All ORDI ATICE creating and defining certain Main and Lateral Sanitary
Sewer Districts in the City of Salina designated as Main Sanitary
Sewer District "R" and Lateral Sanitary Sewer Districts No. 179
and 180, and providing for the construction of main and lateral sani-
tary sewers in said Main Sewer District "R" and in said Lateral
Sanitary Sewer Districts No.'179 and 180 so created, and providing
for the cost thereof and for the levying of special assessments
against the property in said districts for the payment of such
construction and forthe issuing; of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:

Section 1. Main Sanitary Sewer District "R". ,That there be and

there is hereby created a Plain Sanitary Sewer District in the City
i
of Salina which shall be designated as 1"rain Sanitary Sewer District
"R" which shall include all the following described property in said
city to -wit:
i
Lots 1 to 10 inclusive in I,10ant Barbara Park Addition;
Lot 2 in Surveyor's Plat No. 34;
Lots 10 to 19 inclusive, Surveyor's Plat No. 8;
Lots 1 to 22 inclusive, Block 1, Hansen Court Addit:_on;
Lots 1 to 22 inclusive, Block 2, Hansen Court Addition;
i Lots 1, 2, 3, 4, 6, 7 and 8 in Surveyor's Plat lTo. 8;
Part of Lot 1 Surveyor's Plat No. 34 described as follows:
Beginning at the southwest corner of said Lot 1, thence north
140 feet, thence east 120 feet, thence south 140. feet, thence
west 12.0 feet to point of beginning.
Section 2. That it is necessary and it is hereby ordered that
a main sanitary sewer together with all necessary inlets, inlet con-
nections, manholes, service connections and all other necessary

appurtenances be constructed and built in and to serve rain Sanitary
Sewer District "R" along the following described course within and
adjacent to said district to -wit: Beginning at the existing manhole
at the intersection of Iron Avenue and Delaware Avenue, thence east

1 in Iron Avenue as a 10 inch sewer a distance of approximately 3289
i

feet to a manhole to be constructed in the inter°section of Iron Avenue
and West Lane Drive in Mount Barbara Park Addition.
Section 3. Lateral Sanitary ;ewer District No. 179. That there
be and there is hereby created a lateral sanitary sewer district in
the City of Salina which shall be designated as Lateral Sanitary Sewer
District No, 179, and which shall include all of the following des-
cribed property in the City of Saline., to -wit:
Lots 1 to 20, both inclusive in Block 30 in Military
Addition in Salina, Kansas.
Section 4. That it is necessary and it is hereby ordered that a
lateral sanitary sewer with all necessary connections, manholes, flush
tanks and other appurtenances be constructed and built in and to serve
said lateral sewer district No. 179 as created by Section I of this
ordinance, along the following course, to -wit:
Beginning at an existing manhole in the intersection of Pacific
Street and the alley running north and south in Block 30 Military
Addition between and parallel with Tenth Street and Eleventh Street,
thence north in said alley as an 8 inch sewer 477 feet more or less
to a manhole to be constructed in the intersection of said alley and
Marsh Street.

Section 5. Lateral Sanitary Sewer District No. 180. That there be
and there is hereby created a lateral sanitary sewer district in the
City of Salina which shall be designated as Lateral Sanitary Sewer Dis-
trict No. 180 and which shall include all of the following described
property in the City of Salina, to -wit:
Lots 2, 4, 6, 8, 10 in Block 14; and Lots 1, 3, 5, 7 and 9 in Block
15 in South Park Addition in Salina, Kansas.
Section 6. That it is necessary and it is hereby ordered that a
lateral sanitary sewer with all necessary connections, manholes, flush
tanks and other appurtenances be constructed and built in and to serve

said lateral sewer district No. 180 as created by Sections of this
ordinance, along the following described course, to -!Nit:
Beginning at an existing manhole at the intersection of Twelfth Street
and Prescott Avenue, thence south in Twelfth Street as an 8 inch sewer
a distance of 1039 feet more or less to a flush tank to be constructed
in Twelfth Street north of Crawford avenue; also beginning at a manhole
to be constructed on said sewer at the intersection of Twelfth Street
and Charles Street running thence east in Charles Street as a 611 sewer
175 feet, and also beginning at said manhole to be constructed on said
sewer at the intersection of Twelfth Street and Charles Street thence
west as a 611 sewer 185 feet.
Section 7. That the City Engineer shall on or before January 10th,
1939, prepare and file in the office of the City Clerk plans and speci-
fications for the construction of the Main Sanitary Sewer and the Lateral
Sanitary Sewers provided for in the preceding sections of this ordinance
which shall be of proper character to serve the property lying within
the districts within which such sewers are to be constructed and shall
on or before the same date prepare and submit to the Board of Commissioners
detailed estimates under oath of the cost thereof. That thereafter the
City Clerk shall advertise for three consecutive days in the official city
paper for sealed proposals for the building and construction of such sewors
according to such plans and specifications, which proposals shall be
filed with the City Clerk on or before the time fixed in such notice,
at which time the Board of Commiss1ioners may let a contract for the
building and construction of such sewers to the lowest and best responsible'
bidder therefor, if there be any whose bid does not es_ceed the estimated
cost thereof, but said Board shall reserve the right to reject any or all
such proposals, and if no bid shall be received within such estimate, the

Board of Commissioners shall have the power to do such work and make such
improvements within the estimated cost thereof as provided by law.
Section 8. That for the cost of building and constructing such sewers
special assessments shall be made for the full cost triereof on all lots
or pieces of land within the sewer districts within and for which such
sewers shall be built, according to the appraised value thereof, without
regard to the improv^ments or buildings thereon, except such portion of
said cost as may be secured from the WorIcs Progress lidministration or any

other governmental agency, and the City Engineer, City Vilanager, City

Clerk and City Attorney of Salina, Kansas are hereby authorized and
I
directed to make and execute on behalf of said city all proper applica-
tions, reports or other written instruments which may be required or
necessaryfor the purpose of securing a contribullon or grunt of funds
i
from the 17orks Progress Administration or any other governmental agency,
to be used forpa,�' g y in for a portion of the cost of such improvements.
Section 9. After the passage and publication of this ordinance
i
t
the Board of Commissioners shall appoint three disinterested appraisers
who after having taken an oath to make a true and impartial appraise-
went of all lots or pieces of land liable to taxation for the cost of
such improvements, shall within five days after having been notified
!
of their appo-ntment proceed to appraise all of the lots or pieces of
i
land within such districts, liable to assessment and taxation as afore-
said without regard to the buildings or improvements thereon,and
i
after making said appraisements shall return the sarie to the Board of
Commissioners of said city and said Board shall designate a time for
holding a special meeting of said Board for the purpose of hearing any
j
complaints that may be made as to the value of any lot or piece of land
appraised r3 aforesaid, of which special session due notice shall be
given in the official city paper, and at which special session said
j
Board may alter any valuation of any lot or piece of land, if, in their
i
opinion, the same had been appraised too high or too low.

Section 10. The special assessments herein provided for may be
paid by the hers on liable therefor in ten approximately equal annual
i
i
installments but the owner of any property liable to such assessment
may within thirty days from the date of determining the amount assessed
against his property pay the same in full and his property shall not
be liable for any assessment for the cost of such improvements, and
bonds as hereinafter provided for shall be issued for the amount of the
cost of such improvements remaining unpaid at the end of thirty days
from the time such assessment is fixed.
Section 11. For the purpose of paying for th4 work and improve-

ments in this ordinance provided for, the Board of Commissioners are
hereby authorized and directed to issue improvement bonds of the City
of Salina in an amount not to exceed thecost of such improvements or
such portion of such cost ax may be in excess of any funds received
from the Works Progress Administration or any other Eovernmental agency
which may contribute to the cost of such improvem2,nts, and to run for
a period of ten years and be payable in ten approximately equal annual
installments, together with interest not to exceed five percent per annum
which bonds shall be issued and payable according to law; and for the purpose]
of paying the principal and interest on said bonds as they severally become
aue and pay able, the Board of Corimissioners shall apportion and assess

against the lots or pieces of land within the taxing districts of such
improvements, special assessments covering the cost of such improvements
and the apportionment therein contained shall hold good for all of the
installments that are to be collected from the specific property charge-
able with said improvements. Such assessment and apportionment ordinance
shall contain the total amount of tax apportioned to each tract, piece or
parcel of land within the taxing districts and shall state the number of
annual installments in which such tax is to be collected; and thereafter
the City Clerk shall annually, at the same time other taxes are certified
certify to the County Clerk of Saline County, Kansas, a full list of all
property liable for such work and improvements, together with the respective
ariounts due on each of said tracts, piece or parcels of land, which amounts
shall include the annual installments and interest on all unpaid balances
for one year at the rate of not to exceed 5 percent per annum, on such
amounts so certified, which shall be collected as other taxes are collected.
Section 12. This ordinance shall take effect and be in full force
from and after its publication in the official city paper.

AN ORDINANCE creating and defining certain Main and Lateral Sanitary
Sewer Districts in the City of Salina designated as Main Sanitary
Sewer District "R" and Lateral Sanitary Sewer Districts No. 179
and 180, and providing for the construction of main and lateral
sanitary sewers in said Main Sewer District "R" and in said
Lateral Sanitary Sewer Districts No. 179 and 180 so created,
and providing for the cost thereof and for the levying of special
assessments against the property in said districts for the pay-
ment of such construction and for the issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salir}g,
Kansas:
Section 1. Main Sanitary Sewer District "R". That there be
and there is hereby created a Main Sanitary Sewer District in the
City of Salina which shall be designated as Main Sanitary Sewer
District "R" which shall include all the following described property
in said city to -wit
Lots 1 to 10 inclusive in Mount Barbara Park Addition;
Lot 2 in Surveyor's Plat No. 34;
Lots 10 to 19 inclusive, Surveyor's Plat No. 8;
Lots 1 to 22 inclusive, Block 1, Hansen Court Addition;
Lots 1 to 22 inclusive, Block 2, Hansen Court Addition;
Lots 1, 2, 3, 4, 61 7 and 8 in Surveyor's Plat No. 8;
Part of Lot 1 Surveyor's Plat N0.34 described as follows: beginning
at the southwest corner of said Lot 1, thence north 140 feet, thence
east 120 feet, thence south 140 feet, thence west 120 feet to point
of beginning.
Section 2. That it is necessary and it is hereby ordered that

there be and there is hereby created a lateral sanitary sewer
district in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 179, and which shall include all of
the following described property in the City of Salina, to-wit:-
Lots 1 to 20, both inclusive in Block 30 in Military
Addition in Salina, Kansas.
Section 4. That it is necessary and it is hereby ordered
that a lateral sanitary sewer with all necessary connections, man-
holes, flush tanks and other appurtenances be constructed and built
in and to serve said lateral sewer district No. 179 as created by

Beginning at an existing; manhole in the intersection of
Pacific Street and the alley running north and south in Block

Section 5, Lateral Sanitary Sewer District No. 180. That
there be and there is hereby created lateral sanitary sewer
district in the City of Salina which shall be designated as Lateral
Sanitary Sewer District No. 180 and which shall include all of the
following described property in the City of Salina, to-wit.-
Lots
o-wit:Lots 2, 4, 6, 8, 10 in Block 14; and Lots 1, 31 50 7 and 9
in Block 15 in South Park Additidn in SalIna, Kansas.
Section 6. That it is necessary and it is hereby ordered that
a lateral sanitary sewer with all necessary connections, manholes,
flush tanks and other appurtenances be constructed and built in
and to s Vve said lateral sewer district No. 180 as created by

to-wit:
Beginning at an existing manhole at the intersection of

sections of this ordinance which shall be of proper character to
serve the property lying within the districts within which such
sewers are to be constructed and shall on or before the same date
prepare and submit to the Board of Connissioners detailed estimates
under oath of the cost thereof. That thereafter the City Clerk
shall advertise for three consecutive days in the official city
paper for sealed proposals for the building and construction of
such sewers according to such plans and specifications, which
proposals shall be filed with the City Clerk on or before the ti -ie
fixed in such notice, at which time the Board of Commissioners may
let a contract for the building and construction of such sewers
to the lowest and best responsible bidder therefor, if there be
any whose bid does not exceed the estimated cost thereof, but
said Board shall reserve the right to reject any or all such

proposals, and if xx bid shall be received within such estimate,
the Board of Commissioners shall have the power to do such work
and make such improvements within the estimated cost thereof as
provided by law.
Section 8. That for the cost of building and constructing
such sewers special assessments shall be made for the full cost
thereof on all lots or pieces of land within the sewer districts
within and for which such sewers shall be built, according to the
appraised value thereof, without regard to the iprovements or
buildings thereon, except such portion of said cost as may be
secured from the Works Progress Administration or any other
governmental agency, and the City Engineer, City Manager, City
Clerk and City Attorney of Salina, Kansas are hereby-and directed
to make and execute on behalf of said city all proper applications,
reports or other written instruments which may be required or
necessary for the purpose of securing a contribution or grant of
funds from the Works Progress Administration or any other govern-
mental agency, to be used for paying for a portion of the cost
of such improvements.
Section 9. After the passage and publication of this ordinance
the Board of Commissioners shall appoint three disinterested

Clerk shall annually, at the same time other taxes are certified
certify to the County Clerk of Saline County, Kansas, a full list
of all property liable for such work and improvements, together with
the respective amounts due on each of said tracts, piece or parcels
of land, which amounts shall include the annual installments and
interest on all unpaid balances for one year at the rate of not
to exceed 5 percent per annum, on such amounts so certified, which
shall be collected as other taxes are collected.
