter the City Clerk shall ad-
vertise for three consecutive days in the official city paper for sealed proposals
for the building and construction of such sewers according to such plans and speci-
fications, which proposals shall be filed with the City Clerk on or before the ti;i.e
fixed in such notice, at which time the Board of Commissioners may let a contract
for the building and construction of such sewers to the lowest and best responsible
bidder therefor, if there be any whose bid does not exceed the estimated cost thereof,
but said Board shall reserve the right to reject any or all such proposals and if no
bid shall be received within such estimate, the Board of Commissioners shall have the
power to do such work and make such improvements within the estimated cost thereof
as provided by law.
Section 8. That for the cost of building and constructing such sewers special
assessments shall be made for the full cost thereof on all lots or pieces of land
within the sewer districts within and for which such sewers shall ,-e built, according
to the appraised value thereof, without regard to the improvemdnts or buildings
thereon, except such portion of said cost as may be secured from the 'forks Progress
Administration or any other governmental agency, and the Pity Engineer, City Yanager,

City Clerk and City Attorney of Salina, Kansas are hereby authorized and
directed to make and execute on behalf' of said city all proper applications,
reports or other written instruments which may be required or necessary for
the purpose of securing a contribution or grant of funds from the Vv'orks Progress
Administration or any other governmental agency, to be used for paying for a
portion of the cost of such improvement.
Section 9. After the passage and publication of this ordinance the Board
of Commissioners shall appoint three disinterested appraisers who after having
taken an oath to make a true and impartial appraisement of all lots or pieces
of land liable to taxation for the cost of such improvements, shall within

five days after having been notified of their appointment proceed to appraise
jall of the lots or pieces of land within such districts, liable to assessment
and taxation as aforesaid, without regard to the buildings or improvements
thereon, and after making said appraisements shall return the same to the
Board of Commissioners of said city and said Board shall designate a time
for holding a special meeting of said Board fer the purpose ofheari.ng any
complaints that may be made as to the value of any lot or piece of land
appraised as aforesaid, of which special session due notice shall be to ven
in the official city paper, and at which special session said Board may alter
any valuation of any lot or piece of land, if, in their opinion, the same had
been appraised too high or too low.
Section 10. The special assessments herein provided for may be paid by
the person liable therefor in ten approximately equal annual installments but
the owner of any property liable to such assessment may within thirty days
from the date of determining the amount assessed against his property pay the
same in full and his property shall not be liable for any assessment for the
cost of such improvements, and bonds as hereinafter provided for shall be
issued for the amount of the cost of such improvements remaining unpaid at
the end of thirty days from the time such assessment is fixed.
Section 11. For the purpose of paying for the work and improvements
in this ordinance provided for, the Board of Commissioners are hereby authorized
and directed to issue improvement bonds of the City of Salina in an amount
not to exceed the cost of such improvements or such portion of such cost as
may be in excess of any funds received fro -t, the Works Progress Administration
or any other governmental agency which may contribute to the cost of such
improvements and to run for a period of ten years and be payable in ten
approximately equal annual installments, together v;ith interest not to ex-
ceed five percent per annum which bonds shall be issued and payable according
to law; and for the purpose of paying the principal and interest on said

juonds as they severally become- due and payable, the Board of Commissioners
shall apportion and assess against the lots or pieces of land within the
taxing districts and such improvements, special assessments covering the cost of
such improvements and the apportionments therein contained shall hold good for all
! of the installments that are to be collected from the specific property chargeable
with said improvements. Such assessment and apportionment ordinance shall contain
the total amount of tax apportioned to each tract, piece or parcel of land within
the taxing districts and shall state the number of annual installments in which
such tax is to be collected; and thereafter the City Clerk shall annually, at the
same time other taxes are certified certify to the County Clerk of Saline County,
Kansas, a full list of property liable for such work and improvements, together
with the respective amounts due on each of said tracts, piece or parcels of land,
which amounts shall include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed 5 percent per annum, on such
amounts so certified, which shall be collected as other taxes are collected.
Section 12. This ordinance shall take effect and be in full force from
and after its publication in the official city paper.
