AN ORDINANCE relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the City of Salina
to pay the cost of curbing and guttering Clark Street from the
north line of Walnut Street to the south lineof'-M=etta Avenue;
Delaware Avenue from the south line of Iron Avenue to the center
line o os own Avenue; Des Moines Avenue from the north line
of Ash Street to the south line of Elm StrFet; Eighth Street
from the north line of Pacific Avenue to the noRH line--o=arsh
Street; Johnstown Avenue from the east line of Columbia Avenue
to the east line of Kansas Avenue; Kansas Avenue from the south
line of Iron Avenue to the north line o ypsum venue; Kirwin
Avenue from the west line of Santa Fe Avenue to the East-ine
o ig land Avenue; Merrill Street from the south line of Craw-
ford Street to the nor ine o ilson Street; Oakdale Avenue
from the south line of Johnstown Avenue to the south line o
Ash Street; Republic Avenue from the east line of Eleventh Street
to the west line of SHerman Street; Tenth Street from the north
line of Frost Street to the north line o Fran n Avenue; and
relating to and providing for the collection and payment of such
assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Sarna,
Kansas-:
Section 1. That for the purpose of paying for that part of the
cost of improvements of certain portions of certain streets as here-
inafter set forth in the following sections of this ordinance which
is chargeable to the private property in the assessment districts for
each of such improvements, respectively, as set forth in the following
sections of this ordinance and which cost is hereby determined to be
the sums hereinafter set forth in the following sections of this ordinance
with respect to each of such improvements, there are hereby levied End
assessed on the property liable therefor, being all of the lots and
pieces of ground lying on either side of said streets so improved,
respectively to the middle of the block for the distance improved,
with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, ?,
S, 9, 10, 11 and 12 of this ordinance, according to the appraised value
of such lots and pieces of ground with respect to each such improvement,
without regard to the buildings or improvements thereon, special assess-
ments covering tie cost of such work and improvements, said special
assessments being based on the special valuation and appraisement of
said lots and pieces of ground heretofore made by three disinterested
appraisers appointed by the Board of Corrqissioners of the City of Salina,
Kansas, with respect to each such improvement, which said appraisements
are hereby referred to and made parts of this ordinance, and the several
amounts levied, apportioned and assessed against the lots and pieces of
ground for each of such improven4nts, respectively, for the purposes
aforesaid are hereby found and determined to be the amounts set forth
in the following sections of this ordinance with respect to each of such
improvements.
Section 2. For that part of the cost of the curbing and guttering
of Clark Street f rom the north line of Walnut Street to the south line
of Marietta Avenue which is chargeable against the private property liable
therefor, and which cost is hereby determined to be $958.91, there is here-
by levied, apportioned and assessed against the following described lots
and pieces of land, as provided for in Section 1 of this ordinance, the

Section 13. Said amounts levied, apportioned and assessed aforesaid
shall be due and collectible in ten equal installments the first
becoming due with the taxes levied for the year 1939 and one of said
installments falling due each and every year thereafter until all are
paid, and all to be collected with interest as in this ordinance
provided; PROVIDED HOVIEVER, that the owner of any piece of property
liable for any such assessment may redeem his property from such
I liability by paying into the City Treasury the entire amount charge-

able against the same, as in this ordinance designated at any time

within thirty days after the publication of this ordinance and before
I
j the issuance of the bonds of said city in payment of the balance of
the cost of said improvements, and the property so paid on shall not

thereafter be liable for any further assessments for the cost of said

improvements nor for any part of said bonds.
Section 14. There is hereby further levied and assessed against
each lot and piece of ground described in this ordinance 4 per cent
interest per annum on all of said installments therein mentioned from
the date of the bonds which may be issued at the end of thirty days as
j specified in the preceding section hereof, as by law provided, to the
time of collection of the last installment as provided by law, which
said interest shall be collected annually at the same time and in the
same manner as said installments are collected; and after the taking
effect of this ordinance it shall be the duty of the City Clerk of
said city to annually at the same time other taxes are certified and
until all of said assessments so apportioned and levied herein have
been certified, to certify to the County Clerk of Saline County, Kansas,

a full list of all property liable to assessment and taxation for such
work and improvement, except such property on which the special assess-
ments aforesaid have been paid in full as hereinbefore provided, together
with the respective amounts due on each of such lots and pieces of
ground, which amounts shall include the annual installments of such
special assessments together with the interest for one year at the rate
of 4 per cent per annum on all unpaid balances of such assessments at
the beginning of each such
g � year as aforesaid, and such amounts so certi-
fied as herein provided for shall be placed upon the tax roll by the
County Clerk of Saline County, Kansas and collected as other taxes are
collected.
Section 15. This ordinance shall take effect and be in force from
and after its publication in the official city paper.

ORDINANCE NO. 4931
AN ORDINANCE relating to and apportioning and levying special
assessments on certain lots and pieces of ground in the
City of Salina to pay the cost of curbing and guttering
Clark Street from the north line of Walnut Street to the
south line of Marietta Avenue; Delaware Avenue from the
south line of Iron Avenue to the cen er 11ne of Johnstown
Avenue; Des Moines Avenue from the north line of Ash Street
to the south line o Street; Eighth Street from the
north line of Pacific Avenue to the north 11n6 of Harsh
Street; Johnstown Avenue from the east line of Columbia
Avenue to a eastline of Kansas Avenue; Kansas Avenue
from the south line of Iron Avenue to the nor ne o
Gypsum Avenue; Kirwin Avenue from the west line of Santa

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of paying for that part of
the cost of improvements of certain portions of certain streets as
hereinafter set forth in the following sections of this ordinance
which is chargeable to the private property in the assessment
districts for each of such improvements, respectively, as set forth
in the following sections of this ordinance and which cost is hereby
determined to be the sums hereinafter set forth in the following
sections of this ordinance with respect to each of such improvements,
there are hereby levied and assessed on the property liable therefor,
being all of the lots and pieces of ground lying on either side of
said streets so improved, respectively to the middle of the block
for the distance improved, with respect to the improvements
mentioned in Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11 and 12 of this
ordinance, according to" the appraised vAlne o -f sucn Lots and pieces
of ground with respect to each such improvement, without regard to
the buildings or improvements thereon, special assessments covering
the cost of such work and improvements, said special assessments
being based on the special valuation and appraisement of said lots
and pieces of ground heretofore made by three disinterested appraisers
appointed by the Board of Commissioners of the City of Salina, Kans.,
with respect to each such improvement, which said appraisements are
hereby referred to and made parts of this ordinance, and the several
amounts levied, apportioned and assessed against the lots and pieces
of ground for each of such improvements, respectively, for the
purposes aforesaid are hereby found and determined to be the amounts
set forth in the following sections of this ordinance with respect
to each of such improvements.
Section 2. For that part of the cost of the curbing and
guttering of Clark Street from the north line of Walnut Street to
the south line of Marietta Avenue which is chargeable.against the
private property liable therefor, and which cost is hereby deter-
mined to be $958.91, there is hereby levied, apportioned and

Section 13. Said amounts levied, apportioned and assessed
aforesaid shall be due and collectible in ten equal installments
the first becoming due with the taxes levied for the year 1939 and
one of said installments falling due each and every year thereafter
until all are paid, and all to be collected with interest as in
this ordinance provided; PROVIDED HOWEVER, that the owner of any
piece of'propert y liable for any such assessment may redeem his
property from such liability by paying into the City Treasury the
entire amount chargeable against the same, as in this ordinance
designated at any time within thirty days after the publication
of this ordinance and before the issuance of the bonds of said
City in payment of the balance of the cost of said improvements,
and the property so paid on shall not thereafter be liable for any
further assessments for the cost of said improvements nor for any
part of said bonds.
Section 14. There is hereby further levied and assessed
against each lot and piece of ground described in this ordinance
per cent interest per annum'on all of said installments
therein mentioned from the date of the bonds which may be issued
at the end of thirty days as specified in the preceding section
hereof, as by law provided, to the time of collection of the last
installment as provided by law, which said interest shall be collected
annually at the same time and in the same manner as said install-
ments are collected; and after the taking effect of this ordinance
it shall be the duty of the City Clerk of said City to annually at
the same time other taxes are certified and until all of said
assessments soapportioned and levied herein have been certified,
to certify to the County Clerk of Salina County, Kansas, a full
list of all property liable to assessment and taxation for such
work and improvement, except such property on which the special
assessments aforesaid have been paid in full as hereinbefore pro-
vided, together with the respective amounts due on each of such
lots and pieces of ground, which amounts shall include the annual
installments of such special assessments together with the interest
for one year at the rate of 4 per cent per annum on all unpaid
balances of such assessments at the beginning of each such year
as aforesaid, and. such,amounts so certified as herein provided for
shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas and collected as other taxes are collected.
Section 15. This ordinance shall take effect and be in force
from and after its publication in the official city paper.
