AN ORDITiANCE providing for the repair and reconstruction of a
certain portion of a certain sewer in Ash Street in the City
of Salina and providing for the payment of the cost of such
L-1proveraent by the city at large and for the issuance of
general improvement bonds of said city to pay such cost.

WHEREAS, a certain portion of the main sanitary sewer in Ash Street
in the City of Salina lying immediately west of and adjacent to that
I
portion of said sewer which has been and is being* repaired and re-
constructed as provided in Ordinance No. 4891 of said city, and pur-
suant to the plans and specifications prepared by the City Lngineer
and tie contract let for such work pursuant to said Ordinance No.
4891, and running from said point west in Ash Street to the inter-
section of Ash Street and DesT,ioines Avenue, is in reed of repair
and reconstruction by reason of damage caused by flood waters; and

WHEREAS, in the judgment of the'overnin q body of the City of Salina
such portion of said sewer should be repaired and reconstructed in

the manner provided by law; and
ViiEi EAS, said sewer serves a substantial portion of said city and

in the judgment of the governing body of said city the cost of re-
pairing and reconstructing the sane should be borne by the city at
large; and
ti'JHIJRLAS, the general fund of said city is insufficient to pay such
cost and such governing body deems it necessary to issue general
improvement bonds of said. city in the manner provided by law to pay

such cost; NM"J THEREFORE

3L IT ORDAINED by the Board of Commiss Loners of the City of Salina,
Kansas:
Section 1. That the foregoing preambles be and they are hereby
adopted as a part of this ordinance and that a certain portion of
the sanitary sewer in Ash Street in the City of Salina commencing
at a manhole in the intersection of Ash Street and Des1doines Avenue
and running thence east 106 feet to the westerly end of that portion

of said sewer which has been and is now being repaired and recon-
i
structed under and pursuant to the provisions of Ordinance Pio. 4891
i
of said city and ander and pursuant to the plans and specifications
of the City Engineer and the contract which was awarded by said city
(

under and pursuant to said Ordinance No. 4891, be repaired and re -
conatructed to such extent as will be necessary within the limits
herein mentioned.

Section 2. That on or before the 9th day of January 1939 the City
Engineer shall prepare and file with the City Clerk plans and speci-
fications for the repair and reconstructing of the portion of said

sewer described in Section 1 hel,eof, together with a detailed estir.-late
of the cost thereof, under oath, and thereafter the City Clerk shall

advertise in the official city paper for three consecutive days for

sealed proposals for the construction of such work accordin,; to the
plans and specifications of the City Engineer. Upon receipt of such
proposals the governing body shall let a contract for such word: and
a
improvements to the lowest responsible bidder therefore, if there

be any whose bid does not exceed the estimate of the City Engineer,

but the city shall reserve the right to reject any or all bids and
i
the estimated cost thereof as provided by law.

the contract price for such work or the cost thereof if done by the
city, shall be issued and sold in the manner provided by law and for
the purpose of paying such bonds and interest as the same become due
and payable, the board of Commissioners shall levy a general tax iipon

all taxable property in the City of Salina in the time and manner pro-
vided by law.
Section 4. This ordinance shall take eff:ct and be in force from
and after its publication in the official city paper.

by the city, shall be issued and sold in the manner provided by
law and for the purpose of paying such bonds and interest as the
same become clue and payable, the Board of Commissioners shall levy
a general tax upon all taxableproperty in the City of Salina in the
time and manner provided by law.
Section 4. This ordinance shall take effect and be in force from
and after its publication in the official city paper.
