5212 Utility Improvements North Park AdditionORDINANCE NO. 521(22 (Published -in _-the Salina_ Jrturns.L,1 i i AN ORDINANCE creating and defining certain Lateral Sanitary Sewer Districts in the City of Salina designated as Lateral Sanitary Sewer Districts No. 210, 211, 212 and 213, and providing for the construction of Lateral Sanitary Sewers in said Lateral Sanitary Sewer Districts No. 210, 211 and 212 and 213 so j created, and providing for the payment of the cost thereof and for the levy- ing of special assessments against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District No. 210. That there be and there is hereby created, a lateral sanitary sewer distfict in the City of Salina which shall be and is hereby designated as Lateral Sanitary Sewer District No. 210, and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Lots 1 to 46, both inclusive, in Block 5, North Park Addition to the City of Salina, Kansas. Section 2. That it is necessary and it is hereby ordered that an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flush tanks and i other appurtenances be constructed and built in and to serve said lateral sewer district No. 21C as created by Section 1 of this ordinance along the following course, to -wit: Beginning at a manhole to be constructed as a part of Main Sanitary Sevier "T" in Lincoln Street on the south parking of Broadway Boulevard as provided by Ordinance No. 5210, thence south in the center line of said alley 580 feet, more or less, as an 8" V.C.P. lateral sanitary sewer, to the north line of Lots 45 and 46 in Block 5, North Park Addition to the City of Salina, Kansas, being the terminus of said lateral sanitary sewer. Section 3. Lateral Sanitary Sevier District No. 211. That there be and there is hereby created, a lateral sanitary sewer district in the City of Salina i which shall be and it is hereby designated as Lateral Sanitary Sewer No. 211 and I which district shall include all the following described property in the City of Salina, to -wit: i Lots 22, 24, 26 and also Lots 28 to 46, both inclusive, in Block 2, North Park Addition to the City of Salina, Kansas. Section 4. It is necessary and it is hereby ordered that an 8" V.C.P. lateral sanitary sewer with allnecessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District No. 211, as created by Section 3 of this ordinance, along i the following course, to -wit: Beginning at a manhole to be constructed, as a part of Main Sanitary Sewer "T", in Lincoln Street, as provided by Ordinance No. 5210, and at a po nt between the public alley next east lines of Barney extended, of Street, thence a certain north and south north in the center line of said alley 320 feet, more or less, to a manhole to be con- structed in the south parking of Broadway Boulevard, being the terminus of said sewer. Section 5. Lateral Sanitary Sewer District No. 212. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be and it is hereby designated as Lateral Sanitary Sewer Distract No. 212 and which district shall include all the following described property in the City of Salina, to -wit: Lots 1 to 46, both inclusive, in Block 4, North Park Addition to the City of Salina, Kansas. Section 6. It is necessary and it is hereby ordered that an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Oewer District No. 212 as created by Section 5 of this ordinance, along the following course, to -wit: Beginning at a manhole to be constructed as a part of Lain Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 5210, at a point on the south parking of Broadway Boulevard, thence southwesterly 100 feet more or less, to a manhole to be constructed at the center line of a north and south public alley next east of VBhitredge Street, thence south in said alley 550 feet, more or less, to a manhole to be constructed at the north line of Lots 45 and 46 in Block 4, North Park Addition to the City of Salina, Kansas, being the term'. -nus of said sewer. Section 7. Lateral Sanitary Sewer District No. 213. That there be and there is hereby created, a lateral sanitary seiAer district in the City of Sal'na which shall be and it is hereby designated as Lateral Sanitary Sewer District No. 213 and which district shall include all the following described property in the City of Salina, to -wit: Lots 31 to 45, both inclusive, in Block 1, North Park Addition to the City of Galina, Kansas. Section 8. It is necessary and it is hereby ordered that an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District No. 213, as created by Section 7 of this ordinance, along the following course, to -wit: Beginning at a manhole to be constructed as a part of Dain Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 5210, at a point on the south parking of Broadway Boulevard, thence northwesterly in Broadway Boulevard to a manhole to be constructed in the center of the north and south public alley next east of V7hitredge Street, thence north in the center line of said alley 140 feet more or less, to the south line of Lots 31 and 32 in Block 1, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. Section 9. That the City engineer shall on or before April 28, 1947, prepare and file in the office of the City Clerk, separate plans and specifications for the construction of each of the Lateral sanitary sewers provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Colualssioners detailed estimates under oath of the cost thereof. That thereafter the City Clerk shall ad- vertise for three consecutive dans in the official city paper for sealed proposals I for the building and construction of such sewers according to such plans and f specificatons, which propaals shall be filed with the City Clerk on or before the tire fixed in such notice, at which time the Board of Commissioners may let a con- tract for the building and construction of such sewe s to the lowest and best re -s - i ponsible bidder or bidders therefor, if there be any whose bid does not exceed the estimated cost thereof,but said Board shall reserve the right to reject any or all of such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improve- ments within the estinnted cost thereof as provided by law. Section 10. That for the cost of bu'lding and construction each of such sewers, spo cial assessments shall be made for the full cost thereof on all lots or pieces of land within the sewer district within and for which each of such sewers shall be built, according to the appraised value thereof, without regard to the improvements or bu'ldings thereon. Section 11. After the passage and publication of this ordinance, the Board of Comm ssioners shallappoint theree disinterested a;.)praisers, who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointment proceed to appraise all of the 4 - lots or pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the building or improvements thereon, and after making said appraisements shall return to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or p'_ece of land, if, in their opinion, the same had been appraised too high or too low. i Section 12. The special assessments herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the o,•,ner of any property liable to such assessment may within thirty days from the i date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessments for the cost of such im- provements, and bonds as hereinafter provided for shall be issued for the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 13. For the purpose of paying for the work and ii-provements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvements, and to run for a period of four ;years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according; to law; and for the purpose of paying t,,e nrincipal and interest on said bonds as they severally become due and payable, the Board of Commlissioners shall apporti n and assess against the lots or nieces of land within the taxing districts of such im- provements special assessments covering the cost of such improvements and the apportion- ment therein contained shall hold good for all of the installments that are to be collected from the specific property chargea'-)le with said improvements, such assess- ment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, niece or parcel of land within the taxing districts and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of tali^.a �'ounty, Kansas, a full list of all property liable for such work and irprovements, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and in- terest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 3. Lateral Sanitary Sewer District No. 211. That there be and there is hereby created, a lateral sanitary sewer district in the City of Salina which shall be and it is hereby designated as Lateral Sanitary Sewer No. 211 and which district shall include all the follmVi-a- described property in the City of Salina, to -writ: Lots 22, 24, 26 and also Lots 28 to 46, both inclusive, in Block 2, North Park Addition to the City of Salina, Kansas. Section 5. Lateral Sanitary Sewer District No. 212. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be and it is hereby designated as Lateral. Sanitary Sewer District No. 212 and which district shall include all the following described property in the City of Salina, to-vrit: Lots 1 to 46, both inclusive, in Block 4, North Park Addition to the City of Salina, Kansas. Section 6. It is necessary and it is hereby ordered than an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District No. 212 as created by Section S of this ordinance, along the follouvinp course, to wit: Beginning at a manhole to be constructed as a part of Main Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No.5210 , at a point on the south parking of Broadway Boulevard, thence southwesterly 100 feet more or less, to a manhole to be constructed at the center line of t a north and south public alley next east of 'Tahitredge Street, thence south in said alley 550 feet, more or less, to a manhole to be constructed at the north line of Lots 45 and 46 in Block 4, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. Section 7. Lateral Sanitary Sewer District: No. 213. That there be and there is hereby created, a lateral sanitary sewer district in the City of Salina which shall be and it is hereby designated as Lateral Sanitary Sewer District No. 213 and which district shall include all the following described property in the City of Salina, to -wit: Lots 31 to 45, both inclusive, in Block 1, North Park Addition to the City of Salina, Kansas. Section 8. It is necessary and it is hereby ordered that an 8" V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary "ewer District No. 213, as created by Section -Of this ordinance, along the follovring course, to -wit: Beginning at a manhole to be constructed as a part of Main Sanitary Sewer "T" in Lincoln Street, as provided by Ordinance No. 521.0-4 at a point on the south parking of Broadway Boulevard, thence northwesterly in Broadway Boulevard to a manhole to be constructed in the center of the north and south public alley next east of �Ihitredge Street, thence north in the center line of said alley 140 feet more or less, to the south line of Lots 31 and 32 in Block 1, North Park Addition to the City of Salina, Kansas, being the terminus of said sewer. Section 9. That the City Engineer shall on or before , 1947, prepare and file in the office of the City Clerk, separate plans and specifications for the construction of each of the lateral sanitary sewers provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners detailed estimates under oath of the cost thereof. That thereafter the City Clerk shall advertise for three con- secutive days in the official city paper for sealed proposals for the build- ing and construction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a con- tract for the building and construction of such sewer6to the lotrrest and best or bidders responsible bidder/therefor, if there be any whose bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all of such proposals, and if no bid shall be received within such estim- ate, the Board of Commissioners shall have the power to do such lsrork and make such Lmprovements within the estimated cost thereof as provided by law. Section 10. That for the cost of building and constructing each of such sewers, special assessments shall be made for the full cost thereof on all lots or pieces of land within the sewer district vrithin and for which each of such sewersshall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 11. After -the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation for the cost of such improvements, shall within five days after having; been notified of their appointment pro- r ceed to appraise all of the lots or pieces of land within such district ii liable -to assessment and taxation as aforesaid, without regard to the build - P ing or improvements thereon, and after making said appraisements shall re- turn to the Board of Commissioners of said city and said Board shall desig- nate a time for holding a special meeting of said 3oard for the purpose of hearing any complaints that may be made as to the value of any lot or piece i of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same had been appraised too high or too low. Section 12. Section 13. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners are hereby author- ized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvements, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed, ji five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering; the cost of such improvements and the apportion- ment therein contained shall hold good for all of the installments that are i l to be collected from the specific property chargeable with said improvements, i such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing districts and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of I Saline County, Kansas, a full list of all property -liable for such work and improvements, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual install- ments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 14. This Ordinance shall take effect and be in full force from and after its publication in the official city paper.
