That Ordinance No. 4709 of the Cite of Sa ii_na being an ordinance relating to and re ;plating the production and sale of milk and milk products be amended by adding thereto certain sections pro- v ding; for and requiring the inspection and tes tinxr of cows for certain diseases, such added sections being; as hereinafter set forth. Section 2_ Inspection and Testing for Disease. Yo person shall within the City of Salina or its police jlzrisdiction produce, sell, offer or expose for sale or have in his possession s.,iith intent to sell any milk or milk product as defined by Ordinance T?o. 4709 of the City of Salina, unless such milk or milk Product has been produced from cows which have been inspected and tested for and found to be free from ui_sease in accordance with the following requirements of this ordinance, -rid no permit shall be issued to any person for the sale or distribution of milk or riilk products within the City of Salina, and no person shall be perriitted to sell or distribute milk or milk products w1thin the City of Salina under any .permit previously issued, unless the cows from 1,,'-�.ich such milk is produced and all cows kept on the same premises with such cows, s iall have been inspected., tested and certified in accordance with the following regrirements of this ordinance. Section 3. Tuberculosis Test. Item I -R of Section 7 of Ordinance No. 4709 of the city of Salina shall hereaf ter apply to all cows and herds from which milk is produced, sold or distributed for consumption in the Cit,r of Salina. or its -police juri sdict:i.on, and to all cows kept on the sarie premises with any such cows. Section 4. Bang's Disease. No milk or milk products shall be pro- duced, sold or distributed for consumption in the City of Salina unless all of the cows in the herd or herds from yrhich any such milk is -Jro- duced and all cows kept on the same premises with the cows from which any s>> -ch milk is produced shall have been found free from Tian ' s disease as shown by blood serum tests for agglutinins against Brucella abortus. Blood samples shall be taken by a licensed veterinarian and tests shall be made in the City laboratory or a laboratory approved by the health officer. All reactors shall be immediately removed from the premises and disposed of in accordance iiith the requir.emer_ts of the health officer and/or State livestock sanitary commissioner. All such co1jrs shall be so inspected and tested anc. certificates covering, the cows so tested small be filed with the city health officer v. ith.in 90 days fr­_)n' the date r 1 1 I 1 L this section takes effect. All such cows shall be so tested, Inspected and certified at lA ast once every 12 months thereafter and if at anTr such test any reactor is found such reactor shall be removed from the premises and all other coves in the same hexed or on the same premises shall be retested within 90 days from such date. BE IT OhDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That Ordinance No.4799 of the City of Salina being an ordinance relating to and regulation the production and sale of milk and milk products be amended by adding thereto certain sections providing for and requiring the inspection and testing of cows for certain diseases, such added sections being as hereinafter set forth. Section 2. Inspection and Testing for Disease. No person shall within the City of Salina or its police jurisdiction produce, sell, offer or expose for sale or have in his possession with intent to sell any milk or milk product as defined by Ordinance No.4709 of the City of Salina, unless such milk or milk product has been produced from cows which have been inspected and tested for and found to be free from disease in accordance with the following requirements of this ordinance, and no permit shall be issued to any person for the sale or distribution of milk or milk products within the City of Salina, and no person shall be permitted to sell or distribute milk or milk products within the City of Salina under any permit previously issued, unless the cows from which such milk is produced and all cows kept on the same premises with such cows, shall have been inspected, tested and certified in accordance with the following requirements of this ordinance. A certificate identifying each animal by number, and signed by the veterinarian and/or laboratory making the test and filed in the office of the city health officer shall be evidence of the above test. Section 5. Penalty. Any person who shall violate any of the pro- visions of this ordinance or who shall fail, refuse or neglect to comply u:Tith any of the lawful orders or regulations made by the city health officer pursuant to this ordinance shall be deemed guilty of a misdemeanor and shall be punished to the same extent and in the same manner as for a violation of any of the provisions of Ordinance No. 4709 and in acid.ition thereto the issuance of a permit as required by Ordinance No. 4709 may be denied or if one has been issued any such permit may be revoked by the city health officer upon information received by him of any such violation.
