ORDINANCE NO. 4917

AN ORDINANCE relating to and apportioning and levying special assess-
ments on certain lots and pieces of ground in the City of Salina
to pay the cost of curbing and guttering Clark Street from the
south line of Walnut Street to the north line o pruce Street;
Columbia Avenue from the south line of Iron Avenue to the north
line or Gypsum Avenue; Front Street from the north line of Iron
Avenue to the south line o sh=reet; Seventh Street from the
north line of Pacific Street to the south line o ars Avenue;
and for the paving of the alley lying between Santa Fe Avenue
and Fifth Street from the nortR line of Mulberry Street to the
north line of Walnut Street; and relating to and providing for
the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for the purpose of paying for that pa. -:t of the
cost of inprovements of certain portions of certain streets as herein-
after set forth in the following sections of this ordinance which is
chargeable to the private property in the assessment districts for
each of such improvements, respectively, as set forth in the follow-
ing sections of this ordinance and which cost is hereby determined
to be the sums hereinafter set forth in the following sections of
this ordinance with respect to each of such improvements, there are
hereby levied and assessed on the property liable therefor, being
all of the lots and pieces of ground lying on either side of said
streets so improved, respectively to the middle of the block for the
distance improved, with respect to the improvements mentioned in
Sections 2, 3, 4 and 5 of this ordinance, and being all of the lots
and pieces of land abutting on the alley to be improved, as mentioned
in Section 6 of this ordinance, according to the appraised value of
such lots and pieces of ground with respect to each such improvement,
without regard to the buildings or improvements thereon, special assess-
ments covering the cost of such work and improvements, said special
assessments being based on the special valuation and appraisement of
said lots and pieces of ground heretofore made by three disinterested
appraisers appointed by the Board of Commissioners of the City of Salina,
Kansas, with respect to each such improvement, which said appraisements
are hereby referred to and made parts of this ordinance, and the several
amounts levied, apportioned and assessed agai st the lots and pieces of
ground for each of such improvements, respectively, for the purposes
aforesaid are hereby found and determined to be the amounts set forth
in the following sections of this ordinance with respect to each of

Section 2. For that part of the cost of the curbing and
guttering of Clark Street from the south line of Walnut Street to
the north line of Spruce Street which is chargeable against the private
property liable therefor, and which cost is hereby determined to be

the alley
lying between Santa Fe Avenue and Fifth Street from the north line
of Mulberry Street to the south line of Walnut Street which is charge-
able against the private property liable therefor, and which
cost is
determined to be 01,841.58 there is hereby levied, apportioned
and
assessed against the following described lots and pieces of
land, as
provided for in Section 1 of this ordinance, the following
amounts:
liability by paying into the City Treasury the entire amount charge-
able against the same, as in this ordinance designated at any time
within thirty days after the publication of this ordinance and before
the issuance of the bonds of said city in payment of the balance of
the cost of said improvements, and the property so paid on shall
not thereafter be liable for any further assessments for the cost
of said improvements nor for any part of said bonds.

Section 8. -'here is hereby further levied and assessed against
each lot and piece of ground described in this ordinance 4 per cent
interest per annum on all of said installments therein mentioned
from the date of the bonds which may be issued at the end of thirty
days as specified in the preceding section hereof, as by law provided

Section 7. Said amounts levied, apportioned and assessed
aforesaid
shall be due and collectible in ten equal installments
the first be-
coming due with the taxes levied for the year 1939 and
one of said
installments falling due each and every year thereafter
until all
are paid, and all to be collected with interest as in this ordinance
r provided; PROVIDED HOWEVER, that the owner of any piece
of property
liable for any such assessment may redeem his property from such
liability by paying into the City Treasury the entire amount charge-
able against the same, as in this ordinance designated at any time
within thirty days after the publication of this ordinance and before
the issuance of the bonds of said city in payment of the balance of
the cost of said improvements, and the property so paid on shall
not thereafter be liable for any further assessments for the cost
of said improvements nor for any part of said bonds.

Section 8. -'here is hereby further levied and assessed against
each lot and piece of ground described in this ordinance 4 per cent
interest per annum on all of said installments therein mentioned
from the date of the bonds which may be issued at the end of thirty
days as specified in the preceding section hereof, as by law provided
to the time of collection of the last installment as provided by law,
which said interest shall be collected annually at the same time and in
the same manner as said installments are collected; and after the taking
j effect of this ordinance it shall be the duty of the City Clerk of said
city to annually at the same time other taxes are certified and until all
of said assessments so apportioned and levied herein have been certified,
to certify to the County Clerk of Saline County, Kansas, a full list of
all property liable to assessment and taxation for such work and improve-
ment, except such property on which the.special assessmeiits-aforesaid

have been paid in full as hereinbefore provided, together with the
respective amounts due on each of such lots and pieces of ground, which
i
amounts shall include the annual installments of such special assessments
together with the interest for one year at the rate of 4 per cent per
annum on all unpaid balances of such assessments at the beginning of each
year as aforesaid, and such amounts so certified as herein provided for
shall be placed upon the tax roll by the County Clerk of Saline County,
Kansas and collected as other taxes are collected.
I Section 9. This ordinance shall take effect and be in force from
and after its publication in the official city paper.

Section 7. Said amounts levied, apportioned and assessed
aforesaid shall be due and. collectible in ten egillal installments
the first becoming due with the taxes levied for the year 1::39 and
one of said installments fallin due each and every year thereafter
lentil all are paid, amid all to be collected with interest as in

niece or property liable for any such assessment may redeem his
property from such liability by paying; into the City Treasury the
entire amount chargeable against the same, as in this ordinance
desi;iated at any time within thirty days after the publication of

in Da;rnent of the balance of the cost of said L provements, and t e
property so paid on shall not thereafter be liable for any further
assess�jients for the cost of said improvements nor for any )art of
said bonds.
Section .8 . There is hereby f -.rt'- er levied and -assessed
against each lot and piece of ground described. in t:_is ordinance
per cent interest per annum on all of said installments
t? erein rlentioned from the date of the bonds which may be issued
at the end ow' thirty days as s;ecified in the preceding; section
hereof, as by law provided, to the time of collection of the last

are collected; and after the takin effect of this ordinance it shall
