5224 Confirm Utility ImprovementsORDINANCE NO. 5224 (First published in the Salina Journal JW -Q Az 1947) AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction Coi:ipany for the construction of certain lateral sanitary sewers in the City of Salina, heretofore designated as Lateral Sanitary Sewer Districts No. 210, 211, 212 and 213, and for the construction of certain main Sewers in Main Sewer District "T" and Main Sewer District "U", heretofore created, and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor Construction, hereinafter referred to as the "contractor", as submitted to the Board of Commissioners on May 19, 1947, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by its Mayor an May 19, 1947, for the construction of certain public improvements in the City of Salina, to -wit: (1) A lateral sanitary sewer in a certain Benefit District, being Lateral Sanitary Sewer No. 210, as heretofore provided by Ordinance No. 5212, as follows: Construction of an 8" V.C.P. lateral sanitary sewer, with allnecessary connections, manholes, .flush tanks and other appurtenances, beginning at a manhole to be constructed as a part of Main Sanitary Sewer "T" in Lincoln Street on the south parking of Broadway Boulevard as provided by Ordinance No. 5210, thence south in the center line of said alley 580 .feet, more or less, as an 8" V.C.P. lateral sanitary sewer, to the north line of Lots 45 and 46 in Block 5, North Park Addition to the City of Salina, Kansas, being the terminus of said lateral sanitary sewer. (2) A lateral sanitary sewer in certain Benefit District, being Lateral Sanitary Sewer No. 211, as heretofore provided by Ordinance No. 5212, as follows: Construction of an 8" V.C.P. lateral sanitary sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed, as a part of Main Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 5210, and at a point between the lines extended, of a certain north and south public alley next east of Barney Street, thence north in the center line of said alley 320 feet, more or less, to a manhole to be constructed in the south parking of Broadway Boule- vard, being the terminus of said sewer. (3) A lateral sanitary sewer in certain Benefit District being Lateral Sanitary Sewer No. 212, as heretofore provided by Ordinance No. 5212 as follows: Construction of an 8" V.C.P. lateral sanitary sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed as a part of pain Sanitary newer "T" in Lincoln Street, as provided by Ordinance No. 5210, at a point on the south parking of Broadway Boulevard, thence southwesterly 100 feet more or less, to a manhole to be constructed at the center line of a north and south public alley next east of Whitredge Street, thence south in said alley 550 feet, more or less, to a manhole to be constructed at the north line of Lots 45 and 46 in Block 4, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. (4) A lateral sanitary sewer in certain Benefit District being Lateral Sanitary Sewer No. 213, as heretofore provided by Ordinance No. 5212 as follows: Construction of an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed as a part of Main Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 5210, at a point on the south parking of Broadway Boulevard, thence northwesterly in Broadway Boulevard to a manhole to be con- structed in the center of the north and south public alley next east of Whitredge Street, thence north in the center line of said alley 140 feet, more or less, to the south line of Lots 31 and 32 in Block 1, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. (5) A Main Sanitary Sewer in certain Benefit District, being �� Main Sewer T" as heretofore provided for by Ordinance No. 5210, as follows; Construction of a Main Sanitary Sewer, with all nec- essary connections, manholes and other appurtenances, beginning at a manhole over an existing 10" sanitary sewer in Lincoln Street at a point within the north and south alley lines extended, of the alley next east of Reynolds Street, thence west in Lincoln Street to a manhole to be constructed within the lines of a north j and south alley extended, next east of Barney Street, thence west in said Lincoln Street 230 feet more or less, all as an 8" V.C.P. main sanitary sewer, to a manhole to be constructed in the south parking of Broadway Boulevard, being the terminus of said main sewer. (6) A Main Sanitary Sewer in a certain Benefit District, being Main Sewer "U" as heretofore provided for by Ordinance No. 5211, as follows: Construction of a blain Sanitary Sewer, with all nen- essary connections, manholes and other apurtenances, beginning at an existing manhole in Pacific Avenue at the intersection of Pacific Avenue and a certain north and south public alley between Tenth Street and Eleventh Street, thence west in Pacific Avenue j a distance of 330 feet, more or less, as a 12" V.C.P. main sani- tary sewer to a manhole to be constructed at the intersection of Pacific Avenue and a certain north and south public alley between Eleventh Street and Twelfth Street being the terminus of said main sewer. R at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the I City Engineer on file in the office of the City Clerk, which estimates are here- by referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accord- ance with the plans and specifications therefore prepared by the City "ngineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. I Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 4 1/2 percent i per annum and to mature not later than June 1st, 1948 and to be issued in such i amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. i Section 4. (3) A lateral sanitary sewer in certain Benefit District being Lateral Sanitary Sewer No. 212, as heretofore provided by Ordinance No. 5212 as follows: Construction of an 3" V.C.P. lateral sanitary sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed as a part of liain Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 5210, at a point on the south parking of Broadway Boulevard, thence southwesterly 100 feet snore or less, to a manhole to be constructed at the center line of a north and south public alley next east of Whitredge Street, thence south in said alley 550 feet, raore or less, to a manhole 'Lo be constructed at the north line of Lots 45 and 46 in Block 4, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. (4) A lateral sanitary sewer in certain Benefit District being Lateral SanitLry Sewer No. 213, as heretofore provided by Ordinance No. 5212 as follows: Construction of an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed as a part of Dain Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 5210, at a point on the south parking of Broadway Boulevard, thence northwesterly in Broadway Boulevard to a manhole to be constructed in the center of the north and south public alley next east of Whitredge Street, thence north in the center line of said alley 140 feet, more or less, to the south line of Lots 31 and 32 in Block 1, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. (5) A T,iain Sanitary Sewer in a. certain Benefit District, being r,,.ain Sewer "T" as heretofore provided for by Ordinance No. 5410, as follows: Construction of a i::ain Sanitary Sewer, with all nec- essary connections, manholes and other appurtenances, beginning at a manhole over an existing 10" sanitary sewer in Lincoln Street at a point within the north and south alley lines extended, of the alley next east of Reynolds Street, thence west in Lincoln Street to a manhole to be constructed within the lines of a north and south alley extended, next east of Barney Street, thence west in said Lincoln Street 230 feet more or less, all as an 8" V.C.P. train sanitary sewer, to a manhole to be constructed in the south parking of Broadway Boulevard, being the terminus of said main sewer. (6) A Main Sanitary Sewer in a certain Benefit :District, being main Sewer "ti" as heretofore provided far by Ordinance No. 5211, as follows: Construction of a twain Sanitary Sewer, with all nec- essary connections, manholes and other appurtenances, beginning at an existing manhole in Pacific Avenue at the :intersection of Pacific Avenue and a certain north and south public alley between Tenth Street and Eleventh Street, thence west in Pacific Avenue a distance of 330 feet, more or less, as a 12" V.C.P. main sani- tary sewer to a manhole to be constructed at the intersection of Pacific Avenue and a certain north and south ;public alley between Eleventh Stret and Twelfth Street being the terminus of said main sewer. at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the sane is riereby ratified and confirged, said proposal being within the estimated cost of said improvements as sno&n by tae sworn estimates of the City EnL-ineer on file in tre office of the City Clerk, which estimates are hereby referred to and {lade a part of this ordinance. Section 2. Said improvements shall be built and constructed in accord- ance with the plans and specifications therefore prepared by the City r-ngineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the tarms of said contract, all of which are hereby referred to and wade parts of t=iis ordinance. Section 3.
