4948 Loud Speaker PermitORDIDANCE NO. 4948 (Published in the Salina Journal AN ORDINANCE providing for the levying and paying of a license tax on and regulating a certain trade, calling or occupation and pro- viding for the issuance of licenses thereon and providing a penalty for the violation of this ordinance. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. There is hereby levied a license tax upon every person, firm or corporation who shallwithin the city of Salina, conduct, pursue, carry on or operate the calling, trade or occupation of advertising or announcing, by means of any loud speaker, radio or phonograph device, either in or attached to any automobile or other vehicle operated on the streets of said city or from any stationary location on private property by which the sound of such advertisement or announcement, either in the form of music, voice or otherwise by any of the means aforesaid, is projected into any public street for the purpose of calling attention to persons in such public street or elsewhere the advertisement or announcement projected from or by means of any such device. Section 2. The license tax levied and provided for under the provisions of Section 1 of this ordinance shall be in the sum of ;3.00 per day for each loud speaker, radio or phonograph device from which such advertisement or announcement is projected, and it shall be unlawful for any person, firm or corporation to use any such device within the City of Salina, and upon the public streets thereof or adjacent to any such public street until such i person, firm or corporation shall have applied to the City Clerk of said city for such license, and shall pay the license taxes pro- i vided for herein and shallhave received a license from the City Clerk to conduct, pursue, carry on or operate within the City, for the time for which such license is paid, such calling, trade or occupation. Section 3. It shall be unlawful for any person, firm or corpora- tion to use or operate any such device as mentioned in Section 1 of this ordinance, within the City of Salina, at any time after the hour of 9:00 P. M. and earlier than the hour of 8:00 A.M in any day, and no license issued under the provisions of this ordinance shall be deemed to permit the use thereof during any of the time when such use is prohibited by the provisions of this section. Section 4. Any person, firm or corporation or any agent, manager employee or officer or member thereof who shall violate or shall cuase., permit or direct the violation of any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than $5.00 nor more than 010.00 for each offense and each occasion upon which any such violation shall occur shall be deemed a separate offense. Section 5, This ordinance shall take effect and be in force from and after its publication in the official city paper. There is hereby levied a license tax upon every person, firm or corporation who shall within the City of Salina, conduct, pursue, carry on or operate the calling, trade or occupa- tion of advertising or announcing, by means of any loud speaker, radio or phonograph device, either in or attached to any auto - or other mobile/vehicle operated on the streets of said city or from any by, stationary location on private property/which the sound of such advertisement or announcement, either in the form of music, voice or otherwise by any of the means aforesaid, is projected into any public street or the purpose of calling attention to persons in or elsewhere such public street/ the advertisement or announcement projected from or by means of any such device. Section 2. The license tax levied and provided for under the provisions of Section 1 of this ordinance shall be in the sum of $3.00 per day for each loud speaker, radio or phonograph device from which such advertisement or announcement is projected, and it shall be unlawful for any person, firm or corporation to the use any such device within the City of Salina, and upot�public streets thereof or adjacent to any such public street until such person, firm or corporation shall have applied to the City Clerk of said city for such license, and shall pay the license taxes pro- vided for herein and shall have received a license from the City Clerk to conduct, pursue, carry on or operate within the City, for the time for which such license is paid, such calling, trade or occupation. Section 4. Any person, firm or corporation or any agent, manager employee or officer or member thereof who shall violate or shall cause, permit or direct the violation of any of the pro- visions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than vii 5y, nor more than w10w for each offense and each occasion upon which any such violation shall occur shall be deemed a separate offense. Section 5. This ordinance shall take effect and be in force from and after its publication in the official city paper.
